HomeMy WebLinkAbout2002-01-30 - TB I � TOWN OF ULYSSES SPECIAL TOWN BOARD MEETING 1/30/2002 PRESENT : Supervisor Doug Austic, Town Board Members Carolyn Duddleston, Sue Poelvoorde, Lee Scott, and Robert Weatherby, Town Clerk Marsha Georgia. Supervisor Austic called the meeting to order at 7 : 30pm. The primary matter of business for the evening was review of the first draft of the revised Town of Ulysses Zoning Ordinance, as submitted to the Board for review by contractor George Frantz. Before starting on this matter of business, the Board addressed the following matters : Dormitory Authority Grant Contract Supervisor Austic reported that he received the contract application packet from the Dormitory Authority for the $500,000 grant in the mail. Purchase Offer: Property for Pump Station/Water Tank After brief discussion, Mrs. Duddleston moved, seconded by Ms. Poelvoorde the following BE IT RESOLVED that the Town Board of the Town of Ulysses authorize Supervisor Austic to forward the purchase offer prepared by the Town Attorney Bruce Wilson to Ms. Paula McClure for the previously appraised portion of parcel #23 . -01 - 11 . 134, located on Wolf Lane in the Town of Ithaca, with a proposed sale price of $ 10,000 and, BE IT FURTHER RESOLVED to forward- the purchase offer prepared by Town Attorney Bruce Wilson to Ms. Nedra L. Harvey for the previously appraised portion of parcel # 34. -3 -27, with a proposed sale price of $5 ,000 for the land on VanDorn Corners Road. Mr. Austic aye Mrs. Duddleston aye Ms. Poelvoorde aye Mr. Scott aye Mr. Weatherby aye Adopted. Supervisor Austic will submit the above purchase offers on behalf of the Town of Ulysses. Banking : Authorization for Supervisor to Transfer Town Funds via Internet Transfers Ms. Poelvoorde moved, seconded by Mrs. Duddleston, the following : BE IT HEREBY RESOLVED , that the Town Board of the Town of Ulysses hereby authorize the Town Supervisor to enter into Electronic Funds Transfer Agreements including but not limited to ; Funds Transfer Agreements, Agreements for the Automatic Transfer of Credits and/or Debits, and Trust Company Internet Banking Enrollments, with Tompkins County Trust Company, AND, that the Town Supervisor is authorized on behalf of the Town of Ulysses to execute such Agreements with the Tompkins County Trust Company as he deems suitable and proper; Town of Ulysses 2 ) C) Special Board Meeting 1 /30/2002 AND BE IT FURTHER RESOLVED , the Town Supervisor is also hereby authorized to designate different or additional individuals as authorized representatives of the Town of Ulysses in accordance with the particular EFT Agreement. Public Hearing : Trumansburg Fire Department Contract Mr. Scott moved, seconded by Mr. Weatherby the following BE IT RESOLVED that the Town Board of the Town of Ulysses schedule a public hearing on the proposed 2002 Fire Protection contract with the Trumansburg Fire Department for 7 : 20 pm on Tuesday, February 12`h Mr. Austic aye Mrs. Duddleston aye Ms. Poelvoorde aye Mr. Scott aye Mr. Weatherby aye Adopted. Memorial Donation for Paula J. Mount Mrs. Duddleston moved, seconded by Ms. Poelvoorde the following resolution: WHEREAS, the Town Board of the Town of Ulysses expresses its sympathy and condolences to the family of Paula J. Mount and, WHEREAS, the Town Board of the Town of Ulysses wishes Ito honor Paula, a former Deputy Town Clerk, Tax Collector, Justice Clerk, and most of all Friend, BE IT HEREBY RESOLVED, that the Town Board of the Town of Ulysses hereby makes a donation of $50 to the Ulysses Philomathic Library, in remembrance of Paula. Draft Revised Ulysses Zoning Ordinance It was noted that, since the Planning Board and the Town Board are likely to have many of the same questions and issues for Mr. George Frantz, it would be sensible for the initial meeting with Mr. Frantz to include both the Town Board and the Planning Board. Mrs. Georgia noted that the Planning Board had set a meeting for February 7th and requested Mr. Frantz's attendance. The draft revised Zoning Ordinance was discussed as follows:: Page Section Notes 2 2 . 5 Possibly add "expert "/consultant fees, to be charged the . 2 Town of Ulysses 3 �. Special Board Meeting 1 /30/2002 back to the applicant . 3 2 . 8 Compliance will not be with this Zoning Ordinance, but with the NYS Uniform Building and Fire Prevention Code. Cover grand fathering/variance procedures for structures built prior to 2002 . 4 2. 11 Include tax liability for violations that are not corrected by the property owner; establish fines/ notification schedules. The Town Attorney will look into these matters. 6- 17 3 .2 adult entertainment business-Attorney will look into Bed & Breakfast Inn-more definition, State Code needs to be noted. Add adult care Clinic-add well care to defined purposes Home occupation-remove, is defined in Comprehensive Plan Lodge-more definition Manufactured Homes-remove additional definition of "mobile home " Sawmill-remove treatment as acceptable use, use term "planning " instead 18 4.2 Kennel should be a use allowed only by special permit 19 4.4 " Special permit" needs to be more defined. Large gathering use could create problems within agricultural districts. 20/24/27 4 . 5 , 5 . 5 ,6. 5 Required Frontage is possibly too little-an increase from the current 200' seems wiser than a decrease. 21 4 . 5 Ask Mr. Frantz about 5 % lot coverage clause and rationale behind lodge acreage requirement. 22/25 5 .2/6.2 Ask Mr. Frantz about two-family residences second-unit floor area clause. 23 5 . 3 Remove " non-commercial garden or home nursery 23 5 .4 Special Permit-set criteria 24 5 . 5 (Besides frontage issue) Lot size of 3/4 acre.
