HomeMy WebLinkAboutZBA Minutes 1969-04-15 113 TOWN OF ITHACA ZONING BOARD OF APPEALS MINUTES APRIL 15 , 1969 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Town Offices , 108 E . Green Street , Ithaca , New York at 7 : 30 P . M . on Tuesday the 15th day of April 1969 , PRESENT : Robert Powers David Powers Ans'elm Soyring Loran Marion Roger Sovocool David Cowan , Zoning Officer ALSO PRESENT . Mr . Douglas Clark , 679 Coddington Road Mr . Leland R . Crawford , 1128 E . Shore Drive Mr . & Mrs . Lawrence S . Miller , 242 DuBois Rd . Mr . Alfred Cook , Coy Glenn Road DOUGLAS CLARK - 679 CODDINGTON ROAD - VARIANCE Mr . Cowan read the Legal Notice as published in the Ithaca Journal for this and the following three cases . Mr . Clark had been denied a permit to erect a storage building and use of same for storage and housing a horse at 679 Coddington Road under Article V . Section 18 -8a of the Zoning Ordinance . Mr . Cowan presented pictures of the site and asked Mr . Clark to further explain the outlay of the land . The matter was discussed and the Board adjourned for 30 minutes . Upon motion by Mr . Roger Sovocool , seconded by Mr . Robert Powers and carried by unanimous vote , it was moved that the variance be granted to Douglas R . Clark to erect an accessory building 20 feet by 30 feet , no closer than 10 feet from any 16t line . No closer than 325 feet from the street line . That this building may house no more than two ( 2 ) horses and this decision is sub - ject to review by the Zoning Officer upon development of the adjoining premises on the southeast based on the following findings of fact : 1 ) Land to rear of lot is low and wet so that any accessory building if erected at the rear of the lot must be closer to the lot line than 30 feet . 2 ) An accessory building housing a horse 10 feet from a lot line would not be detrimental to health , safety , morals 114 or general welfare of the community in harmony with the purpose of the ordinance . NOTE : No persons appeared in opposition to the foregoing . LELAND R.es CRAWFORD - 1128 E . SHORE DRIVE - VARIANCE Mr . Leland R . Crawford had been denied a permit to remodel and extend a house at 1128 E . Shore Drive under Article IV , Section 14 of the Zoning Ordinance . Mr . Cowan presented a letter to the Board from Mr . Brown ( neighbor ) stating no objection tolthe proposed use and asked Mr . Crawford to present his architectural drawings , The matter was discussed . Upon motion by Mr . Robert Powers , seconded by Mr . Anselm Soyring and carried by unanimous vote , it was moved that the variance be granted on the following findings of fact : 1 ) There is a practical difficulty due to the topography , location of the septic tanks , railroad and highway . 2 ) Spirit of ordinance observed . 3 ) Public safety and welfare secured . 4 ) Substantial justice done . 5 ) Consideration of the promotion of the health , safety , tmo morals or general welfare of the community in harmony with the purpose of the ordinance . NOTE : No persons appeared in opposition to the foregoing . ALFRED P . COOK - COY GLENN ROAD - VARIANCE Mr . Alfred P . Cook had been denied a permit to extend an apart - ment structure at 721 Five Mile Drive under Article XII , Section 54 of the Zoning Ordinance . Mr . Cook presented his architectural drawingsā€˛ and insurance appraisals . Mr . Cook stated that the apartment duplex , at completion , would have the same number of apartments as it originally did . The matter was discussed . Upon motion by Mr . Roger Sovocool , seconded by Mr . Robert Powers and carried by unanimous vote , it w4s moved that the variance be granted on the following finds of fact : 1 ) The building be extended to the north 22h feet . 2 ) The extension be used for single apartment use . 3 ) This use is in conformity with the pre - existing use . NOTE : No persons appeared in opposition to the foregoing . 115 Zoning Board of Appeals Minutes - April 15 , 1969 LAWRENCE S . MILLER - 242 DUBOIS ROAD - VARIANCE Mr . Lawrence S . Miller had been denied a permit to remodel family home at 242 DuBois Road under Article V . Section 18 - 2 of the Zoning Ordinance . Mr . Cowan presented pictures of the exterior of the house to the Board . Mr . Miller presently has two apartments ( one in which , he and his wife live ) and would like permission to have another apartment . The matter was thoroughly discussed . Upon motion by Mr . Robert Powers , seconded by Mr . David Powers and carried by unanimous vote , Mr . Miller ' s appeal for a variance was denied in that it was not shown that there are practical difficulties or unnecessary hardship . Mr . Tony Egner of Egner & Niederkorn Associates Inc . pre - sented the preliminary plans for the two Jr . Highs . This meeting was adjourned at 10 : 00 P . M . Respectfully submitted , Ruthann H . Brown
