The adjourned meeting of the Zoning Board of Appeals of the Town of Ithaca was held on April 2 , 1960 at 12 : 15 P . M . in the Supervisors Rooms of the Tompkins County Court House in the City of Ithaca , as was announced at the meeting held on March 31 , 1960 . Members present were : Wiliam-lRolston , chairman ; David Powers ; and Constance E . Cook , secretary . Others present were : Mr . Charles A . Collins , Sr . ; Enos Pyle ; Ben Boynton ; Robert J . Wells ; and a neighbor , Mr . Ahmann . The meeting was called to order by the chairman , Mr . Rolston . . He asked for further discussion on . the appli - cation of Mr . Charles A . Collins , Sr . Mr . Pyle , attorney for Mr . Collins , stated that he hoped the board would base its findings on the following . 1 ) is this or is it not a non- conforming use / The application of Mr . Collins is to erect a 30 . x 50 ' cinder block structure to replace existing barns ; and 2 ) is this an extension of his non- conforming use ? Mr . Pyle went on to state that the barn to be torn down has been used for this kind of business since 1911 . The present barn has electricity and water . The new barn would continue same facilities as is now present in the old barn . Mrs . Cook reviewed the principles on which the Board bases its findings , and noted that the application of Mr . Collins is for Special Approval . Discussion followed as to the capacity of the pro - posed structure . Mr . Powers noted that the new building could house five trucks . And since this new building could house five trucks , this is an extension of the present non - conforming use . Mr . Pyle stated that the mere fact that the new building could house five trucks does not necessarily mean an extension of the non- conforming use . Mrs . Cook asked what equipment had been kept in the present structure since 1954 . Mr . Collins answered that the following equipment ( not necessarily all at one time ) had 114 been stored there : garbage equipment , bulldozer , picnic table , small tolls , and four trucks . At any one time , only three trucks and a bulldozer could be stored there . Mr . Collins pointed out that sometimes trucks are taken home by the drivers , and sometimes they are parked in the barn . Further discussion followed : Mr . Ahmann - 112 Blackstone Avenue . He noted that trucks are parked both in and outside the barn , with no par - ticular pattern , and at no particular time . Mrs . Cook noted that Mr . Collins is limited to the exactly defined use of his property as it was used before the enactment of the Zoning Ordinance in 1954 . Question raised as to what extent present barn is used to house trucks . Mr: . Collins said that in the winter - time , four trucks have been perked inside the barn . Mrs . Cook asked if there are nights when there are no trucks parked out - side . Mr . Ahmann noted that at times , this was true , but there is no stable pattern - only eratic use . The board then voted to adjourn the meeting to the premises in question in order to look at the present barn on the Collins property . After the board looked over the pro - perty , Mr . Powers noted that it would be impossible to get ., even one truck inside the present barn , fully enclosed . The ' S board reached the unanimous decision that the application be denied since the application is for a non- conforming use and is an application for an extension of the non- conforming use , and no community goal would be served . Other business - The Zoning Board of Appeals recommended to the Town Board of the Town of Ithaca that aerial photographs of the entire town be taken as of the time the Zoning Ordinance is amended and that spot ground photographs of certain areas be taken - - thus facilitating decisions for variance and special approval of applications concerning the enforcement of the.
