Paul Darsie - Applicant The meeting of . the Zoning Board of Appeals of the Town of Ithaca was held on March 29 , 1957 at 11 : 00 A . M . at the town barn as advertised in the Ithaca Journal on March 25 and 26 , 1957 . The members present were : William Roston ; Robert Powers ; David Powers ; and Aldus Fogelsanger . Others present were Dr . Paul Darsie ; John Peters ; Mr . Faltman ; Mrs . Corson ; Robert Steel ; D . F . Holcomb ; and N . W . Rollins . The meeting was called to order by Mr . Fogelsanger to consider the application of Dr . Paul Darsie for permission to place a building nearer the road than other houses in the area . The following testimony was heard : Dr . Darsie : - The denial of the appeal would result in unnecessary hardship because he would have to relocate excavation and drain a spring ; he would have a sloping driveway ; he plans to start work immediately ; he made the excavation six months ago and there were no complaints from the neighbors until March 20th ; and the view is not as good if he has to move his house back from the road . Mr . Faltman : - The .location of road right of way was not well known . If Darsie builds too close to the road and the road is later widened , all the road expansion will come from the Faltman property . Mrs . Corson : - The neighborhood is uniformly set back 40 feet except Corson which was built before the zoning ordinance . There is no formal agreement about the 40 foot setback . It has turned out to be observed by the entire neighborhood . Mr . Steel : — Mentioned the location of the drainage ditch . He asked what sort of precedence will this set for other lots ; . e . g . lots 12 , 13 , and 14 which are 200 feet . 40 - wide and can be split to 100 feet wide ? All these houses would interfere with Steel view . Mrs . Corson : - wanted the zoning to be enforced . Mr . Rollins - feels that the zoning ordinance should be kept as much as possible . Mr . Holcomb . - thinks that the zoning ordinance should be kept , especially in this district . After further discussion and viewing the premises the board unanimously denied the appeal for . the following reasons . 1 . Cars. coming down hill might get out of con- trol on the sloping turn- and collide with the car . port . or house which is close to the road . 2 . The .._ _violation consists only in failure to set back forty fget %(.40 ) to ; conform ::_ wIth the � neighborhood , - e Board concluded that there would be not . much expense ( even with the present development work in the foundation ) in moving the house back forty .( 40 .) feet from the right of way . This would let the , carport be closer to the road than forty ( 40 ) feet but this may not be a variance if the carport is considered an accessory building .
