Georgia. Others Present : George Kennedy and Jarrett McLaughlin Ithaca Journal Reported . Supervisor Austic called the Public Hearing to order at 7 : 00 p . m . and asked if anyone had any comments . No comments were heard . Supervisor Austic reviewed the Budget line by line . He explained that the copy shows that it is adopted, but that is just because for him to change figures in the budget it moves to the next column the way his program is set up . The reason for most of the changes are from insurance, NYS Retirement and additional revenues that have come in. The most significant revenue changes are in the Sales Tax, Mortgage Tax and the reimbursement from Tompkins County for the snow contract. After readjustment in the revenues he reduced what he used from the fund balances . After the review of all the funds he explained that the new tax rate for General Fund would be a rate of $ . 98845 , which is an increase of . 85 % increase, the General Highway rate is $ . 69148 , which is a decrease of . 42 % . This means the overall tax increase will be .43 % . The Fire Tax although is an increase of 3 . 02 % . Mr. Kennedy asked if there is money for the support of the membership with the Cayuga Lake Water Shed? Supervisor Austic stated that it is covered either under Town Board CE or the account #7550 . Hearing no further comments and/or questions Mrs . Duddleston moved, seconded by Mr. Weatherby to close the hearing. Unanimously approved Public Hearing closed at 7 : 15 p .m . Georgia ''� C Ulysses Town Clerk F TOWN OF ULYSSES SPECIAL TOWN BOARD MEETING NOVEMBER 5, 2003 PRESENT : Supervisor Douglas Austic ; Councilpeople Carolyn Duddleston, Robert Weatherby and Lee Scott ; Councilwoman Sue Poelvoorde absent; Marsha L. Georgia, Ulysses Town Clerk. Others present : George Kennedy Supervisor Austic opened the Special Board Meeting at 7 : 25 p .m . to continue with the review of the Draft Zoning Ordinance . At the last meeting it was discussed about property that has been set a side in some kind of special Conservation Zone and/or Land Trust. Supervisor distributed a map that the Tompkins County Planning sent to him titled "Protected by Ownership" Included in this coverage are lands that clearly are protected for their natural resource values (called "Natural Areas") and these lands are protected open spaces and may provide important habitat resources, but are not protected primarily as natural areas . He will have George Frantz put all these on the Zoning Map . Mr. Kennedy asked about the "moratorium"? Mr. Austic stated that the Attorney will provide something for the Board to review at the Regular Board Meeting on November 10th and from there they will set a date for the public hearing. Mr. Austic stated that there have been several conversations in reference to building and hooking up to Water District #3 so he has distributed the rules/guidelines/conditions on future service in the Agricultural District . This is for anyone in the NYS Agriculture and Markets District/Tompkins County; most of Ulysses is in this district . The Guidelines are as follows : Guideline - Conditions on Future Service 4 . The Project sponsor/permittee should impose the following conditions, as warranted or recommended on the management of water/sewer lines within agricultural districts : A. The only land and/or structures which will be allowed to connect to the proposed waterline or sewer within the agricultural district will be existing structures at the time of construction, future agricultural structures , and land and structures that have already been approved for development by the local governing body prior to the filing of the Final Notice of Intent by the municipality. Land and structures that have been approved for development refer to those properties/structures that have been brought before a local governing body where approval is needed to move forward with project plans and the governing body has approved the action. B . If a significant hardship can be shown by an existing resident, the lateral restriction to the resident's property may be removed by the municipality upon approval by the Department. It is the responsibility of the resident landowner to demonstrate that a hardship exists relative to his or her existing water supply or septic system and clearly demonstrate the need for public water or sewer service . The municipality shall develop a hardship application to be filed with the municipality, approved by the County Department of Health, and agreed to by the Department of Agriculture and Markets . C . If it can be determined to the Department's satisfaction that the landowner requested the county to remove his or her land from the agricultural district at the time of district review and the county legislative body refused to do so , lateral restrictions may be removed by the municipality if the Department determines that the removal of the restriction for the subject parcel(s) would not have an unreasonably adverse effect on the agricultural district. Special Town Board Meeting 11 /05/2003 What Mr. Austic is trying determine if in paragraph (a) if they are referring to zoning and by doing our new Zoning Ordinance it would allow people in the Water District #3 to hook up after the formation. Review of Draft Zoning Ordinance Review of the ordinance continued from where the Board left off on October 29th, 2003 with the Lot Area & Yard Requirements in Al . Mr. Austic has submitted his thoughts on Ag District (AI) zoning based on the purpose so stated; to protect the agricultural land resources of the Town and to promote, to the extent possible, the continued economic and operational viability of agricultural enterprises in the Town as follows : Residential lots 1 . No flag lots in Al without variance 2 . Minimum lot 3 acres 3 . Minimum frontage 500 feet 4 . Maximum frontage 700 feet 5 . Maximum lot depth 265 feet 6 . Side Yard Setback, maximum of 30 feet from one side lot line 7 . Minimum front yard set back 75 feet 8 . Minimum rear yard set back 75 feet Agricultural lots 1 . Minimum frontage 1000 feet 2 . Unlimited acreage 3 . Unlimited lot depth 4 . Upon subdivision purchaser must demonstrate intent to engage in an agricultural enterprise as herein defined or intent to allow the land to be farmed . Variance requirements 1 . Flag lot minimum frontage 50 feet 2 . Flag lots allowable only in inactive farmland areas as determined by a BZA site visit 3 . Area variances allowable only to a level of 20% of the requirement 4. Frontage variances allowable only in inactive farm land areas 5 . Depth variances allowable only in inactive farm land areas The Board, in attendance tonight, agreed that it is the purpose of this district as Mr. Austic stated . They felt that this is a compromise - agreed thai: it should not be two (2) acre lots with 200 ' frontage. They feel that is a fair compromise, even though it is against all planners . No one wants to see a house every two hundred feet down the road, so this proposal eliminates that and even lets you see between the houses to see open space. The Board felt that this would be more acceptable for the property owners of Ulysses that they have heard from - they will let it be known at a Public Hearing. Last meeting Mrs . Duddleston stated that she would look for a different definition of kennel, she found the following definition on the web from the American Kennel Association : Kennel — Any building or lot where four (4) or more dogs are raised and/or boarded for the purpose of sale, breeding, training or exhibition or are boarded for a fee or are sheltered for humanitarian reasons . • 7 Special Town Board Meeting 11 /05/2003 Article V — A2 — Special Agricultural District 5.3 Permitted Accessory Uses Add - Tempory Building or Structure Article VI — RI - Rural Residence District 6. 2 Permitted Uses Delete Not more than one doublewide 6.4 Uses Permitted by Site Plan Approval Take out Campground, group campground; Fire station etc . ; golf course; Public and private school ; Public and private community parks . These would be transferred to Special Permit by Town Board . Add Rehabilitation Facility to Residential Care/Assisted Living New Section 6.5 Uses Allowed by Special Permit by the Town Board Campground, group campground Fire station or other public building necessary for the protection or the servicing of a neighborhood . Golf course, except miniature golf course operated on a commercial basis . Public and private school , nursery school , institution of higher education, including dormitory. Public and private parks . It was discussed to make standards for golf course accessory buildings . 6.5 would become 6.6 Article VII — R2 — Moderate Density Residence District 7.2 Permitted Uses Delete - Not more than one doublewide 7.4 Uses Permitted by Site Plan Take out Fire station etc . ; golf course; Public and private school ; Public and private community parks . These would be transferred to Special Permit by Town Board . New Section 73 Uses Allowed by Special Permit by Town Board Fire station or other public building necessary for the protection or the servicing of a neighborhood. Golf course, except miniature golf course operated on a commercial basis . Public and private school , nursery school, institution of higher education, including dormitory. Public and private parks . z Special Town Board Meeting 11 /05/2003 7.5 would be 7. 6 No changes Article VIII — RM — Multiple Residence District 8.4 Permitted Accessory Uses Remove Automobile parking and - leave the rest put in alpha order under garages 8.5 (should read) Uses Permitted by Site Plan Approval Article IX — MHP — Manufactured Home Park District 9.3 Permitted Uses Delete last sentence - Two family residence etc . 9.4 Permitted Accessory Uses Remove Automobile parking — leave garage - put in order Add in — Family Adult care 9.5 (should read) Uses Permitted by Site Plan Approval (correct what follows) Article X — H1 — Hamlet District 10.2 Permitted Uses Delete - Not more than one doublewide etc . 10.3 Permitted Accessory Uses Delete - Outdoor dining facilities etc . 10. 6 Lot Area & Yard Requirements The fifth sentence — take out — doublewide manufactured homes — also there is an extra and in the last sentence. Article XI — B1 — Business Districts 11 .3 Permitted Accessory Uses Delete - Outdoor dining facilities etc . Article XIV — IL — Light Industry District 12.5 Buffer Areas Make sure it states subject to Article? Article XIII — CR — Conservation/Recreation District Left out under 2 . 9 and renamed to Park & Recreation Hearing no further discussion the Board adjourned at 9 : 10 p .m . and will set a meeting at the Regular Town Board Meeting for the next review.
