Zoning Board of Appeals of Town of Ithaca

The meeting of the Zoning Board of Appeals of the Town of Ithaca
was held on December 8 , 1956 at 11 : 00 A . M. in the town barn as
advertised in the Ithaca Journal on December 3 and 4 , 1956 . The members
present were : William Rolston, chairman ; David Powers ; and Constance
E . Cook, secretary. Others present were : Ben Boynton, town zoning officer ;
and Sidney Rocker , applicant .
The meeting was called to order by Mr . Rolston to consider the appeal
of Mr . Rocker to extend Sunnyside Restaurant in variance with Section 12
of the town zoning ordinance which requires a side yard 10 feet in width .
The corner of the addition will be 4 feet over the required distance if ,
constructed as planned .
After hearing testimony and after discussion , the board upon motion
duly made and seconded, unanimously adopted the following resolution
WHEREAS, additional space is necessary to accomodate applicant ' s
customers efficiently ; the kitchen is on the other side ; remodelling by
extending in the other direction would cost $ 30 , 000 ; this addition will
cost $ 6 , 000 ; the restaurant will be able to seat 175 instead of 135 ; there
is plenty of . access for fire vehicles ; and
WHEREAS, no objections have been expressed to the board, and there
are practical difficulties and an unnecessary hardship in carrying out
the strict letter of Section '12 of the zoning ordinance and
WHEREAS, the variance applied for is in general accord with the spirit
of the ordinance , the public safety and welfare will be served and
substantial justice will be done if said variance is granted , and
consideration having been given to the promotion of the health , safety,
morals and general welfare , of the community, be it
RESOLVED, that the variance applied for be and is hereby granted and
an order to said effect shall be enteres in the office of the town clerk .
There being no other, business , the meeting was adjourned .
