HomeMy WebLinkAbout2003-10-28 - TB TOWN OF ULYSSES SPECIAL TOWN BOARD MEETING OCTOBER 28TH, 2003 PRESENT : Supervisor Douglas Austic ; Councilpeople Robert Weatherby, Carolyn Duddleston Sue Poelvoorde and Lee Scott ; Marsha. L . Georgia, Ulysses Town Clerk and Bruce Wilson Attorney for the Town. Others Present : Richard Coogan and Lorren Hammond Supervisor Austic called the meeting to order at 6 : 10 p . m . and stated that there are a couple of things that need to be discussed prior to joining the Village of Trumansburg Board of Trustees to determine additional water hook-ups . ANNEXATION APPLICATION The Town is in receipt of a petition from William Auble to annex his property, two parcels, into the Village of Trumansburg. The Town received the petition on the 16th of October 2003 . Attorney Bruce Wilson reviewed the timetable of the process and the procedure . From the time of filing the two Boards have 20 days to set a joint public hearing, the expenses that occurs are shared by both boards . The public hearing needs to be not less than 20 days and no more than 40 days from the receipt of the petition. The Public Hearing is done jointly but the final decision is done separately. It would be predetermined who would chair the public hearing . Mr. Wilson also provided a checklist to be followed at the public hearing . A determination of findings has to be made by each Board within 90 days of the public hearing and this is not a joint finding, if no action is taken it is considered annexed. If either the Town Board or the Village turns it down and the other passes it the court can make a determination. Also you would have to have a written transcription by a stenographer of the hearing . A 2391/m has to be done by Tompkins County Planning and a short form EAF . Attorney Wilson stated that you have to have written exempt objections to a petition filed by the time of the hearing and he does have some concerns about the petition . It is notarized but the statue actually gives form that you are suppose to give the petition in and it does not say notarized but there are some case law that says notarization is okay. He also feels like you cannot do the petition without a survey map , a certification from Tompkins County Assessment, a statement of "why this is in the public interest" and he feels that it is not a proper acknowledgement on the petition. The simple thing to do about this is to advise the petitioner of the lacking items and they withdraw the petition. Mrs . Georgia advised the Board that Mr. Auble ' s attorney might be present at the joint Village /Town Board Meeting at 7 : 00p . m . to answer any questions or address any concerns . The Board felt they could further discuss this with the Village of Trumansburg Trustees. MORATORIUM Supervisor Austic stated that we would like to discuss the possibility of a moratorium . We are talking about the separating or dividing of a parcel of land until such time we can get the zoning finished, sub-division as we describe it may not be that. Mr. Tyler had given a sample of a moratorium he feels could be used, he used it in the Village of Trumansburg. Attorney Wilson had some problems with the clause that addressed "hardship". He is not sure how you would define an unnecessary hardship in relationship to this . The Town would have to file a 239 l/m with the County. Mr. Wilson Special Town Board Meeting 10/28/2003 will draft the moratorium on dividing any lot in the Town and have it available for the Town Board Regular Meeting scheduled for Monday, November 10th, 2003 . WATER DISTRICT #5 The Town Board is scheduled to meet jointly with the Village of Trumansburg Trustees following this meeting to discuss the possibility of allowing residents in the Town of Ulysses to hook up to their water line that is in the Town' s proposed Water District #5 before the District is formally formed. The request of the establishment of Water District #5 came about from a petition filed by the residents in the Town on the Village ' s waterline to requesting the Town to look into forming the district. Also, Ms . Poelvoorde stated, that this whole thing started by the Village stating they would not do any more connections to residents outside the Village until the Town established a water district. The Town than had Barton & Loguidice do a Map , Plan and Report that the Town has filed with the Village and have heard no response to . Than with the construction of a home on South Street Ext. , that has the water line directly in front of their new home, Mr. Austic informed the new property owners that the Town Board would approach the Village of Trumansburg and ask them to allow hook-up to the municipal water line . Mr. Austic and the Board members feel that in the light of forming District #5 it only makes sense to negotiate with the Village to allow hook-ups to the water line well working on the formation of the District. The Village has had the Town' s Map , Plan and Report for Water District # 5 for several weeks . FLO-TECH APPLICATION FOR PDD Supervisor Austic and the Town Board has discussed Mr. Robert Brown' s application for the construction and renovation of a old barn on his property on Halseyville Road. He would like to move his business from Route 96 (on Maguire ' s property) to his property on Halseyville Road, building a new building and renovating the existing barn on the property. The Board has previously discussed this and feels that it would fit into the description in the current zoning ordinance to allow him to apply for a PDD and that it would fit into the guidelines of the Town' s Comprehensive Plan. The Town Board is directing the Planning Board to review the application of Mr. Robert Brown for a PDD for his Flo-Tech business . Hearing no further business the meeting was adjourned.
