HomeMy WebLinkAboutZBA Minutes 1962-06-18 • i73 TOWN OF ITHACA ZONING BOARD OF APPEALS MINUTES JUNE181 1962 A meeting of the Town of Ithaca Zoning Board of Appeals was held at the Town Highway Building on Monday , June 18 , 1962 at 8': 00 P . M . Members of the Board present were : Chairman David F . Powers , Robert N . Powers , William B . Norton , and William S . Scott , Jr . Also present were : Robert J . Wells , Zoning Officer , Mr . Rodriquez of the Trinity Lutheran Church , Russel Savey , Homer MacNamee , and several residents of the Northview Road area . FIRST CASE : This is an appeal signed by Russel Savey for a variance in regard to the decision of the Zoning Officer denying permission to erect a house at 153 Nathview Road ( corner of Northview and Coddington Roads ) . Permit was denied under Article IV , Section 16 , of the Town of Ithaca Zoning Ordinance . Proof of publication was presented . Mr . Wells presented a map of the Northview Develop - ment by Richard MacDowell , dated February 25 , 1962 . The figures on this map were taken from deed records and from the original map of the Northview Development . This map showsthe dimensions of Mr . Savey ' s lot to be about 89 ' x 1381 . Mr . Savey , when applying for a • building permit, stated that the lot was about 110 ' x 1601 . His figures were based on the agreement which he had made with Homer MacNamee , seller , at the time of purchase . Mr . , Savey plans to move the side lot line 20 feet to the east so that he will have the required frontage and square footage . The seller refuses to give Mr . Savey the additional land that would give him the required depth . The general feeling expressed by the neighbors present was that Mr . Savey should !�not be allowed to build unless the dimensions meet those required by the Zoning Ordinance . One resident felt that the spirit in which Mr . Savey has built in this area has not been good . HIs lot sizes and houses have not been in keeping with the neighborhood . Another felt that Mr . Savey ' s investment should not be jeopardized . A motion was made by David Powers and seconded by William B . Norton to adjourn this hearing until June 26 , 1962 at 8 : 30 P . M . Unanimously carried . SECOND CASE : The adjourned hearing on the appeal of the Trinity Lutheran Church for a variance was called to order . This application was in regard to the decision of the Zoning Officer denying permission to erect a 41 x 61 sign on Honness Lane . Permit was denied under Article IV , Section 11 , of the Town of Ithaca Zoning Ordinance . . David Powers stated that two neighbors were not in favor of the sign and definitely protest its erection . A motion was made by William Scott and seconded by William B . Norton that the. variance applied for be denied on the basis that the permitted two 4 square foot signs would be adequate . Unanimously carried . THIRD CASE : The adjourned . hearing on the appeal of the Ashland Oi Company for a variance was called to order , This application was in regard to the decision of the ` Zoning Officer denying permission to erect a 4 ' x 61 sign at the site of their plant and warehouse off Elmira Road . Permit was denied under Article IV , ' Section 11 , of the Townpof Ithaca Zoning Ordinance . The minutes of the previous ' hearing held in connection with the location of the warehouse ' in 'a residential zone were read . The minutes specifically state . that the * original application did not request any signs and no signs were to be permittedrif the application was granted . A motion was made by Robert Powers and seconded by David Powers that the application for the variance by the Ashland Oil Company for erection of an identification -sign on their property be denied . A' motion was made by William B . Norton and seconded . by William Scott to table this motion until the next meeting so that the Board can obtain the opinion of the fifth member .' Ayes - Norton . Noes Powers , � Powers , Scott . Denied . Vote was taken on the original motion by Robert Powers . Ayes - Powers . , Powers , Scott . Noes - Norton . Carried . Meeting adjourned at 10 : 30 P .
