HomeMy WebLinkAboutZBA Minutes 1958-04-28 59 Minutes of Meeting of Zoning Board of Appeals of the Town of Ithaca The meeting of the Zoning Board of_ Appeals of the Town of Ithaca was held on April 289 1958 at 5 : 30 P . M . in the Cayuga Heights Village Hall as advertised on April 25 , 1958 in the Ithaca Journal . Members present were : William Rolston , Chairman ; David Powers ; Aldus Fogelsanger ; and Constance E . Cook , Secretary Others present were Ben Boynton and an officer of the New York State Artificial Breeders Co - op . The chairman called the meeting to order and stated that the purpose of the meeting was to consider the petition of Raymond Frear for a variance in requirements of Section 4 of the Zoning Ordinance with respect to his lot owned at the corner of Hayts and Trumansburg Road . The New York State Artificial Breeders Co - op wishes to place a directional sign to aid its patrons in finding its barn located on the Sheffield Road . The, applicant has consented to permit erection of a sign on his premises without charge . The sign which has already been made is five feet by two and . one -half feet ( 5 X- 2 ft . ) or twelve and one -half square feet ( 12h ) . After hearing the testimony of the officer' for the Artificial Breeders Co - op and the Town Zoning Officer the board unanimously adopted the following resolution : WHEREAS the Town Zoning Ordinance contains no pro - vision for the erection of directional signs it . does permit the erection of identification signs on the premises to which it refers . It appears that the proposed sign , is a necessary adjunct to the co - op ' s farm . It will be located near a similar sign of - the Hillendale Golf course which was on the premises prior to the enactment of the zoning laws and the next property owners have no objections . WHEREAS , the sign has already been constructed and its size is only one -bald square feet in excess of that allowed by the ordinance , the applicantewill not be required to alter the sign to comply , the variance being de minimus . 60 \ The Board found in view of the above stated facts it would be an unnecessary hardship to deny the application . However , in consideration of the promotion of the general welfare of the community along the Trumansburg Road , the permit to erect the sign will be granted temporarily so that if objections are made after the erection of the sign the board may reconsider its findings . If no objections are made by the time of the next meeting a permit for a limited number of years will be granted . The Board discussed - two proposed amendments to the Zoning law . One would amend Article I Section 6 to provide that a residence shall be for one and two families only . The other amendment provided for the establishment of " floati.ng" zones for multiple housing . The Board approved in principle the idea that . multi - ple housing and residences should be controlled . It was of the opinion that the Town Board should act quickly to protect property owners and therefore moved unanimously to approve the proposed amendment . The Board was of the opinion that the proposed amendment requirements would be objectionable in the long run unless the ordinance was amended to permit . the erection of apartment houses in appropriate zones .
