HomeMy WebLinkAboutZBA Minutes 1954-12-18 The meeting of the Zoning Board of Appeals of the Town of Ithaca - was held on December 18 , 1954 at 11 : 15 . A . M. at the town barn . The members present were ; Elmer Phillips, Chairman, William Rolston, Thomas Smith, Aldus Fogelsanger and- Constance K . Eberhardt , Secretary . Other persons present were : Allan Treman, Esq . , attorney for the applicant ; Harry Gordon, town zoning officer and Edgar D . Townsley, architect . The chairman called the meeting to order and stated that the purpose of the meeting was to consider the petition of the Ithaca Valley Real Estate Corporation for a variance in the front yard requirements with respect to premises of the applicant at 212- 220 Elmira Road . Section 12 of the zoning ordinance requires a twenty-five ( 25) foot front yard . After hearing testimony of the attorney and architect of applicant the board unanimously . adopted the following resolution : WHEREAS, compliance would involve placing the budding back nine ( 9) feet and would result in the loss of one row of parking spaces ; and an entrance at other side would not be as convenient and as safe for patrons ; and several existing buildings in the area extend further towards the highway; and the building can not be placed nearer the rear lot lines because of a drainage ditch and soft ground ; and the non-conformance is only a few feet ; and WHEREAS, no objections have been expressed to the board and in view of the above stated facts there are practical difficulties and an unnecessary hardship in carrying out the strict letter of Section 12 of the Zoning - Ordinance ., and WHEREAS, the variance applied for is in general accord with the spirit 6 of the ordinance and the public will , safety and welfare be served and substantial justice will be done if said variance is granted , be it RESOLVED , that the variance applied for be and is hereby granted " and an order to said effect shall be entered in the office of the town clerk , There being no further business the meeting adjourned . _.
