ZONING BOARD OF APPEALS MINUT 'E' S
October 23 , 1968
A meeting postponed from October 15 , 1968 , of the Town of Ithaca
Zoning Board of Appeals was held at the Town Offices , 108 East
Green Street , Ithaca , New York at 7 : 30 P . M . on Wednesday ,
October 23 , 1968 .
Members of the Boars present : Acting Chairman Robert Powers ,
Loran Marion , Andy Soyring , Zoning Officer David Cowan , and
Secretary Robert Soyring ,
Acting Chairman Robert Powers called the meeting to order at
7 : 30 P . M .
BILLY J . BELOUS - 174- 176 KENDALL AVENUE
Mr . Belous in appealing to the Board to construct a two -family
dwelling at 174- 176 Kendall Avenue , had prior to the Board
meeting revised his plans conforming to the Zoning Ordinance .
The Board recommended that the appeal be withdrawn and revised
plan be submitted to the Zoning Officer who would issue the
necessary permit .
T . G . OVERBAUGH - 1469 TRUMANSBURG ROAD
Mr . Overbaugh appealed to the board to construct a two - car
garage at 1469 Trumansburg Road . The Zoning Board of Appeals
ruled that a variance need rot be granted . The finding of
the Board was based on the interpretation of the Zoning
Ordinance of the Town of Ithaca , Article 5 , Section 20 , which
states that a garage in a rear yard may be as near as 3 feet
to any side or rear lot line . Mr . Overbaugh ' s garage will
be built at least 10 feet from any lot line .
No persons appeared in opposition to either of the two fore -
going appeals .
This meeting was adjourned at 8 : 00 P . I4[ .
