HomeMy WebLinkAbout1980's Games of Chance TOWN OF DANBY A local law Authorizing and Regulating the Conduct of Games of Chance by Authorized Non-Profit Organizations . BE IT ENACTED by the Town Board of the Town of Danby as follows: Section 1: Authority. This Local Law is enacted pursuant to the authority of Article Nine-A of the General Municipal Law of the State of New York, and shall be known as the Games of Chance Law of the Town of Danby. Section 2 : Definitions. The words and terms used in this Local Law shall have the same meaning as such words and terms are used in Article Nine-A of the General Muncipal Law of the State of New York. Section 3: Games of Chance Authorized; Restrictions . Games of chance may be conducted in the Town by an authorized non-profit organization, after obtaining a license therefor, in accordance with the provisions, requirements and limitations of Article Nine-A of the General Muncipal Law, the rules and regulations of the New York State Racing and Wagering Board and this Local Law. The conduct of games of chance on Sundays is authorized, except as otherwise restricted in Article Nine-A of the General Muncipal Law. Section 4 : Control and Supervision. The powers and duties set forth in subdivision one of Section 194 of the General Municipal Law shall be exercised by the Chief Law Enforcement Officer of the County of Tompkins . Section 5 : Effective date. This Local Law shall take effect immediately upon filing with the Secretary of State after approval thereof by the voters of the Tcwn voting thereon at a Special Town election to be held pursuant to the provisions of the Municipal Home Rule Law. 4' ORDINANCE NO. 80-9 GAMES OF CHANCE Shall Ordinance No. 80-9 of the City of Ithaca entitled "Games of Chance", which would permit certain games of chance by certain organizations within the City of Ithaca, pursuant to the provisions of Art. 9 (A) of the General Municipal Law, be approved and made effective? Your attention is directed to Section 195 (f-2) of the General Municipal Law relating to "an additional license fee" to be pay- able by the licensed authorized organizations. The Board has es- tablished the fee to be 5% of the net proceeds. The revenue derived by the municipalities from this fee must be used to defray the actual cost to municipalities or counties of administering the provisions of the games of chance licensing law. If any inquiries are made by organizations located in your jurisdiction relating to obtaining *an identification number you may refer them to our office. If you have not already done so, it is necessary that a copy of your local law or ordinance and vote tally be filed with the Board. The identification number is a prerequisite to obtaining a license to conduct games of chance from your office. If an identification number is approved by the Board, a Form GC-1 will be issued to the organization containing its identification number. The Board will send a copy of the approved GC-1A to your office and a notice containing the ident- ification number assigned to the organization. Form GC-1 (Part 5601 of Rules) is the form used by the Board to issue identification numbers to authorized organizations. Be- fore an organization can obtain a license to conduct games of chance it must have received an identification number from the Board. Forms GC-2, GC-2A and GC-2B (Part 5602 of Rules) are the forms to be used by authorized organizations in order to . obtain a license to conduct games of chance from your office. Forms GC-2A and. GC-2B are the schedules which must be completed as part of Form GC-2. Form GC-4 (Part 5603 of Rules) is the form to be used by the municipality in its determination of the eligibility of the or- ganization to receive a license to conduct games of chance. . Form GC-5 (Part 5603 of Rules) is the form of the license to be used by the licensing authority for the conduct of games of chance. Form GC-6 (Part 5604 of Rules) is the form to be used by the authorized organizations to amend their licenses to conduct games of chance. Form GC-7 (Section 195-f of the General Municipal Law) is the form to be used by the authorized organizations to report the de- tails of the conduct of each games of chance license period as well as the disbursement of games of chance funds . The 5% additional license fee is based upon the net proceeds for each license period. A copy of the GC-7 form must also be sent to the Board' s office (Instructions for the preparation of Form GC-7 are also enclosed) . Form GC-7B is the form to be used by the authorized organi- zation in connection with control of cash and games of chance currency utilized and must be submitted with Form GC-7 (Instruc- tions for the preparation of Form GC-7B are also enclosed) . Form GC-8 (Part 5602 of Rules) is the form to be used and • . ? maintained by the municipal licensing authority for each organi- zation which has received a license to conduct games of chance. Form GC-101 (Part 5606 of Rules) is the form to be used by an authorized organization for an authorized games of chance lessor' s license. Form GC-102 (Part 5606 of Rules) is to be completed and sub- mitted as part of Form GC-101. Form GC-109 (Part 5606 of Rules) is the form of the license to be used by the licensing authority for authorized games of chance lessors. Form GC-317 (Part 5605 of Rules)' is the form to be submitted by the authorized organizations to the Board requesting permission to disburse games of chance funds. • Bulletin No. 2 contains the guidelines for the disbursements of games of chance funds. Form GC-9 (Part 5624.18 of Rules) is the form to be used by the authorized organizations to report the details relating to rental income, expenses and disbursement of net proceeds in con- nection with the leasing_. of premises. Single entry bookkeeping system (Section 5624. 13) was inadvertently omitted in the book of rules and regulations . Each licensee shall - maintain a single entry bookkeeping system for the purpose of recording all receipts and expenditures in connection with the conduct of games of chance and disbursement of net proceeds derived therefrom. Such bookkeeping system shall consist of a- book prepared in the manner shown in Exhibits I and II enclosed. Two printers have undertaken the printing of forms and single entry bookkeeping system which are available for sale to the public.
