HomeMy WebLinkAbout2002-03-28 - TB TOWN OF ULYSSES JOINT MEETING — DRAFT ZONING ORDINANCE TOWN BOARD & PLANNING BOARD March 28 , 2002 MINUTES Town Board Members Present: Doug Austic (Supervisor) , Sue Poelvoorde. Absent: Carolyn Duddleston, Lee Scott, and Robert Weatherby. Planning Board Members Present: Dick Coogan, Richard Geiger, Lorren Hammond (chair), Rose Hilbert, George Kennedy. Also, Eileen Jacobs, planning board clerk Absent: Mark Ochs, David Tyler. Others Present: Alex Rachun, Code Enforcement Officer; Bruce Wilson, Town Attorney; George Frantz, Planning Consultant. Supervisor Austic called the meeting to order at 7 :00 p .m. The purpose of this meeting was to continue review of the draft-zoning ordinance prepared by George Frantz. Article IX — B1 -Business District 9.5 Lot Area & Yard Requirements Mr. Frantz explained why no minimum lot area was proposed — that the size of the business determines lot size, taking parking and other considerations into account. There was lengthy discussion regarding front yard setback. Thirty feet from right-of-way is what is being proposed, and there was a suggestion that it be increased to 50 feet. Mr. Frantz agreed to do some research into this and explore what exists along the Route 96 corridor for comparison. There was also discussion about side yard setbacks regarding fire safety, specifically what the Fire Department and NYS building code might require in terms of fire access. This issue will be revisited. It was agreed that minimum rear setback should be 40 feet . Article X — BH — Hamlet Business District 10.2 Permitted Uses First part of italicized sentence should read "Place of business such as the following, and businesses of a similar and no more "intense use" . . . Move Dry cleaner to 10.4 "Uses by Special Permit . " Remove "drive- in theatre" from permitted use . 10.3 Permitted Accessory Uses Remove off-street loading areas — There was discussion regarding traffic safety issues and trucks backing into traffic during loading or unloading in off- street areas. 1.0.3 Permitted Accessory Uses Outdoor dining facilities — delete the word "facilities. " 10.4 Uses Permitted by Special Permit Add Family adult care. 10.5 Lot Area & Yard Requirements After some discussion regarding off-street parking, it was agreed that no parking shall be allowed in front of buildings, and must be within a certain distance of the business. Joint Meeting Minutes 3/28/02 2 Article XI — IL Light Industry District Add "Purpose" section from comprehensive plan. 11 .2 Permitted Uses Remove conference center. Since the area that is currently zoned Eight industry is very limited, there was discussion regarding the need to retain the land that is available for more industrial- type use. There was concern regarding competition for land in the light industry zone, and the need to provide for compatible uses in other zoning districts. Remove agricultural commerce, but leave Agriculture as a legal nonconforming use. Self service storage facility — move to Uses Allowed by Special Permit (needs design criteria) . Mr. Frantz distributed a revised zoning ordinance draft that incorporates changes suggested to date. He noted that new items are underlined in the document. He also suggested the creation of a new zoning district to accommodate the fairgrounds classified as, the A2 Agriculture District, which allow fairs.
