HomeMy WebLinkAboutZBA Minutes 1967-09-19 . 93 TOWN OF ITHACA ZONING BOARD OF APPEALS MINUTES SEPTEMBER 199 1967 A Regular Meeting of the Town of Ithaca Zoning Board of Appeals was held on Tuesday , September 199 1967 at the Town of Ithaca Offices , 108 East Green Street , Ithaca , New York . Members of the Board present : Chairman David Powers , Roger Sovocool , Loran Marion , Zoning Officer Donald Franklin and Secretary Cheryl S . Beninati . Others present : Antonio G . Fernandez , Archie Robertson and Ben Light . ITHACA COLLEGE APPEAL Chairman Powers called this Public Hearing to order at 7 : 45 P . N . Zoning Officer Donald Franklin read the legal ad as published in the Ithaca Journal . Mr . Ben Light , Secretary of Ithaca College , appeared in behalf of the appeal of Ithaca College from the Toning Officer denying permission to conduct business at Danby Road under Article IV , Section 12 of the Zoning Ordinance . Ithaca College wishes to conduct a barber shop business in the basement of Dorm 12 , the westerly of the two 14- story towers . There will be 3350 students on campus this year , and class schedules make it a hardship for the students to travel down- town . Also , the bus service has to be kept at a minimum because of the high cost of operation of the same . It was pointed out that this area is a special zone for educational purposes . There will probablylbe two barbers during the week and three on the weekend operating the pro - posed business . The room is 360 square feet , and this sh6p will be the last business operation to go into this building . Upon motion by Mr . Sovocool , seconded by Mr . Marion and carried by unanimous vote , it was moved to grant special approval to Ithaca College for the operation of a barber shop in the basement of Dorm 12 on the Ithaca College Campus , ARCHIE ROBERTSON - 118 HONNESS LANE - APPEAL Chairman Powers called this Public Hearing to order at 8 : 00 P . M . Zoning Officer Donald Franklin read the legal ad as published in the Ithaca Journals, Mr . Robertson appeared appealing from the decision of the Zoning 94 Officer denying permission for the construction of a one -family dwelling at 118 Honness bane under Article IV , Section 14 of the Zoning Ordinance . Mr . Robertson pointed out that this lot was bought in 1947 prior to the enactment of the Zoning Ordinance . The proposed con- struction would leave 15 feet on one side and only 9 feet on the other side , which lot is 50 feet in width rather than the 100 foot requirement as set forth in the Zoning Ordinance , Mr . Robertson submitted his deed of record under which deed this was a legal building lot when it was purchased . Mr . Fernandez , who wants to buy this lot to build the house , was>> also present . Upon motion by Loran Marion , seconded by Mr . Sovocool and carried by unanimous vote , a variance was granted on the east side yard at 118 Honness Lane to permit construction of a house within 9 feet of the lot line . Findings of Fact : 1 . The lot was created as a 50 foot lot on April 17 , 1947 ( Liber 315 of Deeds ap page 180 ) which is prior to the enactment of the Town of Ithaca Zoning Ordinance . 2 . The next house to the east is approximately 60 feet from the house to be constructed . NOTE : No persons appeared in opposition to either of the above public hearings .
