HomeMy WebLinkAboutZBA Minutes 1964-04-06 r L 23 : : TOWN OF T.THACA ZONING BOARD OF APPEALS APRI-L 6 , 1964 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Highway Building on Monday April 6 , 1964 at 7 : 40 P . M . Members of the Board present were : Chairman David F . Powers , Robert Powers , CA , Tilton , William S . Scott , and Robert J . Wells , Zoning Officer . Also present were : Truman K . Powers - Savings Bank Building Forrest E . Votaw - 1223 Trumansburg Road Mrs . Leo F . Davis - 1221 Trumansburg Road Mr . Leo F . Davis - 1221 Trumansburg Road John Vasse - 618 Elm Street Ext , Florence W . Goldsmith — P . O . Box 91 , Jacksonville , New York V . C . Warren - 301 Wyckoff Avenue G . H . Ford - 1224 Trumansburg Road FIRST CASE : Chairman Powers called the public hearing to order a : 40 P . M . and instructed the Zoning Officer to proceed to read the subject application , appeal and present proof of publication . So done , setting forth the following : Application has been made to build a 60 bed Nursing Home on the Hunna Johns ' property located on the east side of the Trumansburg , Road , approximately 200 feet south of the south Odd Fellows property line . Location is zoned partially R - 30 in the northern portion and R - 15 in the southern part of the southern lot . Proposed construction to be in the 400 to 500 thousand dollar range , one story masonry construction , built to comply , with all applicable standards of the State of New York , - the Social Welfare Department and the Town Zoning Regulations . It was noted that the proposed construction would fulfill a community need , promote the general welfare in harmony with the intent of the Ordinance , would be safely designed , and not detrimental in anyway to the area and would have con siderable impact on the Towns tax base . The lot is 385 feet wide by 325 feet deep and public water and sewer facility connections - exist on the property . Chairman Powers called ' u.pon Mr . Vasse , as agent for Mrs . Florence Goldsmith , developer , for any additional comments or facts relative to the application . Mr . Vasse informed the Board that the architects responsible for the detail plans etc . have not completed said project as yet , so he was unable to provide same for this meeting . He also pointed out that Mr . Johns has owned this land for about 14 years and it was originally purchased for future development , but has since come under the restrictions of - subsequently adopted zoning regulations . Mr . Truman Powers , Attorney , representing Mr . . and Mrs . F . E . Votaw , o`iners of the property adjacent to the .subject property on the south spoke in opposition to the granting of special approval and made the following three points : 10 ., He questioned the exact location of the zone boundry between the R - 15 and the R- 30 zones . 2 . He held that the applicant in the appeal should be the principal party concerned with the devel - opment and not an agent . 3 . He contended that the supporting documents to the appeal were insufficent to provide the information necessary for this Board to render • a decision , that is �e detailed plot and building plans , elevations , ,, area .cover - age , etc . Dr . Charles deProsse questioned the Zoning Officer on different sections of the Zoning Ordinance , paying particular- attention to the differences in require ment and proceedure for this Board to act on a variance as would be required were the property R-15 , as against a special approval as required where zoning is R- 30 resid - ential . The prineip ?.11difference being that hardship must be shown for the granting of a variance in areas of the R-15 classification . The Zoning Officer suggested that in as much as the detail of the proposal was not available for this meeting , that it would be in order to entertain an adjourn- ment uxztil such time as complete information could be furnished . A11 principals were in agreement on this point , and no further persons desiring to be heard on the subject at this meeting , and upon I''1rs . Goldsmiths assurance that she - would do all possible to provide the necessary information as soon as possible , Mr . Robert Powers moved to adjourn the meeting and stipulated that the Zoning Officer should set the date , time and place of the adjourned meeting after receipt of the required information and should also notify all area resid - ents in attendance at this meeting of the new meeting at least one . week in advance of the meeting . 225 Zoning Board of Appeals I`'iinutes - April 6 , 1964 Page 2 The hearing was adjourned at 8 : 10 P . M . In further business : Mr . Victor Bagnardi , Architect , and Mr . Harry Wear t , representing the Trinity Lutheran Church appeared before the Board and presented site plans for the proposed . new Lutheran Church to be located on the south side of Honness Lane . The problem of parking on the site is in question , so a hearing of this Board was - set for April 14 th , next , at 7 : 30 � P . M . at this place , to hear and decide the matter . There being northing further to come before the. Board at this time , the meeting was adjourned at 8 : 45 P . M . Respectfully submitted , Robert J . Wells Zoning Officer
