HomeMy WebLinkAboutZBA Minutes 1965-08-18 39 TOWN OF ITHACA ZONING BOARD OF APPEALS AUGUST 189 1965 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Town Offices , 108 E . , Green Street , City of Ithaca at 7 : 30 P . M . on Wednesday , August 18 , 1965 . Members of the Board present were : Chairman David F . Powers , Robert Powers , C . A . Tilton , William S . Scott , Jr . , Zoning Officer Robert J . Wells , and Secretary Cheri S . Beninati . Also present were : Mr . M . R . , Classen , Harry Gordon , Mrs . Beald , Miss Edla Beald , Miss Doris Wood , and Miss Markel , BUILDING PERMIT -BEALD PREMISES A Public Hearing was called to order at 7 : 50 P . M . Chairman Powers stated purpose of meeting : To hear and receive information regarding the application of a variance to build a carport on the Beald premises at 15 Hillcrest Drive : Zoning Officer read the application , appeal and proof of publication as published in the Ithaca Journal August 11 , 1965 . The Zoning Officer read the following from Section 280 A of the Town Law , in part : " No permit for the erection of any building shall be issued unless a street or highway giving access to such proposed structure has been duly placed on the official map or plan or , if there be no official map or plan , unless such street or highway is an existing street , county or town highway . ,", The Zoning Officer pointed out the location of the property on the Zoning Map . There are five houses located on the turn-around , adjacent to the six -acre plot on which this Board now has an application for a 20 - story apartment build - ing . Mr . Harry Gordon brought out the fact that the Beald ' s own lots 2 and 3 as shown on the map submitted by Mr . Classen . The existing house is 75 feet from the road . Chairman Powers asked for any questions from the Board . There were none . He then stated that the main problem was the street 40 law . . Zoning officer Wells brought out the point that the Zoning Board had acted in several cases similar to the Beald case . After hearing no opposition from the Board , Mr . Wells , brought out the following facts : Miss Beald has been in the house for two years . There are lots available for sale in the area . It is not possible to build on the lots without a variance . The right - of -way is located directly across from the Beald house . Mrs . Marinas , who owns land in the area , anticipates development of the 40 acres across from the right - of -way . As to the matter of the street law , the road was - not property located in the right - of -way when it was constructed . There - fore , it is not a Town road . The road must be re -worked as it is in very poor shape gravel=wise . Chairman Powers inquired if the residents of the area present had any objections to the construction of this carport , five feet from the lot line . There were no objections from the residents and ^ also none from the Board members . Mr . C . A . Tilton made a motion that Miss Beald be granted a variance for this carport . The motion was seconded by Mr . Robert Powers and carried . The resolution is as follows : That this Board grant the requested variance in that practical difficulty tas been found , and the health , safety , morals and general welfare of the area will not be adversely affected , and that the premises are adapted to the proposed use . Upon motion by Mr . Tilton , seconded by Mr . R . Powers and carried , this Public Hearing was adjourned at 8 : 15 P . M . Respectfully submitted , Cheri S . Beninati Secretary
