HomeMy WebLinkAboutZBA Minutes 1962-06-04 TOWN OF ITHACA ZONING BOJ RD OF API EALS MINUTES JUNE 4 ,,. 1962 A meeting of the Zoning Board of Appeals of the Town of Ithaca was held at the Town Highway Building on Monday , June 4 , 1962 at 70. 30 Polo Members of the Board present were : Chairman David F . Powers , Constance E . Cook , Robert N . Powers , William B . Norton , and William S . Scott , Jr . Others present werea Robert J . Wells , Zoning Officer , Mr . Welker of the . New York State Artificial Breeders , Inc . , Mr . Thomas Walters of the Ashland Oil Company , and two representatives of the Trinity Lutheran Church . First Case : This is an appeal of the New York State Artifi - cial Breeders , Inc . for special approval in regard to the decision of the Zoning Officer denying permission to build a new barn on Judd Falls Road . Permit was denied under Article XII , Section 54 , of the Town of Ithaca Zoning Ordin® ance , extension of a non conforming use , in a residential zone . Proof of publication was presented . Mr . Wells presented to the Board a map of the property showing existing structures and the location of the proposed barn . The size of the barn will be 82 feet by 132 feet and will be used for expansion and so as to abandon out dated and dangerous existing facilities . . The proposal mee all requirements as far as lot lines , etc . It is in keeping with the present development of the area with Ide ° s Bowling and the P & C Market across the road . There are only a few homes near-by . _ A motion was made by David Powers and seconded by Robert Powers to grant the special approval . Unani® mously carried . Second Case . This is an appeal of the Trinity Lutheran Church for - special approval in regard . to the decision of the Zoning Officer denying permission to erect a temporary sign on Honness Lane to indicate the future locution of the church . Permit was denied under Article IV., Section 11 , of the Town of Ithaca Zoning Ordinance . It will be - � constructed of painted plywood and supported by steel postso It will probably be up for about one yar , for the duration of construction . The Zoning Ordinance permits two four square feet signs in an Rm15 zone with a permitted use . The Church does not feel that these would be large enough for people to read as they pass by the siteo A letter from Mr . and Mrs . Enos Pyle was presented which states that they have no objections to the s, igno A motion was made by David Powers and seconded by William B . Norton to adjourn this hearing until the next scheduled meeting so that the Board can have more time to make their decision . Unanimously carried . Third Case : This is an appeal of the Ashland Oil Company for sp clal - approval in regard to - the decision of the Zoning Officer denying permission to erect a sign on the corner of Elmira and West Danby Roads . Permit was denied under Article XII , Section 54 , of the Town of Ithaca Zoning - .0rdin� ance , extension of a nonconforming use in a residential zone . Proof of publication was presented . The sign will be located on the property leased from Babooek by the Ashland Oil Company where their plant and warehouse are now locatedo The size of the sign will be six feet by four feet ; eighteen feet high , and lighted with lacquered inserts . It is already up , having been placed on the site about May 13 , 1962 . The Ashland Oil Company was granted special approve al by the Zoning Board of Appeals to use this site for their business about two years ago . The Board feels that it would be wise to review the minutes of that hearing to see if discussion of signs took placed A motion was made by David Powers and seconded by Robert Powers to adjourn this hearing until June 18 , 1962 at 8 : 00 :Pr.M0. Unanimously carried. . A mtion was made to send a letter to Mr . Emmet D ° Arcy of the New York State Highway Department protesting their authorization of signs on the state highway rightdof� way , as it is in conflict with the Town . of Ithaca Zoning Ordinance . f Mrs . Cook entered the protest made by Mark Beathan t against the drawing of gravel from the pit on Sand Bank Road by the William Lynch Corporation . Meeting adjourned. at 9 : 15 P . M ,
