The meeting of the Zoning Board of. Appeals of the Town of Ithaca was held on June 25 , 1958 at 5 : 15 P . M . in the garage of David Powers on Buttermilk Falls Road as advertised .in the Ithaca Journal . Members present were : David Powers ; Robert Powers ; Aldus Fogelsanger . The acting chairman Aldus Fogelsanger called the meeting to order and stated that the purpose of the meeting was to consider the petition of Knight Paving Company to erect an 8 x 12 building . After discussion the board unanimously adopted the following resolution , upon motion duly made and seconded : WHEREAS the foundations were in prior to October 1954 and in view of the above stated facts there are practical difficulties andan unnecessary hardship in carrying out the strict letter of the ordinance and WHEREAS the - variance applied for is in general accord with the spirit of the ordinance and the . public will , safety and welfare be served and substantial justice will be done if said variance is granted , be it RESOLVED that the variance applied for be and is hereby granted and an order to said effect shall be entered in the office of the Town Clerk . The second item of business was the appeal of the Knight Paving Company for a permit to erect a ' 4000 gallon tank in addition to those existing , which would be a variance of Sections 4 and 21 of the zoning ordinance . After discussion from the neighbors in the area and the attorney for the applicant William Easton , Esq . , the board unanimously adopted the following resolution , upon motion duly made and seconded : WHEREAS there have been objections expressed to the board by various neighbors and there would be no practical G6 difficulties or unnecessary hardship and the spirit of the ordinance had not been observed nor had public safety and welfare been secured and substantial justice had not been done if said variance is granted and consideration having been given to the promotion of the health , safety , moral's and general ' .welfare of the community , be it RESOLVED , that the variance applied for be and is hereby denied and an order to said effect shall be entered in the office of the Town Clerk .
