Minutes of Meeting
of
Zoning Board of Appeals of the Town of Ithaca
July 17 , 1958 .

The meeting of the Zoning Board of Appeals of the
Town of Ithaca was held on July 17 , 1958 in the office of
the Town Assessor , 132 Forest Home Drive at 5 : 15 P . M .
Members present were : . David Powers ; Robert Powers ,
Aldus Fogelsanger . The Town Assessor , Ben Boynton was
also present .
The chairman called the meeting to order to consider
the petition of Billy J . Belous to build a house at 178
Kendall closer to the rear line than Section 7 of the
Zoning Ordinance allows .
After discussion , the board unanimously adopted the
following resolution , upon motion duly made and seconded :
WHEREAS the actual front of the house faces notth—
west rather than on Kendall Avenue having sufficient area
behind the house and the topography of the land does not
permit putting the tile . field in back of the house but
in front , and there have been no objections expressed to
the board and in view of the above stated facts there are
practical difficulties and an unnecessary hardship in
carrying out the strict - letter of Section 7 of the Zoning
Ordinance and
WHEREAS THE variance applied for is in general accord
with the spirit of the ordinance and the public will ,
safety and welfare be served and substantial justice will
be done if said variance is granted , be it
RESOLVED that the variance applied for be and is hereby
granted and an order to said effect shall be entered in
the office of the Town Clerk .
It was also moved that a recommendation be made to
the Planning Board that the layouts in the entire area be
reviewed .
There being -no other business the meeting was adjourned .
