of
Zoning Board of Appeals of Town of Ithaca
June 2 , 1958

Applicants .
The meeting of the Zoning Board of Appeals of the Town
of Ithaca wa's held on June 2 ,' 1958 at 5 : 15 P . M . at the
Firehouse of the Village of Cayuga Heights as advertised
on May 27 ., 1958 in the Ithaca Journal . Members present
were : William Rolston , chairman ; David Powers and Robert
Powers . Also present were about twenty -five neighbors of
the Knight Paving Company .
The chairman William Rolston called the meeting to
order and stated that the .purpose of the meeting was to
consider the petition of Thomas Solan for a variance in
requirements of Section 6 of the Zoning Ordinance with
respect to building a carport at his residence at 345
Coddington Road .
After hearing testimony of the applicant and after
discussion the board unanimously adopted the following
resolution , upon motion duly made and seconded :
WHEREAS the terrain necessitates building the carport
9 feet from the road right of way and applicant needs the
carport , and
WHEREAS no objections have been expressed to the
Board and in view of the above stated facts there are
practical difficulties and an unnecessary hardship in
carrying out the strict letter of Section 6 of the Zoning
Ordinance , and
WHEREAS THE variance applied for is in general accord
with the spirit of the ordinance and the public will ,
safety and welfare will be served and substantial justice
will be done if said variance is granted , be it
RESOLVED that the variance applied for be and is
hereby granted and an order to said effect shall be entered
in the office of the Town Clerk .
The board then discussed the applications of Knight
Paving Products to erect an addition to a non- conforming
use garage , size 8 x 11 in violation of Section 21 of
the Zoning Ordinance .
After discussion by approximately 25 neighbors who
were opposed to the addition , the board decided to adjourn
the meeting until June 9 , 1958 . There being no further
business the meeting was adjourned until that date .
