Georgia. Supervisor Austic called the meeting to order at 6 : 45 p . m . Mr. Austic has submitted his thoughts to the Board on updating the Town of Ulysses Land Subdivision Regulations and they are as follows : (these are entered into the minutes as Mr. Austic presented including font) . 1 . 112 . 1 Change to SIMPLE SUBDIVISION last sentence to read NO DISTINCTION IS MADE BETWEEN SUBDIVISION AND RE- SUBDIVISION. 2 . Change 202 . 1 to : ALL DIVISION OF A LOT INTO TWO OR MORE LOTS , WHETHER OR NOT NEW STREETS , PUBLIC FACILITIES OR UTILITY EXTENSIONS ARE INVOLVED OR NOT . 3 . 203 . 2 Add after approved by THE TOWN OF ULYSSES ZONING OFFICER OR before the Town of Ulysses Planning Board 4 . Change 203 .4 to read : RESULTING IN 3 OR MORE LOTS AND NO NEW PUBLIC FACILITIES 5 . Change 203 to read : RECOGNIZE FOUR TYPES OF SUBDIVISION, which are subject to FOUR DIFFERENT review 6 . Add new 203 .4 SIMPLE SUBDIVISION : RESTATE 112 . 1 7 . Change 210 . 1 after submit to - add THE ZONING OFFICER AT LEAST 10 DAYS PRIOR TO 8 . Add to 211 BASED ON AN ACCEPTABLE SKETCH PLAT, THE SUBDIVISION MAY BE CLASSIFIED AT THIS TIME BY THE ZONING OFFICER AS A SIMPLE SUBDIVISION, OR IF NOT A SIMPLE SUBDIVISION, THE REQUEST WILL BE FORWARDED TO THE PLANNING BOARD TO CLASSIFY THE SUBDIVISION PROPOSAL FOR REVIEW SUBJECT TO 9 . ADD 219 SIMPLE SUBDIVISION REVIEW PROCEDURES : UPON DETERMINATION BY THE ZONING OFFICER THAT THE SUBDIVISION IS A SIMPLE SUBDIVISION, THE ZONING OFFICER ACTS TO CONDITIONALLY APPROVE, CONDITIONALLY APPROVE WITH MODIFICATIONS , DISAPPROVE OR GRANT FINAL APPROVAL. IN ANY EVENT , FINAL APPROVAL CANNOT BE GRANTED UNTIL AN OFFICIAL SURVEY MAP PREPARED BY A SURVEYOR LICENSED BY NYS HAS BEEN PRESENTED TO THE ZONING OFFICER AND THAT SUCH MAP INDICATES THAT ALL OF THE REQUIREMENTS OF THE ZONING ORDINANCE HAVE BEEN SATISFIED . FINAL APPROVAL OF THE SUBDIVISION BY THE ZONING OFFICER SHALL BE INDICATED BY HIS SIGNATURE AND DATE ON THE FINAL SURVEY MAP . Mr. Austic suggested that the Board review and give him feedback on how they feel. The Board continued on with the review of the Draft Zoning Ordinance from page 1 . Page 1 . George Frantz had added a new paragraph under 2 . 1 that the Board feels is okay. Page 3 . 2 . 9 Establishment of Districts — Conservation District is not list — the Board feels that the name should be changed to Park & Recreation — be called PR and be the first on the list. Special Town Board Meeting October 29 , 2003 Page 4 — under 2 . 10 after 1st paragraph needs a space before number 1 2 . 14 Could add in Subdivision regulations 2 . 15 — remove or doublewide manufactured Page 5 — keep it to read as printed Page 6 — Airport — add as Regulated by FAA Airstrip Private — use the same definition as airport but not regulated by FAA and used by the owner of the property. (Doug will look into how FAA regulates — Call Steve Selover Page 7 — Bed and Breakfast — keep the original definition — this was from NYS Caterer — leave for hire in there Page 8 — Cottage industry — insert on site last sentence after persons Page 9 — Elder cottage-go back to the original definition - remove everything after marriage or adoption. Farm — go back to fifty because that is the NY State definition Page 10 — handicapped was changed to Persons w Disabilities leave this here as but have under the P — Persons w Disabilities Page 11 — hotel — go with the definition that George Frantz put in Page 12 — kennel — okay — But Carolyn will check to find a better definition Page 14 — motel — leave original Page 15 — Project site — add in — The project site is the entire parcel where something is being developed. Doug will check with George to see if he has anything better. Page 16 — residence, single family — add including doublewide manufactured homes Residential care facility — the title was changed to include Assisted Living/Rehabilitation Facility — also add in, after mental disability, addiction of Roadside Stand — tempory or permanent remove and erected or placed Page 17 — sign — take out visible Skirting — As defined by NYS Residential Building Code Section AE 503 Add in definition — Tempory Building or structure used for office, sales, storage or fabrication activities related to the development of a site for residential purposes, provided that such building or structure may not be continued for more than one ( 1 ) year except upon receipt of Special Permit. Page 18 — Zoning District — changed opens to open and the or to are Article IV - Al - Agricultural District 4. 1 Purpose - leave the definition as it originally stands 4.3 Permitted Uses Cemetery — at the end of definition put as Regulated by NYS Remove Flag lot Remove — Doublewide manufactured homes because they are single-family homes Add in Subdivisions, Rural, minor and major as regulated by Article number ? Subdivision 4.4 Permitted Accessory Uses Special Town Board Meeting October 29, 2003 Put Group adult care back to the way it is under definitions — Adult care group 4.5 Uses allowed by Site Plan Approval Add in Airstrips private Add in Kennel Mr. Austic stated that there is a difference between site plan approval and special permit — you cannot refuse a site plan, but you could refuse a special permit if the applicant did not do what was required . Mr. Austic asked if there were some uses that you might want to add more than site plan approval . Site plan approval does not address how a use could affect the area whereas a special permit could. Create a 4 . 6 and put some of these uses under that. They didn ' t feel that you would need both a special permit and site plan approval because there are standards , some may need both. It was discussed which board would do special permits and it was the consensus that the elected officers of the Town should be issuing these permits . The people elect the Town Board and any big project should be reviewed by the elected officials, but the Planning Board still can be used as advisors like in PDD ' s . Make a new section called : 4. 6 Uses Allowed by Special Permit by the Town Board Transfer the following from Site Plan Approval : Airports Campground, group campground Fire station or other public building necessary for the protection or the servicing of a neighborhood . Public and private school , nursery school, institution of higher education, including dormitory accommodations . Regional parks and preserves 4.6 would become 4. 7 - Lot Area & Yard Requirements At the previous joint meeting a show of hands was agreed to go with 700 ' frontage and 200 ' depth, but after that show of hands more Rl ' s were taken out. You have to go back to the purpose and the purpose is to preserve agricultural. No problem of a maximum non-agricultural lot being 3 acres . A long discussion took place and no determination was arrived. The Board will rethink this whole section and come up with something. 4.7 as in originally has been eliminated Hearing no further discussion the next meeting is scheduled for November 5th, 2003 after the scheduled Public Hearing on the Budget. •
