HomeMy WebLinkAbout2003-05-06 - TB TOWN OF ULYSSES SPECIAL TOWN BOARD MEETING Draft Zoning Ordinance May 6, 2003 PRESENT : Supervisor Douglas Austic ; Councilpeople Carolyn Duddleston, Sue Poelvoorde, Lee Scott and Robert Weatherby. Town Clerk Marsha L. Georgia. Code Enforcement Officer Alex Rachun absent . Supervisor Austic called the meeting to order to continue with the review of the Draft Zoning Ordinance at 5 : 30 PM . Supervisor Austic stated he has received a call from Eric Pond, Engineer for Barton & Loguidice and everything is ready for the Town to advertise for bids for Water District # 3 . Mr. Austic read a proposed resolution, Mr. Scott moved, seconded by Mrs . Duddleston the following : WHEREAS , Barton & Loguidice, P . C . has completed the engineering plans for the construction of Ulysses Water District # 3 , and WHEREAS , Barton & Loguidice, P . C . has received responses from every agency wishing to make comments on the proposed plan and incorporated any relevant comments into the plan, and WHEREAS , spring is finally here and construction season is upon us, BE IT THEREFORE RESOLVED that the Ulysses Town Board duly advertises for construction bids for the Ulysses Water District # 3 project. The Town will place the suggested advertisement in the official newspaper and Barton & Loguidice will advertise in the Syracuse/Binghamton newspapers, Dodge/Construction Data/Builder' s Exchange and by direct contractor notification where possible . Mr. Austic aye Ms . Poelvoorde aye Mrs . Duddleston aye Mr. Scott aye Mr. Weatherby aye Adopted. The Board resumed the review of the Draft Zoning Ordinance . Article VIII - RM - Multiple Residence District Mr. Austic stated WHY a district — Maybe what should be said is that multiple residences be allowed in R1 and Hamlet District and than go from there. Leave the purpose but take out the District. Ms . Poelvoorde said than would this need to be a separate Article or would you just go back into the districts and say multiple residences can be allowed . Mr. Austic said or just say it is allowable in those things and this is the standard for them . You would not need to put family childcare or adult care into R1 or Hamlet because they are all ready allowed . Ms . Poelvoorde stated that all of it is there except for the accessory uses rental office, storage sheds, coin -operated laundry facilities and refuse dumpsters, also automobile parking and garages . This certainly is up for discussion; it just does not make any sense because we have standards . This could be interpreted as Spot Zoning. Mr. Austic said you could leave 17 . 3 in the zoning, because that is how you would do it, if you did it, but it would be any district . Ms . Poelvoorde stated that if you look at the map they are just little tiny dots because they are RM Districts, does not make any sense because they are an apartment building. On the map they are only pointing out what is there not any new areas , so what good is it. Ms . Poelvoorde stated that Page 66 , Section 17 . 3 could be just generic to establish a new zoning district. Mr. Austic asked if there is Special Town Board Zoning Ordinance Review 5/6/03 a design standard for. Yes there is Section 18 . 5 on page 76 . Ms . Poelvoorde stated that you would just have to make sure that covers . Change the title to read Standards for Land Development for — Multiple Residences . You may want to do more standards . The general consensus of the Board was to take out Article VIII and than just say multiple residences are allowable in R1 and Hamlet and go back to R1 and Hamlet and say they are a permitted use with Site Plan Review and put section 8 . 6 back into the standards . Article IX - MHP - Manufactured Home Park District Take this out also for the same reasons and put it in R1 because you have the standards . Put the lot area and yard requirements into the standards . We should talk to George about this and the attorney. Article X - RH - Hamlet Residence District The Board talked about combining the two Hamlet Districts into one Article. The Planning Board also suggested this . 10 . 1 Purpose - no changes 10 . 2 Permitted Uses Two-family residence — delete every thing after in that paragraph 10. 3 Permitted Accessory Uses * * (note 10 . 2 used twice in the Draft Copy) Delete Dish antennae. Delete Office of a resident accountant, doctor, dentist, musician, engineer, teacher, lawyer, architect, landscape architect, artist, real estate broker or person engaged in similar occupation and replace with Professional Office . In 1 ) delete building and replace with property. Add : Elder Cottage 10 . 4 Uses Permitted by Special Permit — Change to Uses Permitted by approval of the Planning Board. Change Section from 17 . 1 to 17 . 2 Move Bed and breakfast to Permitted Accessory Uses 10 . 3 Move Business directional signs to Permitted Accessory Uses 10 . 3 Adult group care Add : Adult group care Residential Care/Assisted Living Facility Multiple Residences The Planning Board had suggested that hospital be removed from permitted uses . They will have to talk about that. A clinic would make more sense than a hospital . 10. 5 Lot Area & Yard Requirements ' Ms . Poelvoorde stated that the lot requirements would have to have two categories one for residential and one for the business . Article XI - B1 - Business District 11 . 1 Purpose - no changes 11 .2 Permitted Uses - no changes Special Town Board Zoning Ordinance Review 5/6/03 11 . 3 Permitted Uses Add : Motel after Hotel Agriculture — excluding feed lots *Note : You may want to exclude feedlots in the other districts except for agriculture district . Take out Sit-Down in front of restaurant and delete except fast food restaurants . 11 . 3 Permitted Accessory Uses Delete Dish antennae 11 . 4 Uses Permitted by Special Permit * * All of these should be under 11 . 2 because they all have to have Site Plan Review fewer than 11 . 2 . 11 . 5 Lot Area & Yard Requirements - no changes 11 . 6 Buffer Areas — no changes 11 . 7 Building Permits — no changes Article XII - BH - Hamlet Business District Combine with other Hamlet District. 12 . 1 Purpose — no changes 12 . 2 Permitted Uses Remove Sit-down in front of restaurant and delete except fast food restaurants . Places of amusement should be discussed because if the Hamlet Residence District and the Hamlet Business are combined some of these things may not fit. 12 . 3 Permitted Accessory Uses Delete Dish antennae 12 . 2 Uses Permitted by Special Permit * * All of these should be under 12 . 2 because they all have to have Site Plan Review under 12 . 2 Delete Flag lot 12 . 5 Lot Area & Yard Requirements Seventh one down under building height remove non - agricultural . Article XIV - IL - Light Industry District 14 . 1 Purpose — no changes 14 . 2 Permitted Uses Add : Adult Care center and Adult care group z Special Town Board Zoning Ordinance Review 5/6/03 14. 3 Permitted Accessory Uses Delete dish antennae 14 .4 Uses Permitted by Special Permit * *All of these should be under 12 .2 because they all have to have Site Plan Review under 12 . 2 . Change definition of Extractive industry to remove petroleum and natural gas . 14 . 5 Lot Area & Yard Requirements — no changes 14 . 6 Buffer Areas — no changes 14. 7 Building Permit — no changes Article XV — CR — Conservation/Recreation District Mr. Austic stated that what we have now does not make any sense . Ms . Poelvoorde said that if we are going to have this it should be out farther. The wording of the purpose is good. Ms . Poelvoorde said that things would be allowed in it and it would be further out so you are not doing intensive development in that particular area because it surrounds Taughannock or Smith Woods or what ever area. You would want to have an area around the park or Cayuga Nature Center and within that you cannot do Industrial, business, may be a single-family residence. Ms . Poelvoorde said you would not allow large-scale subdivisions and things like that. Things that would encourage open space around that area. This zone should be the least intensely developed area. Mr. Austic said that may be you should make that area no more intensive than rural residential but not even allowing everything that would be allowed in the rural residential . We need to get an idea of how much larger we would want to make this district . Article XVI — Communication Transmission Towers and Telecommunications Facilities Needs further discussion — our current ordinance needs to be reviewed because there are new regulations out . Article XVII - Administration 17 . 1 Board of Zoning Appeals 17 . 1 . 1 Establishment — no changes 17 . 1 . 2 Area Variances 17 . 1 . 3 Use Variances Mrs . Georgia said that in the new Municipal formbook that she got from Attorney Wilson. has this type of thing spelled out. The Board may want to look at that book for area and use variance. 17 . 1 .4 Special Permits - no changes 17 . 2 Site Plan Review Mr. Austic said that we have to think about what standards you want to have to protect the community from whatever we are going to allow by the Site Plan Review. Probably in the Site Plan Review there should be some kind of time line. We need to look at different Site Plans and review procedures . We have the Town of Ithaca' s to review and there are some examples in the Municipal Formbook. Mr. Austic stated that if you look through the whole document it states what you can do but it does not tell you what you cannot do . It does not say you can ' t have cars in your .1 1 -, i B�� Special Town Board Zoning Ordinance Review 5/6/03 front lawn or you cannot have garbage in your front lawn . Does anyone see that anywhere? Ms . Poelvoorde stated that we could certainly put a section in. We could say the Town will enforce the NYS Property Maintenance Law . Ms . Poelvoorde stated that we are suppose to anyway. We could do a section 20 . 13 Yard care and reference the Property Maintenance Law, although it is really outrageous . Hearing no further discussion the meeting was closed .
