The meeting of the Zoning Board of Appeals of the Town of Ithaca was called to order by the chairman Mr . Rol - ston at 7 : 30 P . M . at the Tompkins County Court House on June 13 , 1960 , as was advertised in the ITHACA JOURNAL on June 6 , 1960 . Members present were : Chairman William Rolston , David Powers , and Secretary Constance E . Cook . Also present were : Robert J . Wells , Zoning Officers Amelia M . Thomas , applicants and James Buyoucos , attorney . The chairman , Mr . Rolston , stated that the purpose of the meeting was to consider the pEtition of Mrs . Amelia M . Thomas to erect a sign at the East Shore Mart , East Shore Drive , which might be an extension of a non- conforming use . Permit to erect said sign had been denied by the Zoning Of - ficer under Sections 12 , 53 , and 54 of the Zoning Ordinance . Reasons in support of the proposed change were stated by the applicant . Mrs . Thomas felt that no permit was necesslary , since the sign is necessary to business which is a legitimate non- conforming use , and the sign would replace one that was previously on the premises . The Zoning Officer , Mr . Wells , had advised Mrs . Thomas that it was a violation of the Zoning Ordinance of the Town of Ithaca to place a sign approximately 61 . x 14 ' in size on the concrete abutment next to the store . Attorney James Buyoucos , appearing without con ceding jurisdiction of the Board or prejudicing the rights of the applicant , had advised his client , Mrs . Thomas , to cooperate when she was notified of the warning by the Zoning Officer . More discussion followed . The applicant operates a non- conforming use . There has been a sign there as late as last year advertising the various products on sale at the store . Last fall , the sign had been removed by students . The sign to be replaces is substantially the same size as the 4 ' x 5 ' sign which had been removed last fall . The sign is necessary because the East Shore Mart depends on transient trade , and is open only during the summer months . Mrs . Thomas stated that the original sign was there 1h 1951 , when she purchased the property . It was approximately 11 ' x 16 ' in size . A Canada Dry "sign , approximately 4 ' x 5 ' in size , was put up last year . There has always been a sign . .. of some sort there . The proposed sign will be on placard , the same as is the Canada Dry sign . There was no opposition to the proposed sign . A motion was made and duly seconded that the Board grant the petition of Mrs . Thomas to erect a sign , 6 ' x 14 ' feet , upon condition that it is taken down during the period the store is .closed from on or about December lst to April lst , without . prejudice to the rights of the applicant to es - tablish her non - conforming rights existing at the effective date of the applicable provision of the Zoning Ordinance .
