Georgia; Sharon Anderson Mediator. Lorren Hammond Planning Board Member arrived late . Finger Lakes Region Water Protection Plan George Kennedy invited Jason Haremza from the Genesee/Finger Lakes Regional Council to address the Board. Jason was late George Kennedy read the following into record. Watershed protection plans identify priority actions needed to protect and improve water quality including Capital projects and local development controls building on this water. • The Genesee Finger Lakes Region planning council will development specific water quality control laws and/or ordinances for local governments within the Cayuga, Canadaigua Lake watersheds, • 53 Towns • 12 villages • 2 cities located in parts of ten counties in these three watersheds . Key communities within each water shed will be identified. Council will prepare a manual of bottled local laws and case studies to reduce water pollution from non-point sources as a resource for local government. Council will do a series of workshops throughout the states great lakes watersheds to stress the importance of local development controls as a means for addressing non-point sources of pollution as well as to provide examples of local laws and controls appropriate to a variety of local circumstances . Completion of project is anticipated by June 2004 . Jason Haremza arrived and handed out information on the project description. Mr. Haremza stated that the Council is going to focus on Ulysses first because of the revision of the ordinance, which he has a copy of. He wanted to stress that the Council does not want to force any regulations on any town or village that does not want them, so we are looking for active participants and partners in this project that want to improve their local codes to ultimately improve the water quality. He reported that time and budget is limited to approximately 12 on the low end and as high as 14 out of the 52 municipalities watersheds . Reviewing the codes for all municipalities for types of ordinances . Will look at zoning regulations such as where areas zoned for higher intensive developments are, where proposing industrial and commercial zones , higher density residential zones, 2 families, are those areas more susceptible to erosion. Will not only look at the zoning regulations but how those regulations actually are arranged on the map . Mr. Austic suggested that Mr. Haremza read the zoning ordinance that the Town is proposing, see what is proposed and make suggestions at this point. There are some provisions in place for set backs from steams, buffer areas and those kind of things . If after reviewing you don ' t think these are large enough we would like to know that. He does not think that the commercial zones are in places that are going to be a problem or the higher density. The major area that is zoned for rural residential, which is the larger lots, is nearer to the lake so the idea was to keep density down in that area. A lot of the things you have discussed hear are better served by, like the water craft and the timbering and that kind of thing, a local law. A local law would be a broader thing than a zoning ordinance . Mr. Austic thanked him and would appreciate any comments . Chairman Coogan made a statement that the Planning Board met back on Saturday March 22nd and at that time the Planning Board and the Town Board thought there was a draft of the ordinance that the Planning Board could review independently figure out, content wise, were okay and something that they could live with and the Planning Board agreed at this time that once we said a section was okay they would stand by that unless Joint Town Board/Planning Board 08/05/2003 the Town Board made substantial changes to the section. 6 members were present and agreed to proceed and get things done. Ms . Anderson suggested reviewing the sections that had been changed. Article I — okay Article II 2 . 10 subparagraph 4 . Planning board felt the correct legal term was "thread not center line of stream". Supervisor stated that if someone were measuring it would be easier. Left as centerline . No change . 2 . 15 . Discussion concluded to note that it would say "any lot of 2 acres or more" for minimum zoning from health department rules. Article III — Definitions Mr. Austic suggested that if any member has a better definition that they could submit it in writing to be reviewed and considered. Adult Care Group - Wording changed to read "The care, protection and supervision at least twice a week, not more than six (6) but not more than twelve ( 12) adults at any time by a resident of the dwelling, for a fee . " Adult Care Center - Discussion of Adult and Child Care Centers will be written up by? and circulate for all to see if acceptable of all the groupings of the same nature. Occupation - Dick to come up with a suggestion for a better definition. There are questions on this but will wait till Dick works something up and gets it to everyone. Airstrips - Definition needed for Airstrips . In what section would an airstrip be appropriate? Agricultural Commerce - Add in princely after or products . Caterer Move for hire to be placed after or enterprise. Farm Discussed the definition — it was decided that the gross sales value would be set at ten thousand and remove fifty. Handicapped Was previously changed to Physically challenged — it was decided to be changed to Persons with Disabilities Joint Town Board/Planning Board 08/05/2003 Discussion went on about the difference of Motel and Lodging house. A lodging house would be 15 or less with no outside exits . According to George they cannot find where a lodging house would be allowed in their district. It is not listed as an allowable use . There is a gap between a B &B , Hotel and Motel . B&B You have to live there and its 10 or fewer people. Lodging House — 10 — 14 people whether you live there or not . They will not address whether they live there or not. This bridges the gap between B &B and Motel and Hotel . Need to change definition from " 15 or less" to " 15 or fewer" . Mobile Homes - Keep definition as is . Put back definition that was taken out . Lot Coverage - Need to include "impervious" between similar and surfaces . Deal with lot percentages in the districts . Project Site - Add a definition for this . Question on acreage that a project is being developed on . Residential Care Assisted Living Facilities - Change title to read " Residential Care/Assisted Living/Rehabilitation Facilities" . Research and Development Enterprise— Definition is OK as is . Question is where is that allowed . Town Board was to check to see what zone this is in. George suggests that what would be allowed is light industry. Roadside Stands Are there any permanent accessory structures and setbacks related to roadside stands? Discussion suggested that if it is a permanent structure than it needs to conform to the normal setback requirements . If it is a temporary structure than it needs to come down when that activity ends . Remove "erected or placed" after feet in size. Sawmill Delete the word planning and replace with planing . Setback — • Take out the word "or" . Made two sentences . Put a period after "properly line" . Add new sentence is "The highway right of way shall be deemed the property line for purposes of setback". Joint Town Board/Planning Board 08/05/2003 Sign - Remove the word visible in the last sentence Skirting - Change as required to "As defined by NYS code . . . " Zoning District Correct typo in zoning district on 3" 1 line after the word "spaces" there is an "or" and it needs to be "are" . And "opens" should be "open". Article V - Special Agricultural District Under 5 . 3 Permitted Accessory Uses — Tempory building or structure was added previously — within that remove residential purposes — if this is in any other section remove there also . It was decided that this should go in the definitions under "tempory building or structure" (George Frantz will do a better definition than what is here) than only tempory building or structure would be under article 5 . 3 Article VII - Rural Residential District - 7 . 3 family adult care should be added . 7 . 5 First sentence — change one principal building to (2) two principal buildings Mr. Austic stated that it would be spelled out with similar wording like the following where it is needed "if side by side buildings, the distance between the buildings have to be twice the required side yard" . If the buildings are front to back the setback has to be the front yard and back yard combination. Professional Office - All in agreement to leave the concept as is . A discussion went on about the difference between and home occupation and what would be allowed : Special Permit — It happens possibly with some restrictions . Special Exception — The person comes in and makes the case for it. It is concussing home occupation, professional office, and cottage industry. Mr. Coogan is going to do some work on these definitions and come back with it . Ms . Poelvoorde stated than professional offices would be moved to whether it is special exception or site plan review. She stated that professional office defiantly is bigger and should be site plan review . It still would make a difference as to how many employs — a professional office of one professional could be a home occupation. Wait until Dick redoes the definitions . Article VIII — Multiple Residence District Previously removed will be put back in. Article IX - Manufacturer Home Park District Discussion went on if they should take the existing areas and give them reasonable room to gro w or should they e take the dis tricts and give them room for expansion. Joint Town Board/Planning Board 08/05/2003 Suggestion was to make existing parks the district and leave 9 . 2 . Further discussion needed on this at next meeting, which was scheduled for August 13 at 6 : 30 PM . Meeting adjourned at 9 : 45 PM .
