Alfred Eipper , Leonard Leberman , Knight Paving Company , - George Ideman - Appli•cants . The meeting of the Zoning Board of • Appeals of the Town of Ithaca was held on February 27 , 1958 at 5 : 15 P . M . at the town barn as advertised on February 21 , - 1958 in the Ithaca Journal . Members present were : William Rolston , chairman ; David Powers ; -Robert Powers ; - and Constance E . Cook , secretary . Others present were : Alfred Eipper , applicant ; Leonard Leberman , applicant ; and Norbert Schickel . The chairman William Rolston called the meeting to order and stated that the purpose of the meeting was to consider the petition of Alfred W . Eipper fora variance in requirements of Section 21 of the Zoning Ordinance with respect to his residence at 1571 Slaterville Road . After hearing testimony of the applicant and after discussion , the board unanimously adopted the following resolution , upon motion duly made and seconded . WHEREAS the house does not have the required front yard because a steep slope necessitated construction close to the road and the applicant needs additional room in his house and the applicant owns a large tract of land and the additional . room or rooms can be added to the rear, and WHEREAS no objections have been expressed to the board and in view of the above stated facts there are practical difficulties and an unnecessary hardship in carrying out the strict letter of Section 21 of the Zoning Ordinance , and WHEREAS the variance applied for is in general accord with the spirit of the ordinance and the public will , safety and welfare will be served and substantial justice will be done if said variance is granted , be it RESOLVED that the. variance applied for be and is hereby granted and an order to said effect shall be entered in the office of the Town Clerk . 5- 6 The board then discussed the applications of George Ideman for change of zone , Knight Paving Products for change in use , and Leonard Leberman for annexation . -Mr . Norbert Schickel appeared as an owner land adjacent to Knight ' s Paving Products . Mr . Schickel stated that it is his intention to develop his property for residential purposes . The board adopted the annexed report and directed that it be sent to the Town Board . REPORT of the TOWN OF ITHACA BOARD OF ZONING APPEALS 10 Application of George -. Ideman for change of zone . The Board of Zoning Appeals considered the application of George Ideman for a change in use from a residential use to a commercial use of approximately six acres of land adjacent to his present commercial property . The board has no objection to the proposed change in use . It . is of the opinion however , that a change in use of so small an area in this vicinity where there are several tracts of undeveloped land would be spot zoning . Furthermore , the New York State Artificial Breeder ' s Co - op Inc . and the Ide ' s Drome and Bowling Lanes are in a residential zone although . used commercially under the non- conforming use provision of the zoning ordinance . Under these circum- stances a change of the area in question to commercial use would appear to be spot zoning . The Board support the change however , if it is part of the over- all plan for this area . 2 . Application of Knight Paving Products for change in use . The Knight Paving Products has applied for a change in zone from residential to industrial of the land which it is using as a base for its street paving operation . The Board does not approve of the proposed change because the property . in question is bounded on three sides by resi - dences and the owner of the remaining neighboring property has indicated that it would be residentially developed . The Board is of the opinion that the present law permits the Knight Paving Products to continue to operate and that no hardship will result to it if this change is not made . 3 . Application of Leonard Leberman for annexation . The Board of Zoning Appeals opposes. the proposed annexation of Leonard Leberman ' s tract of land along the East Shore Drive . Although no map showing the proposed annexation was presented to the board , it appeared that under Mr . Leberman ' s plan unconnected " islands " ( McKinney ' s Point , Tri - State Egg and Poultry , Renwick Heights ) would be left in the town . The board concluded that such an arrangement would not be feasible or desirable . Finally , no reasons in support of the annexation were presented to the board . The above report was adopted by the Board of Zoning Appeals at a meeting held February 27 , 1958 in the Town Barn . Members present were William Rolston , Constance E . Cook , Robert Powers , David Powers . Action taken by the board was unanimous , except , that Mrs . Cook disqualified . herself from consideration of the application of Knight Paving Products upon the grounds that she is an owner of property in the neighboring area .
