ZONING BOARD OF APPEALS MINUTES
OCTOBER 17 , 1967
A Regular Meeting of the Town of Ithaca Zoning Board of Appeals
was held on Tuesday , October 17 , 1967 , at the Town of Ithaca
Offices , 108 East Green Street , Ithaca , New York .
Members of the Board present : Chairman David Powers , Loran
Marion , Roger Sovocool , Zoning Officer Donald Franklin and
Secretary Cheryl S . Beninatip
Others present : Harry Swansborough
LOUIS J . PROSPERI - 1223 TRUMANSBURG ROAD - VARIANCE
Chairman David Powers called this Public Hearing to order at
7 : 30 P . M . Zoning Officer Donald Franklin read the legal ad
as published in the Ithaca Journal . Mr . Swansborough , con-
tractor , appeared on behalf of Mr . Prosperi , appealing from
the decision of the Zoning Officer denying permission for
the extension of a garage at 1223 Trumansburg Road under
Article IV , Section 14 of the Zoning Ordinance .
Mr . Swansborough pointed out that the proposed construction
would be within two feet of the north lot line and that the
Goldsmith Nursing Home is 50 feet from this side lot line .
Mr . Prosperi is crippled and the proposed construction is
for the purpose of facilitating the use of his wheelchair .
Mr . Swansborough stated that the garage would be L- shaped ,
extending 15 feet to the east , will coincide with the rest
of the house at an estimated cost of $ 2 , 000 .
Upon motion by Mr . Marion , seconded by Mr . Sovocool and
carried by unanimous vote , it was moved that the variance
be granted to build an addition to a garage at 1223 Trumans -
burg Road based on the following findings of fact :
1 . There are no safety problems ;
2 . It is in general keeping with the character of the neigh-
borhood ;
2 . There is a showing of physical hardship on the part of
the owner .
Note : No persons appeared in opposition to the foregoing .
The meeting adjourned at 7 : 40 P . M .
