The meeting of the Zoning Board of Appeals of the Town of Ithaca was held on June 2, . 1956 .at l'1 : 00 A . M. at the town barn as advertised in the Ithaca Journal on May 23 , 24 , 29 and 31 , 1956 • The members present were : David F . Powers ; Thomas Smith; William Rolston , temporary chairman; Aldus Fogelsanger.; Constance E . Cook, secretary . Others present were Ben Boynton; town zoning officer and Harry Gordon, town supervisor . The meeting was called to order by Mr . Rolston, temporary chairman . Mr . Thomas Smith was elected chairman . Mr . Ben Boynton was introduced as the new town zoning officer . The application of Mrs . Gertrude Cowley of 893 Taughannock Blvd . was considered She wishes permission to build a carport within three feet of her side lot line . It would be within eight ( 8 ) feet of a neighbors - garage .( not house ) . - The proposed --building would . be in violation of Article 3 ; Section 7 of the zoning ordinance . After hearing testimony.- and - after discussion, the board, upon motion duly made and seconded. ; unanimously adopted the following resolution : WHEREAS , the neighboring houses are jumbled as most were built prior to any zoning restrictions ; safety factor would be improved since the off- street parting would be provided ; and no fire hazards are involved , and WHEREAS , no objections have been expressed to the board , and there are practical difficulties and an unnecessary hardship in carrying out 24 strict letter of Article 3 , Section 7 of the zoning ordinance and WHEREAS, the variance applied for is in general accord with the spirit of the ordinance , the public safety and welfare will be served and substantial justice will be done , if said variance is granted , and consideration having been given to the promotion of the health , safety , morals and general welfare of the community, be it RESOLVED, that the variance applied for be and is hereby granted and an order to said effect shall be . entered in the office of the town clerk . The board then considered the application of C . B . Jennings of R . D : ,# 2 , Groton, New York for a variation of Section 9 with respect to 208 Muriel Street . After hearing the applicant and after discussion the board, upon motion duly made and seconded , unanimously adopted the following resolution : WHEREAS , applicant wishes to construct a dwelling on a 99 foot lot instead of the required 100 foot . The difference is not signigicant ; there are ample side yards ; the lot . is in a subdivision which was laid out prior to the enactment of the ordinance ; compliance would require the replotting of several lots and would result in a financial hardship to applicant ; and sewer and water will be installed soon and then lot requirements will be reduced to 80 feet ; and WHEREEAS, no objections have been expressed to the board , and there are practical difficulties and an unnecessary hardship in carrying out the strict 'letter of -Section '9 of the zoning ordinance and WHEREAS , the variance applied for is in general accord with the spirit of the ordinance , the public safety and welfare will be served aid substantial justice will be done if said variance is granted , and consideration having been given to the promotion, safety, morals and 25 general welfare of the community, be it RESOLVED, that the variance applied for be and is hereby granted and an order to said effect shall be entered in - the office of the town clerk .
