HomeMy WebLinkAbout2004-01-06 - PH TOWN OF ULYSSES PUBLIC HEARING // SPECIAL TOWN BOARD JANUARY 6, 2004 PRESENT : Supervisor Douglas Austic ; Councilpeople Lee Scott, Roxanne Marino, - Don Ellis and Robert Weatherby; Code Enforcement Officer Alex Rachun and Marsha L. Georgia, Town Clerk. Others Present : Mr. And Mrs . Robert Brown, Richard Coogan, Planning Board Chairman, Bruce Fellows, Christopher and Pamela Carey, John and Martha Ullberg. Proof of Notice having been furnished, Supervisor Austic called the Public Hearing on the application from Robert Brown of Flo-Tech for a Planned Development District to order at 7 : 00 PM . Supervisor Austic explained the application briefly. Mr. Brown has purchased property on Halseyville Road where he wishes to move his current business (Flo-Tech) located at the Maguire property on Trumansburg Road. The proposal is to create a PDD of three (3) acres, which would include a new facility, and the renovation of the existing barn on the property. Under Town Law the Town Board has the authority to create PDD for activities, which they feel, are appropriate for the community taking into the character of the neighborhood and the concerns of the neighbors . Mr. Austic asked if anyone had any questions for Mr. Brown. Martha Ullberg of 8 South Street asked what Flo-Tech does? Mr. Brown stated that the sole activity is the manufacture of prosthetic devices . Raw materials are received approximately once a week by tractor-trailer. Clients are fitted at the hospital or doctor' s office and the finished device delivered to them. There are usually 6-8 employees, with a maximum of 10 . There are no plans to increase this number. Christopher Carey of 2037 Trumansburg Road stated that he is directly across the street and was concerned about noise, light and traffic . Mr. Brown stated that the employees (6- 8) cars would be parked behind the barn, one truck twice a day, UPS , trash removal weekly and once a month a 18 wheel tractor-trailer brings materials and/or picks up the materials to be recycled. The hours of operation are Sam till 6 : 30pm, but there are a couple of workers who work part-time and may stay later. Everything is self-contained within the building, very little noise. The operation is quiet enough that the offices are not enclosed from the manufacturing operation. The Brown ' s invited anyone to stop in and visit the operation . The lighting proposed is a 100-watt "wall pack" light that will be installed on each side or end of the building. In addition, a typical halogen night- light may be installed on the backside of the existing barn for security purposes . No light will be installed at a height above the roofline of the existing building. It was asked what the current zoning was in this location . Mr. Austic replied that in today' s zoning there are two districts — Business and Agricultural/Residential, this area is zoned Agricultural/ Residential . Mr. Austic asked for additional comments from the public . Bruce Fellows of 7221 Halseyville Road stated that he feels this is a great thing and that we need more business in the area and he is all behind it . , ; I I . Public Hearing/Special Town Board 01 /06/2004 Mr. Carey stated that he is hoping that it will not change things in the community with additional traffic etc. Mr. Ullberg asked what would happen if the Flo-Tech business changed hands or the business changed — would it still be zoned to have a business . Mr. Austic explained that is the advantage of a PDD versus changing the Zone. Any changes in the use or any changes or any kind would have to come back to the Town Board requesting an amendment to the PDD . Martha Ullberg asked about the maintenance of the existing bar. Mr. Brown stated that it does have some rot that needs fixing. The intended use for the barn is to store the materials that will be picked up for recycling every three to six months. The exterior will be the same as the exterior of the new building. The drive way and parking are to be improved with gravel, no asphalt paving is proposed. There was a general consensus that it would be nice if the barn could be renovated but left to look as close to what it is today instead of the metal siding that is purposed. Mr. Austic stated that the file is available for anyone to review and the Brown' s welcomes any visits . Hearing no further comments or questions Mr. Scott moved, seconded by Mr. Ellis to close the Public Hearing. Unanimously approved. Public Hearing closed at 7 : 19 PM. SPECIAL TOWN BOARD MEETING Mr. Austic opened a Special Town Board Meeting to review Part 1 — Projected Information of the SEQR application filled out by the applicants consulting engineer. PUBLIC HEARING ON SEAR After review Supervisor Austic opened up the Public Hearing (7 : 37 PM) on any comments of the application of SEQR Part 1 . Mr. Carey asked about the driveway. Mr. Austic stated that there was concern about the driveway. Tompkins County Highway Superintendent and County Engineer were notified of this concern. They have visited the site and have placed markers where they recommend the driveway to be placed. Hearing no further comments and or questions Mr. Weatherby moved seconded by Mr. Scott to close the Public Hearing on SEQR Review. Unanimously approved. Closed at 7 :40 PM. SPECIAL TOWN BOARD MEETING Part 2 — Projects Impacts and Their Magnitude The Town Board reviewed and filled out Part 2 as follows : 1 . Public Hearing/Special Town Board 01 /06/2004 Mr. Austic stated that this finishes the review — written comments can be made up to ten days . The Town Board will set a date to take action on the application after the ten days . Hearing no further business Mr. Weatherby moved, seconded by Mr. Scott to adjourn the meeting.
