Zoning Board of Appeals of the Town of Ithaca .
October 29 , 1959 .

The adjourned meeting of the Zoning Board of Appeals
of the Town of Ithaca was held on October 29 , 1959 at 5 : 15 P . M .
in the Tompkins County Court House in the City of Ithaca . Mem -
bers present were : William Rolston , chairman ; David Powers ; and
Constance E . Cook , secretary .
The chairman called the meeting to order and stated
that the purpose of the meeting was to consider further the
petition of S . L . Boothroyd for a variance from Section 280 - a
of the Town Law as it limits the Town Zoning Ordinance , which
Section requires presumptively access of 15 feet fronting on
highway approach . The proposed division of the lot on Roat
Street into two lots would only provide a 1236 foot access for
each lot after division .
Mr . Boynton stated that George P . Adams , a neighbor
of Mr . Boothroyd ' s and his attorney had stated they had no
objection to the variance .
Discussion took place which showed that an additional
5 foot strip of land could be purchased which would give each
lot the required 15 foot access . No unnecessary hardship or
practical difficulty was shown at this time which would justify
a variance from the zoning requirements and the application was
unanimously denied .
The second item of business was the announcement that
the Town Board would receive from the Planning Board the first
phase of the revised zoning ordinance on November 4th , and the
Town Board would discuss it on November 5 , 1959 .
There being no other business , the meeting was
adjourned .
