HomeMy WebLinkAbout2002-02-19 - TB 3d TOWN OF ULYSSES JOINT MEETING — DRAFT ZONING ORDINANCE TOWN BOARD & PLANNING BOARD February 19, 2002 MINUTES Town Board Members Present: Doug Austic (Supervisor) , Carolyn Duddleston, Sue Poelvoorde, Lee Scott, and Robert Weatherby. Planning Board Members Present: George Kennedy, David Tyler. Also, Eileen Jacobs, planning board clerk Absent: Richard Geiger (excused), Lorren Hammond (excused), Rose Hilbert (excused), Paula Horrigan (unexcused), Mark Ochs, (unexcused). Others Present: Alex Rachun, Code Enforcement Officer; Bruce Wilson, Town Attorney; George Frantz, Planning Consultant; and Dick Coogan. Supervisor Austic called the meeting to order at 7 :00 p. m. The purpose of the meeting was to continue review of the draft-zoning ordinance prepared by George Frantz. Mr. Austic suggested that an in-depth discussion of special permit standards be undertaken at a future meeting. There was some discussion regarding churches and schools in land use law. Mr. Frantz proposed that extractive industry be placed in the industrial zone only. Mr. Tyler proposed that the following paragraph be added to Article I — Purpose : To preserve, foster and enhance the native beauty and rural character of one of the most picturesque and charming communities in the Finger Lakes Region of Central New York, a community that is known for sweeping vistas of farmland, hills and Cayuga Lake, and presently contains more historic homes within its borders than any other township in Tompkins County. Following discussions, the following revisions to the draft-zoning ordinance were proposed : Article IV-A1 -Agricultural District 4.3 Permitted Uses Add Flag lot, Stable 4.5 Uses Permitted by Special Permit Bed and breakfast inn - remove the word "inn." Note: Mr. Frantz explained that Bed and Breakfast is an owner-occupied, single-family residence offering overnight accommodations and breakfast for no more than 5 persons. Add Cemetery; Elder Cottages. Remove Community centers, Extractive industry, Fraternal organizations. There was discussion about possibly removing campgrounds and golf courses in this district, but the matter was tabled for future discussion. Hunting club - in definition (p. 12) remove phrase "and other outdoor recreational purposes." Note: Mr. Frantz will work on language regarding prohibiting the use of motorized vehicles (e. g. snowmobiles, motor cross) from hunting club definition and use. Add definition for inn — "see hotel" Lodge — in definition section add " . . . meals ` may' (or ` can ' ) be offered . . . " 4.6 Lot Area & Yard Requirements There was a discussion regarding ways in which to protectively zone agriculture by creating large building lots. Mr. Frantz explained and illustrated a zoning tool that has been successfully implemented in parts of Pennsylvania. It allows that for each tract of agricultural land, no more Joint Meeting Minutes 2/ 19/02 2 than one building lot is created for each 10 acres within the parcel. Mr. Frantz agreed to draft a proposal for this body to consider. The following revisions were proposed : Define agricultural lot . Minimum lot area shall be 2 acres; maximum lot area shall be 3 acises for any non-agricultural lot. Minimum lot width at the maximum front yard setback line shall be 250 feet for any non- agricultural lot. Maximum lot depth shall be 350 feet for any non-agricultural lot. After a discussion regarding possibly increasing feedlot setback requirements, it was agreed that Mr. Frantz will check DEC and Ag & Markets regulations to see if' they would preclude more than 200 feet from any road or highway right of way line, side yard or rear yard line. Article V - RS — Suburban Residence District 5. 1 Purpose — remove "in areas served by public water and/or public sewer" After a brief discussion, it was proposed that this entire section be moved to follow the section on RR - Rural Residential. Article VI — RR-Rural Residence District 6. 1 Purpose - remove "in areas of the town not served by pubic water or public sewer. " 6.2 Permitted Uses "Two-family residences" (remove remainder of sentence referring ro floor area of second unit not to exceed 50% of primary unit) . Add Communication transmission towers and telecommunications facilities, subject to the provisions of Article XII Add flag lot . 6.3 Permitted Accessory Uses Family child care — add Family adult care (or Family Child/Adult Care) . Provide definition for Family Adult Care. Office of a resident doctor, etc. — add "accountant". Remove "Non-commercial garden or home nursery. " There was discussion regarding what an acceptable size for freestanding dish antennae would be. Initially there was concern regarding commercial use of dishes, as well as aesthetics issues. 6.4 Uses Permitted by Special Permit. Add "Elder Cottage" and provide definition. Fraternal organizations — add language to prohibit the sale of alcohol on the premises. Remove Manufactured Home Park. It was proposed that a new district (Manufactured home district) be created for mobile homes, and that mobile homes will go into only those zones. It was agreed to meet again on Tuesday, March 5 , 2002 at 7 : 00 p.m. in Ulysses Town Hall. Meeting was adjourned at 10 : 00 p. m. At the conclusion of the meeting held earlier this evening, Town Board members still present gathered to discuss one item — a request by the Town Planning Board to have an extension of February 28 deadline to submit comments on the draft zoning ordinance. After a brief discussion, Mr. Scott made the following motion: RESOLVED, that the Town Board hereby extends the deadline for submission of comments by the Town Planning Board regarding the draft zoning ordinance until the fmal draft has been completed for fmal review. Ms. Poelvoorde seconded the motion. Mr. Austic aye Ms. Poelvoorde aye Mr. Scott aye Mr. Weatherby aye Motion carried unanimously, 4-0.
