HomeMy WebLinkAbout2002-04-08 - BZA 715 TOWN OF ULYSSES BOARD OF ZONING APPEALS PUBLIC HEARING & MEETING 4/8/02 PRESENT : Board of Zoning Appeals Chair George Tselekis, Board of Zoning Appeals members Ken Christianson, Carl Mann and Joel Warren, Code Enforcement Officer Alex Rachun, Zoning Clerk Karin Lanning . ALSO PRESENT : Randolph Smith, Michael Schott, applicants, one young man, accompanying Mr. Smith, one woman, accompanying Mr. Schott, names were not offered. Chairman George Tselekis called the meeting to order at 7 :35pm. The first order of business was hearing of the area variance request of Randolph Smith for tax parcel 22 . -5 -20.6, for the purpose of constructing an accessory building with a maximum roof height of more than 20' at the peak, the maximum allowed by the Town Zoning Ordinance. Mrs. Lanning affirmed that adjacent property owners were notified of Mr. Smith's application. No one from the public was present, no written responses were received, and no comments were made. Mr. Smith briefly described his project, noting first that the maximum height his barn will reach at the peak will be approximately 21 . 5 ', as opposed to the height of 26' that he had previously calculated. No aspect of the design has changed, but there was a miscalculation that was straightened out . Mr. Smith further explained that his barn will be a replica of one carriage-house style barn that is located in the Village of Trumansburg, which he passed around photos of. Mr. Smith intends to use the barn primarily as a wood- shop, where he will make cabinets. The height of the barn in general is needed to allow for accurate replication of the appearance of the original, and is further necessitated because Mr. Smith's barn will have a 10' high ceiling on the ground floor (where the original only has an 8' ceiling) to allow for the practical keeping and moving of large pieces of wood, which Mr. Smith will need for his cabinetry and other wood-craft. Mr. Mann asked if a wood-shop is a permitted use in a residential district. Mr. Rachun stated that it is allowable either as a home-occupation or as a construction-only site, whereby Mr. Smith may assemble his products in the barn, but must not have a show- room on the premises for selling his wares. All applicable regulations on signs and traffic for home occupations and residential accessory uses do , of course, apply. Hearing no further comments, Mr. Warren made the following resolution, which Mr. Christianson seconded : Whereas, the variance in regards to the requirement is not substantial, and, Whereas, there will be no resultant change in population density, nor any impact at all on the available governmental services, and, Whereas, there will be no detriment to adjoining properties nor any change in the essential character of the neighborhood, and, Whereas, the interests of justice will indeed be served by the granting of this variance, Be It Hereby Resolved that the variance be granted. Chairman Tselekis called the public hearing for the application From Mr. Michael Schott for tax parcel 33 .-3 -20 to order at 7 :43 pm. Mrs. Laming affirmed that all adjacent property owners had been notified of Mr. Schott's application, and no comments have been received. No comments were made by the public. Mr. Schott explained that the variance request is to allow him to construct an owner- occupied residence. A variance is requested on the grounds that the parcel does not have 200' of frontage and, despite widening as it goes back from the front property line, the lot is not wide enough to allow the required circumscription of a 200' diameter circle of usable area anywhere near the residence. Mr. Rachun noted that the lot may or may not widen to 200' further back than the planned residence, but that, without conducting a survey, it is not possible to ascertain. Mr. Mann asked about the nature of the adjacent properties to the side of Mr. Schott's lot. Mr. Schott stated that one parcel is a vacant lot, likely to remain so because there is a creek crossing it, and the other has a single-family residence on it. Hearing no further comments, Mr. Christianson moved and Mr. Warren seconded the following motion: 1 Whereas, the variation in regards to the requirement is not substantial, and, Whereas, there will be a very minimal change in population density and equally minimal impact on all available governmental services, and, Whereas, the project will have no impact whatsoever on the character of the neighborhood, and no detrimental impact on adjoining properties, and, Whereas, the interests of justice will be served by the granting of this variance, Be It Hereby Resolved that the variance be granted. The final order of business before the Board was the approval of minutes from the meetings of 11 / 12/2001 and 3/11 /2002 . Mr. Warren moved to approve the minutes of the March 1 lt', 2002 meeting and Mr. Christianson seconded. Mr. Mann moved to approve the minutes of November 12th, 2001 and Mr . Christianson seconded. Mr. Christianson aye Mr. Mann aye Mr. Tselekis aye Mr. Warren abstained Adopted. Following the approval of minutes, the Board members asked Mr. Rachun if there were any upcoming matters that they should be aware of. Mr. Rachun stated that there are none at present, excepting perhaps the fact that work on the Jacksonville-area water district goes on. Of late, a major source of funding for this project has been approved and finalized after a long wait, property has been purchased for the pump station and the water tank, and engineering work on the project is moving along. Hearing no further business, Mr. Warren moved, seconded by Mr. Christianson to adjourn the meeting. The motion carried unanimously, and the meeting adjourned at 7 : 50 pm.
