HomeMy WebLinkAbout2003-04-21 - TB TOWN OF ULYSSES SPECIAL TOWN BOARD MEETING Draft Zoning Ordinance April 21 , 2003 PRESENT : Supervisor Austic ; Councilpeople Sue Poelvoorde, Lee Scott, Carolyn Duddleston, Robert Weatherby; Code Enforcement Officer Alex Rachun and Town Clerk Marsha L . Georgia. The meeting was called to order to review the Draft Zoning Ordinance . For simplicity of minute taking the Board reviewed the draft page-by-page, article-by- article . The following notes are the changes and/or corrections after much discussion. (Tapes on file for review of discussions) Article I — Purpose No changes Article II — Application 2. 1 Conformance Remove the underscore between manner_ which 2.2 Space and Construction No changes 2 .3 Enforcement, Violations and Penalties delete paragraph two (2) 2 .4 Building Permits Second Paragraph — add in under exceptions — any residential accessory building 144 square feet or less and not to exceed 15 ' height . Make this a stand-alone paragraph — second . Third paragraph — remove and — after scale (second sentence) 2.5 Fees for Permits First paragraph — third sentence — remove as (after shall be) . Second paragraph — Local Law — no law — check to see if a law is needed -- now a resolution is in place to allow the Boards to request to hire . Maybe reword — this will have to be LOOKED AT . Has to be clear that the Town Board hires . 2 . 6 Building Code Conformance remove Fire Prevention and Building Construction Code title - use New York State Uniform Code (Alex will check for the correct title) . 2 . 7 Approval of County Health Department insert a comma (second sentence) after requirements and (third sentence) after disposal . 2. 8 Certificate of Compliance no changes 2.9 Establishment of Districts the order needs to be changed and Conservation/Recreation District added . The order should be by the level of development, start out with the least to the most . The whole document will get re- ordered. 2 . 10 District Boundaries No changes . 2 . 11 Amendments No changes . 2. 12 Validity No changes . 2. 13 When Effective No changes . 2 . 14 Local Laws Superseded insert the date of the Tower Ordinance - March 17 , 1997 2 . 15 Number of Dwellings on a Lot No changes . Special Town Board Meeting 4/21 /03 ARTICLE HI - DEFINITIONS 3 . 1 General 4 . Capitalize first word (The) 5 . Change font on this number 3 .2 Glossary Agricultural commerce - Remove last sentence. Bed and breakfast - Use NYS Code Definition (Alex Provided) Owner-occupied residence resulting from a conversion of a one family dwelling, used for providing overnight accommodations and a morning meal to not more than 10 transient lodgers, and containing at least three but not more than five bedrooms for such lodgers. Add caterer —(after campground) (definition from the Town of Ithaca) a person or enterprise that prepares food for hire for consumption predominately off premises. Conference center remove dining and replace with restaurant Dwelling - no changes but add dwelling unit from the NYS Code definitions and add the minimum cannot be less than 750 square feet, excluding elder cottage Dwelling unit. A single unit providing complete, independent living facilities for one or more persons, including permanent provisions for living, sleeping, eating, cooking and sanitation. Minimum dwelling unit not to be less than 7,50 square feet (excluding elder cottage). Elder cottage insert adult dependent after grandparents in the last sentence. Farm use the NY State Agricultural and Markets Law definition (Look Up) Handicapped change to read physically challenged. Handicraft - Capitalize first word Home occupation - remove dwelling replace with — residentiail property. Hotel/motel/inn/townhouse - Alex will look up definitions from NYS Code Kennel - look to see where this is mentioned in the ordinance — may not be needed. Revisit definition Lodge - may want to include lodging definition Mobile home - re-visit — this may not be necessary to have — this is a pre- 1974 definition Motel - see better definition of hotel to be provided by Alex Multiple residence - remove Nursing home - remove space between chronic illness Principal building - remove of after owner replace with or Research and development enterprise - check zone C Rehabilitation Center - definition needs to be added (Alex will provide) Self-service storage facility - take out or after building Setback - add - or highway right-of-way (at the end) Sign - last sentence after visible remove form replace with from Special Town Board Meeting 4/21 /03 Single-family residence - remove Townhouse- use definition out of NYS code (Alex will provide) Two-family residence - remove The board discussed the Conversation Zone — some thought it would be simple, others thought it needed to be much broader .
