Zoning Board of Appeals of the Town of Ithaca

The meeting of the Town of Ithaca Zoning Board of
Appeals was held at the Town Highway Building , Elmira Road ,
on April 11 , 1961 at 7 : 40 P . M . It was duly publicized in the
ITHACA JOURNAL on April 6 , 1961 . . Members of the Board
present were : Chairman William Rolston , David Powers , and
Aldus Fogelsanger . Others present were Robert Wells , Ben
Boynton , Cecil Miller , A . K . Reeves , E . R . Turk , Manning
Woolley , C . E . Green .
This is an appeal signed by Cecil W . Miller who
was denied permission to erect a one story , one family
residence of frame construction at 121 Coy Glen Road under
Article III , Section 9 , of the Zoning Ordinance . This is
in an R-9 Residential District had has an area of .10 , 500
square feet whereas 12 , 000 square feet are required as sewer
is not available although the City water is available . The
house will be 461 8f1 x 221 811 including carport and will have
two bedrooms and occupy about 10 . 6 % of the lot area . The
front and side yard requirements are fulfilled . The building
is 531 from the right — of —way at Coy Glen Road in the front
and there is a 601 back yard . Mr . Miller bought the land
last month from A . K . Reeves who still owns nearby land ..
This lot , except for about 201 which were sold off
the back about 1955 , appears on a map dated March 16 , 1929
as a part of the J . F . and E . D . Daley Development .
The neighbors who appeared were interested only
in the sanitation feature of the locality and had no objection
to the building since the Health Department - issued the .septic
permit .
It was moved by Powers and seconded by Fogelsanger
that since the Health Department permit is issued and there
112 ® is no objection from the neighbors ; that the variance be
granted . Unanimously approved .
