HomeMy WebLinkAboutZBA Minutes 1955-03-12 The meeting of the Zoning Board of Appeals of the Town of Ithaca was held on -March 12,- 1955 at 11 : 15 A . M. at the town barn. Public notice of the meeting was printed in The Ithaca Journal on March 5 and 71 1955 . The members present were : Elmer Phillips , chairman ; Aldus Fogelsanger , William Rolston and Constance K . Eberhardt , secretary . Other persons present were : Harry Gordon, town zoning officer ; ; : ::. ' Elmer H . Stickler and Elmer K . Stickler who appeared for the applicant . The chairman called the meeting to order and stated that the purpose of the meeting was to consider the petition of Eldred E . Hoyt for a variance in the front yard requirements , Section 12 of the zoning ordinance , with respedt to premises of the applicant on the Elmira Road . Mr . Hoyt wishes to build an addition to his luncheonette and to move the entire . building back 122 feet . After hearing Messers Stickler and after discussion the board unanimously adopted the following resolution : WHEREAS, the existing building is on the line of the highway right of way and it would be an improvement to move it back where it would line up with existing buildings ; and it appears that the building cannot be moved farther back because there is a ditch in the rear and a trailer camp which needs access ; it would be impractical to fill the creek and move fixed trailers as such a move might create a septic tank problem; and the structure is in the nature of a temporaty building with only $ 3 , 000000 being put into it ; , and WHEREAS, no objections have been expressed to the board and in view of the above stated facts there are practical difficulties and an unnecessary hardship in carrying out the strict letter of Section 12 of the Zoning . Ordinance , and WHEREAS, the variance applied for is in general accord with the spirit of the ordinance and the public-will, safety and welfare be _nserved and substantial justice will be done if said variance is granted , be it RESOLVED , that the variance applied for be and is hereby granted and an order to said effect shall be entered in the office of the town clerk .
