Minutes of Meeting
of
Zoning Board of Appeals of the Town of Ithaca
October 14 , 1957 .

The meeting of the Zoning Board of Appeals of the Town
of Ithaca was held on October 14 , 1957 at 5 : 15 in the town
barn as advertised in the Ithaca Journal on October 7 , 1957 .
The members present were : William Rolston , Chairman ; Robert
Powers ; Aldus Fogelsanger ; David Powers ; and Constance E .
Cook , Secretary . Others present were : Ben Boynton , Town
Zoning Officers Michael LoPinto , attorney for applicant ;
Stanford Fertig ; Alfred Eiper ; Warner Paley ; H . Mara ; A . F .
Sheif ; C . S . Pearson ; Helen Dunn , G . B . Rawls; and Bernard
Quick , applicant .
The chairman called the meeting to order and stated
that the purpose of the meeting was to consider the petition
of Bernard H . Quick , 1564 Slaterville Road , for a . variance
of Section 4 of the Zoning Ordinance . The application for
a permit had been denied because it required the . extension
of a non- conforming use in a residential district and be -
cause Section 37 , Paragraph 2 of the ordinance requires that
a place for the boarding of animals must be set back 100 feet
from a residential district .
Mr . Quick has 19 acres with approximately 1200 feet
frontage on the Slaterville Road . He started raining mink
in 1947 with 18 mink . In October 1954 , he had approximately .
1300 mink and now has 1500 . He needs new cages for 240
mink ( this year ' s increase ) His mink are too crowded
at the present time . The mink need one cage per adult which
will give them better sanitary and more humane conditions .
Mr . Quick showed the board a mink which had been maimed by
another mink in the same cage .
Mr . - Warner Paley , a mink raiser , supported Mr . Quick ' s
application . He ' stated that new cages could be cleaned easier
and would help minimize the odor problem .

The following neighbors stated objections ,
Mr . Fertig stated that the number of mink was not the
problem but that the odor and health were the big problems .
More cages would not improve either .
Mr . Eiper stated that the rats and ordor were the worst
consideration . Even mink may come over from the farm .
Mr . Mara � . stated that he lives opposite the farm and
the smell is very objectionable . He bought the farm in
March 1957 and would - no.t have done so if he had known how
bad the smell was in the summer .
Mrs . Fertig lives across the road from the applicant . .
She objected to the flies in the summer .
Mr . Sheif lives across the street . They knew the
neighbors did not like the . mink farm , but out of considera-
tion for Mr .. Quick , did not object previously but he did
object to any expansion . The flies are particularly
objectionable .
Mr . Pearson stated that he lived one quarter of %_: a
mile away and that the smell was getting worse every
summer .
Mrs . Dunn has lived for years in the . present neigh-
borhood . She . stated that the smell has gooten worse every
- summer as well as the flies .
Mrs . Sheif stated that the smell was bad but the real
problem was the flies .
Mr . Rawls lives one ' half mile away . This last sum-
mer , the smell was very noticeable . If Mr . Quick is allowed
to expand , the value of . all property in the neighborhood
will be lowered .
The board took no action - upon the .application but
directed the zoning officer to write to Dr . . Broad , the
County Health Officer , requesting his opinion as to whether
or not the additional cages . would " promote health " within°
the meaning of the provision of the zoning ordinance . .
The board briefly discussed the proposed change of zoning
in the Five Mile Drive -Elmira Road . area from residential to
light industrial use . No action was taken .
There being no other business , the meeting adjourned .
