HomeMy WebLinkAbout2002-04-18 - TB 53 TOWN OF ULYSSES JOINT TOWN BOARD & PLANNING BOARD ZONING ORDINANCE WORK SESSION April 18, 2002 MINUTES Present: Town Supervisor Doug Austic, Town Board Members Carolyn Duddleston, Sue Poelvoorde, Planning Board Chair Lorren Hammond, Planning Board Members Dick Coogan and George Kennedy, Code Enforcement Officer Alex Rachun, Planning Consultant George Frantz, Planning Board Clerk Eileen Jacobs. Absent: Lee Scott, Robert Weatherby, Richard Geiger, Rose Hilbert, Mark Ochs, and David Tyler. The meeting was called to order at 7 : 10 p . m. Draft Zoning Ordinance for Town of Ulysses The issue of the how lake frontage is defined and how is it determined (measured) was discussed at some length. In the current draft, the definition reads, "In the case of lots that bound on a lake shore, the length of the boundary line abutting the lake, or the distance between the side lot lines extended to the mean high water mark. " Mr. Frantz agreed to look into how other municipalities such as Canandaigua and Aurora deal with this issue in there zoning regulations. Article XIII Administration Section 13. 1. 4 Special Permits This section was expanded by Mr. Frantz to give the Board of Zoning Appeals additional guidance in ranting special permits . There was general discussion about what special permits are used for, and how to their use is regulated . Special permits trigger SEQR, and there was agreement about the need for required minimum design standards so that developers can provide necessary information expected by the Town. Some examples of design standards that are needed were for stream buffers, parking, drive-through businesses and outdoor lighting. There was discussion regarding the appeals process. Decisions by the Planning Board can be appealed to the BZA, which is a judicial branch of Town government. Decisions of BZA can only be appealed to the Supreme Court. 13. 1.5 Application for Special Permit Delete #9 "My other information deemed reasonable and necessary by the Planning Board in its consideration of site plan approval . " There was discussions regarding the history of site plan review in the Town of Ulysses and why a Planning Board is necessary if the BZA can issue special permits and review site plans. It was agreed that the Planning Board is important in the review and approval of site plans that can potentially have a large impact on the character of the community, and it is also a place where the public hearing can bring important information to bear in the decision-making process . 13.2 Site Plan There was discussion regarding language in this section of the proposed zoning ordinance that refers to actions having to be taken in a certain number of (calendar) days. The need for a procedure in determining whether a submitted site plan is considered complete was discussed. Currently the Zoning Enforcement Officer has been making this determination, but feels that the Planning Board should be more involved. It was agreed that there should be a procedure in place between the Planning Board and the CEO regarding determination of completeness.
