A meeting of the Board of Zoning Appeals of the Town tof Ithaca was held on September 5 , 1958 at 5 P . M . at the town barn . The members present were William Rolston , chairman , Aldus Fogelsanger ; and Constance E . Cook , secretary . The chairman , William Rolston , called .the meeting to order and stated that the purpose of ,the meeting was to con- sider the petition of Peter F . Maxson , for a variance of . Article II , Section 7 of• the town zoning ordinance which re - quires a side yard of 10 feet in respect to property located at 1071 Taughannock Blvd . Applicant proposed to construct an addition to his home which would extend to a point three feet from the side lot line . After hearing testimony of Gabriel Meckenberg , attorney for the applicant and after discussion , the board upon motion duly made and seconded , unanimously .adopted the following resolution . WHEREAS , the applicant needs the additional room to made a year -round house out of the present cottage ; the lot is long and narrow - and it would not be possible to expand in any other direction , because of the steepness of the terrain ; and building elsewhere would necessitate relocation of utilities at great cost ; and WHEREAS , no objection has been expressed to the board and letters in support of the application have been filed by most neighbors , and in view of the above stated facts there are practical difficulties and an unnecessary hardship in carrying out the strict letter of Section 7 of the zoning ordinance and WHEREAS , the variance applied for is in general ac - cord with the spirit of the ordinance and the public will , safety and welfare be served and substantial justice will be done if said variance is granted , be it 710 RESOLVED , that the variance applied for be and is hereby granted and an order to said effect shall be entered in the office of the Town Clerk . The board then considered the application of Mildred Keiffer McIntyre for a variance in the front yard requirements as set forth in Sections 7 and 21 of the town zoning ordinance with respect to • pro'perty located at 253 Stone Quarry Road . Applicant proposes to add an addition to her house which will not have a 25 foot front yard by surveyor ' s measurements . After hearing testimony of the applicant and after discussion , the board , upon motion . d.uly made and seconded , unanimously adopted the following resolution : WHEREAS , the existing house does not have the re - quired _ front yard ; the terrain is so steep that the walking distance from the highway to the proposed building would be in excess of 25 feet ; construction of the addition in another place would not be feasible ; applicant has demonstrated the need for additional room in her house ; the nearest neighbor is at least 1500 feet away ; other houses in the neighborhood are closer to the highway ; and it would improve the neighbor . hood to expand the house ; and WHEREAS , no objections have been expressed to the board , and there are practical difficulties and an unnecessary hardship in carrying out the strict letter of Section 7 and 21 of the zoning ordinance and WHEREAS , the variance applied for is . in general accord with the spirit of the ordinance , the public safety and wel . fare will be served and substantial justice will be done if said variance is granted , and consideration having been given to the promotion . of the health , safety , morals and general welfare of the community , be it RESOLVED , that the variance applied for be and is here - by granted and an order to said effect shall be entered in the office of the Town Clerk .
