Hearing Regarding 704 East Miller Road This hearing was held to give the property owner an opportunity to address code violation con- cerns. Code Officer Beeners reported on communication from the real estate agent representing the owner of 704 East Miller Road. They expect to address the violations within the noted time period. No other communication was received regarding this matter. The hearing was closed at 7:06pm. Privilege of the Floor Elizabeth Owens Roe gave a status report of demolition, in process, of the structure damaged by fire on November 11, 2011. Following the information provided by the Roes, the Board agreed that no further discussion of the matter was necessary. Warrants WATER DISTRICT FUND #025-028 for a total$756.99 Moved by Halton, Second by Klein. The motion passed. There was no further discussion. RESOLUTION NO.70 OF 2012-CLOSING OF NY STATE ROUTE 96B FOR PARADE ON JULY 14,2012 Resolved,that the Town Board of the Town of Danby, in compliance with Section 1604, Paragraph 2, of the Ve- hicle and Traffic Law,which authorizes a Town to close a road for a parade, is officially closing New York State Route 96B on Saturday July 14, 2012 from 10:30am to 11:55am,from the intersection of East Miller and West Miller Roads to the intersection of Bald Hill Road; and it is Further Resolved,that the Town Board approves the extension of this time period,from 10:15 am to 12:15pm, if the Danby Fire Department deems such extension necessary to facilitate the safe movement of the Parade par- ticipants; and it is Further Resolved,that there will be a detour route from the West Miller Road intersection with Route 96B to Comfort Road,to Lieb Road,to the Bald Hill Road intersection with Route 96B. In Favor: Connors, Halton, Klein, Race, Dietrich Resolutions Regarding West Danby Water District Improvements Dietrich, Shawley, and Beeners gave an update on the Water District water tank replacement pro- ject. They introduced and explained these resolutions, authorizing the expenditure of funds for grant writing and the submittal of grant proposals, seeking grants to cover the cost of improvements,to various agencies. The firm of T.G.Miller is assisting with grant writing and assuring that the town meets grant cycle deadlines. An income survey is being conducted of households in the West Danby Water District. Informa- tion from this survey will help support various grant proposals. This confidential survey is being co- ordinated by a firm connected with Federal government programs. RESOLUTION NO.71 OF 2012—AUTHORIZE THE WEST DANBY WATER DISTRICT TO SPEND MONEY FOR GRANT WRITING PURPOSES. WHEREAS,the West Danby Water District is in a position to apply for grant money for the West Danby Water District Project.This project involves replacement of the water tank and meters and work on water leak detec- tion, and WHEREAS,the grant application process involves engineering specifications along with a short deadline date for filing, and WHEREAS,the Board of Commissioners has authorized the expenditure of$2,500 for grant writing purposes, NOW THEREFORE IT IS RESOLVED,the Town of Danby Town Board authorizes the expenditure of$2,500.00 to be paid to T.G. Miller,P.C., Engineers and Surveyors, of Ithaca, NY for the purposes of writing and submitting a Community De- velopment Block Grant application, due on July 16, 2012, and assisting with other funding applications. Funds will be expended from the West Danby Water District Fund. Moved by Klein, Second by Connors. The motion passed. In Favor: Connors, Halton, Klein, Race, Dietrich Town Board_Minutes_20120611 •Monday,June 18,2012 Page 2 of 4 RESOLUTION NO.72 OF 2012—AUTHORIZE TOWN SUPERVISOR TO SUBMIT AN APPLICATION TO THE NYS COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FOR FUNDING FOR THE PROPOSED WEST DANBY WA- TER STORAGE TANK REPLACEMENT AND WATER CONSERVATION IMPROVEMENTS PROJECT WHEREAS,the West Danby Water System is in urgent need of a new water storage tank, leak detection, new household meters, new flushing hydrants, and other water conservation measures, in order to maintain a safe, reliable drinking water supply to the households using the water system; and WHEREAS,funding is needed through the NYS Community Development Block Grant Program in order to make such improvements affordable to the Town and the water users; NOW THEREFORE IT IS RESOLVED,that the Town Board of the Town of Danby authorizes the Town Supervisor to sign and have sub- mitted a grant application to the NYS Community Development Block Grant Program for funding for the pro- posed West Danby Water Storage Tank Replacement and Water Conservation Improvements Project. Moved by Klein, Second by Halton. The motion passed. In Favor: Connors, Halton, Klein, Race, Dietrich West Danby Water District Public Hearing/Special Meeting of Town Board Beeners gave the Board an update on what will take place during a public hearing and special meeting of the Town Board at 7pm on June 20, 2012. This hearing is scheduled to take place at the West Danby Fire Hall. The meeting will be held jointly with the Danby Town Board and Water Dis- trict Commissioners. The public hearing is required by the NYS Community Development Block Grant Program. The Town Supervisor called the special meeting and set the date within the confines of necessary publication of legal notice and the grant proposal deadline. Councilperson Klein and Clerk Goddard informed the Board that they will not be able to attend. The Deputy Clerk will attend and the Code Officer volunteered to operate the meeting recording de- vice. The Board will have a quorum for this special meeting. There was a short discussion of who will be presenting information, as required by the Block Grant proposal, and how the Board can best address questions from residents regarding the need for improvements. There was discussion about ways to inform residents of the importance of returning surveys.A 90-95%return is needed in order to accurately assess economic need in support of grant proposals. Grants are needed to fund improvements in order to keep water rates at the same level. Town Board_Minutes_20120611 •Monday,June 18,2012 Page 3 of 4 Solar Liberty Lease Update Dietrich and Beeners gave an update on the status of a possible lease of a solar electric system. The Town Attorney has reviewed the installation agreement and lease. He has suggested changes in some of the wording and terms. Changes to the installation agreement have been approved by Solar Liberty. The Town is waiting for a response to changes to the lease agreement. Beeners provided information about other solar energy lease options. This is the only option cur- rently available to municipalities. Beeners advised that a decision should be made by early July. This is due to a limited number of lease packages available at this time. There may be a resolution author- izing execution at the next TB meeting. Broadband Update Dietrich gave a short report of a meeting about the future of broadband between municipal repre- sentatives and Senator Gillibrand. Dietrich is attending various meetings in an attempt to acquire fi- nancial support for broadband build-out. Town Clerk's Report Goddard gave a brief overview of activities in the Town Clerk's office during the month of May, including 86 dog license renewals, some fishing licenses, and six building permits. Highway Biomass Boiler Beeners gave a short update on the status. Taitem Engineering is investigating whether NY- SERDA will fund cost change orders related to installation problems. There was a$1,500 electric connection that had not been specified in the original contract.A second change order is needed to fix the angle for the feeder auger to the cost of$1,920. It is hoped that NYSERDA will cover the cost of these changes. Once the changes are approved,the installation work on the Biomass Boiler should be complete in approximately three weeks. The Town expects to meet a July 30 deadline for this work. Fun Day Update Beeners gave a short update on progress for Danby Fun Day and Parade. The two fire companies are sharing responsibility for the event this year.Additional community volunteers are needed. Other Reports The Town Justices'report was circulated among Board members.
