HomeMy WebLinkAboutZBA Minutes 1963-09-09 209 TOWN OF ITHACA ZONING BOARD OF APPEALS SEPTEMBER 9 , 1963 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Highway Building on Monday September 9 , 1963 at 8 : 00 P . M . Members of the Board present were : Chairman David F Powers , William B . Norton , William S . Scott and Robert N . ' Powers . Also present were : Zoning Officer Robert J . Wells , Mr . L . M . Grey , Mr . and Mrs . Charles Ayers , Mr . Rober J . Bruce , Mrs . Anna Costello , Mr . and Mrs . John Mazza , and Mr . Homer DeGraff . The minutes of the previous meeting were approved as written . FIRST CASE : Mr . and Mrs . Charles Ayers and Mr . L . M . Grey were present in regard to the adjourned hearing last month for the denial of permission of 'Ir . Ayers use of a boat house constructed and located at 879 Taughannock Blvd . Mr . Grey reported that he had a phone call from his lawyer earlier in the day and he asked Mr . Grey to request a postponement of the hearing as he was ill . Mr . Ayers stated that there was nothing new to report on the case . Upon motion by William B . Norton , seconded by Robert N . Powers and unanimous vote , this appeal was adjourned until the next scheduled meeting October 149 1963 at 7 : 30 . SECOND CASE : This is an appeal signed by Robert J . Bruce for a variance in regard to the decision of the Zoning Officer denying permission to build a carport on the side of existing house at 123 West Haven Road under Article 4 , Section 14 of the Town of Ithaca Zoning Ordinance . Proof of publication was presented . The proposed construction would come within 4 ' of his lot line instead of the required 10 ' . . Mr . Donald Burnett owns the adjourning property and has given 100 ' permanent right of way to the Gas and Electric Corporation for Bower line use . . The 100 ' right of way is located between the ruce and Costello properties . There would be no construction allowed under high tension lines . This construction is in an R 15 Residence Zone and the carport is strictly_ for residential use only . The carport would extend about 2 ' ahead of the existing house line , which is set back 50 ' from the highway. Mr . Bruce now parks his car where he wishes to build his carport . Mr .. and Mrs . * John Mazza , 127 West Haven Road , expressed that they had no objections to this construction . Mr . Homer DeGraff , 122 West Haven Road , says that he can see no reason to question this construction as long as there is no fire hazard involved , and there can 't possibly be , as construction under power lines is prohibited . Mrs . Costello , 135 West Haven Road , asks the dimensions of the -proposed construction . Mr . Bruce stated that the carport would be 25 ' X 24 ' and will be attached to the existing house . Mrs . Costello can see no objections . to the construction . " Upon motion by William S . Scott , seconded by Robert N . Powers and by unanimous vote the variance was granted . Meeting was adjourned at 8 : 20 P . M . Id J
