HomeMy WebLinkAboutZBA Minutes 1969-05-20 117 TOWN OF ITHACA ZONING BOARD OF APPEALS MINUTES MAY 20 , 1969 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Town Offices , 108 E . Green St . , Ithaca , New York at 7 : 30 P . M . on Tuesday the 20Lh day of May , 1969 , PRESENT : David Powers Anselm Soyring Loran Marion David Cowan , Zoning Officer ABSENT : Roger Sovocool Robert Powers ALSO PRESENT . Mr . & Mrs . Wayne Albro , 908 Danby Road Mr . Apolinar Sanchez , 1341 Slaterville Road Mr . Jason Millman , 105 Christopher Circle APOLINAR SANCHEZ - 1341 SLATERVILLE ROAD - VARIANCE Mr . Cowan read the Legal Notice as published in the Ithaca Journal for this and the following two cases . Mr . Apolinar Sanchez had been denied a permit to remodel a garage and porch at 1341 Slaterville Road under Article IV , Section 13 of the Zoning Ordinance , Mr . Cowan read Section 13 and 14 of the Zoning Ordinance re - lating to uses permitted in Residence Districts R- 15 which also pertains to the following case . Mr . Sanchez stated that his present garage is too narrow to park a car in . The porch roof would be extended three feet and widened four feet to convert it into a garage . It was also stated that there is a set back of forty feet . The matter was discussed . Upon motion by Mr . Loran Marion , seconded by Mr . Anselm Soyring and carried by unanimous vote , it was moved that the variance be granted on the following findings of fact . 1 ) The garage is of an inadequate size to accomodate the present needs of the owner 2 ) Spirit of ordinance observed 3 ) Public safety and welfare secured 4 ) Substantial justice done 5 ) Consideration of the promotion of the health , safety , morals or general welfare of the community in harmony with the purpose of the ordinance . NOTE : No persons appeared in opposition to the foregoing . JASON MILLMAN - 105 CHRISTOPHER CIRCLE - VARIANCE Mr . Jason Millman had been denied a permit to remodel and extend a house at 105 Christopher Circle under Article IV , Section 13 of the Zoning Ordinance , Mr . Millman presented a petition from his neighbors on both sides of the property stating that they had no objection to the proposed use and a list of several addresses where garages had extended beyond the front of the house . The matter was discussed . Upon motion by Mr . David Powers , seconded by Anselm Soyring and carried by unanimous vote , it was moved that the variance be granted on the following findings of fact . 1 ) The house is of an inadequate size to accomodate the present needs of the owner 2 ) Spirit of ordinance observed 3 ) Public safety and welfare secured 4 ) Substantial justice done 5 ) Consideration of the promotion of the health , safety , morals or general welfare of the community in harmony with the purpose of the ordinance NOTE : No persons appeared in opposition to the foregoing . MRS . WAYNE ALBRO - 908 DANBY ROAD - VARIANCE Mrs . Wayne Albro had been denied a permit for change in Noncon- forming Use -from Multiple Residence to Tourist Home at 908 Danby Road under Article XII , Section 55 of the Zoning Ordinance . Mr . Cowan read the letter from Mrs . Albro in which they stated that they would like to change their four apartment dwelling into a Tourist Home since there was a definite need for one in the vicinity with Ithaca College being so close . It was pointed out by Mr . Cowan and the Board that once it was turned into a Tourist Home it wouldn ' t be possible to go back to a multiple residence . The matter was discussed . 119 Zoning Board of Appeals Minutes - May 20 , 1969 Upon Motion by Mr . . Loran Marion , the Zoning Board of Appeals ruled that this is permissible for the nonconforming use of 908 Danby Road and may be changed to a more restrictive use . The motion was seconded by Mr . Anselm Soyring and carried by u unanimous vote on the following findings of fact : 1 ) Practical difficulties or unnecessary hardship 2 ) Spirit of ordinance observed 3 ) Public safety and welfare secured 4 ) Substantial justice done 5 ) Consideration of the promotion of the health , safety morals or general welfare of the community in harmony with the purpose of the ordinance . Since the request was for a more restrictive nonconforming use it was granted . It was further stated that the Albro ' s did not have to exercise the variance if they did not elect too . NOTE ; No persons appeared in opposition to the foregoing . The meeting was adjourned at 9 : 00 P . M . Respectfully submitted , Ruthann Brown
