HomeMy WebLinkAboutZBA Minutes 1965-10-27 41 TOWN OF ITHACA ZONING BOARD OF APPEALS OCTOBER 27 , 1965 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Town Offices , 108 E . Green St . , City of Ithaca , at 8 : 00 P . M . on Wednesday , October 27 , 1965 . Members of the Board present were : Acting Chairman Robert Powers , Roger Sovocool , William S . Scott , Jr . , Zoning Officer Robert J . • Wells , and Secretary Cheri Beninati . There were no other persons present . NANCY SLOUGHTER CASE - 132 KENDALL AVENUE Appeal of Nancy Sloughter for converting the use of a building at 132 Kendall Avenue , Ithaca , New York , from an existing legal non- conforming use to a non- conforming use of a greater nature , i . e . retail pet Shop . The building at 132 Kendall Avenue is owned by Lyle Hall and has in the past been used for a variety of commercial uses , the most recent of which have been furniture storage , taxi office and repair garage , and boat storage . Proof of publication is attached to the application and the appeal , and , as of 6 : 30 P . M . , October 27 , 1965 , on which date thekearing had been previously set for ( 7 : 30 P . M . ) , the application and appeal by Nancy Sloughter was withdrawn by. telephone to the Zoning Officer . The Zoning Officer has on file in connection with this matter a petition opposing the requested operation of a retail shop in this area signed by 38 residents of the area . RONALD HASKINS - 294 HAYTS ROAD Acting Chairman Robert Powers called this Public Hearing to order at 8 : 00 P . M . Ronald Haskins has made application for permission to locate a trailer to the rear of 294 Hayts Road on a temporary basis until the owner of the land ( Mr . John MacLean , building contractor ) can complete the house which he is to build for Mr . Haskins , within the City of Ithaca . The Zoning Officer denied the application on the basis of Article 13 Section 59 of the Zoning Ordinance , and the appeal therefrom states in part that the owner of the land ( Mr . John MacLean ) is agreeable to the placing of the trailer temporarily on his land and that no objection has been voiced on all adjacent neighbors who have been contacted . The Zoning Officer supplied the proof of publication . No 42 persons appeared to be heard either in favor of or in opposition to the application . Mr . William S . Scott , Jr . moved that the variance be denied due to the fact that the legal requirements for a varaince had not been met . Mr . Robert Powers seconded this motion , all in favor , carried . WILPRED E . GELDER - 1120 EAST SHORE DRIVE Acting Chairman Robert Powers called this Public Hearing to order at 8 : 30 P . M . Application has been made by Wilfred E . Gelder , to erect a residence at 1120 East Shore Drive on a lot measuring 101 feet frontage by 165 feet depth with the garage to be attached to the dwelling , but with the front line of the garage located five tet from the edge of the road -= fright - of -way . The application was denied by the- Zoning Officer on the basis of Article 4 - Section 13 which would allow a garage to be located five feet from the road right - of -way provided the grade of the terrain exceeds 8% with special approval of the Board of Appeals . The house will be in a $ 25 , 000 - $ 30 , 000 bracket designed by Architect Jon Metzger and built by Carr Construction Company . The Zoning Officer presented proof of publication of the legal ad and also a letter from Mr . P . C . Gallivan , the immediate neighbor to the north . The plot plan detailed on the application indicates a grade in excess of 8 % from the edge of the road right - of -way to the front line of the house: No persons appeared to be heard for or against said application . The lot immediately adjacent to the north owned by Mr . Gallivan has a garage located within- 5 feet of the road right - of -way . Also , the lot immediately adjacent to the south of the subject property owned by Casterline has located on it a garage with- in 5 feet of the road right - of -way . Mr . William S . Scott , Jr . moved that the Board grant approval for a private garage not over one story in height and house not more than 2 cars to be located in the front yard , not less than 5 feet from the street line as permitted by Section 13 of Article IV since it has been shown that the natural slope of the lot exceeds 8 / fall directly from the street line . This motion was seconded by Mr . Roger Sovocool and carried . The meeting was adjourned at 9 : 00 P . M . Respectfully submitted , Cheri Beninati Secretary
