HomeMy WebLinkAboutI - 11a County Resolution - CMA Aquifer ON THE MOTION OF Paul Slowey Dan Haynes RESOLUTION NO. 21-38 GML# 96.05-01-19.000 Town of Cortlandville Conditional Permit & Aquifer Protection District Special Permit Ramco Development & Holdings, LLC WHEREAS, on September 23, 2021 the Zoning Officer, Town of Cortlandville, pursuant to General Municipal Law 239 M submitted an application for conditional permit & aquifer protection district special permit because the property is located within 500 feet NYS Route 13, AND WHEREAS, the Cortland County Planning Department has reviewed this request and submitted a written report dated October 15, 2021, which is on file, AND WHEREAS, the Cortland County Planning Board on October 20, 2021, held a regular meeting with a quorum and did consider this request, AND WHEREAS, the Cortland County Planning Board did thoroughly consider the material submitted by the petitioner, Department comments and all other relevant reports on file, NOW THEREFORE BE IT RESOLVED, that the Board recommends approval of this application for conditional permit & aquifer protection district special permit for the purpose of demolishing an existing building and site features to allow the construction of a +/- 21,200 SF (plus +/-8,500 SF future addition) Cayuga Medical Associates medical facility. The approval of this application is contingent upon the following: 1.that the Town determine if the proposed architectural style is compatible in character with both nearby developments and the future mixed-use area identified in the Future Land Use Map in the Town’s proposed Comprehensive Plan. 2.that the submitted plans be covered under the Construction General Permit (GP-0-20-001). 3.that the rock spillway indicates as discharging from the infiltration basin. 4.that documentation acknowledges both NYSDEC stormwater regulations and the Town of Cortlandville stormwater ordinance. 5. that native plant species be used to the maximum extent practicable on the proposed site. 6. that pedestrian access be provided via a sidewalk along NYS Route 13 for the entire length of the parcel. 7. compliance with SEQR requirements., AND BE IT FURTHER RESOLVED, that the Board reminds the Town of Cortlandville the requirements of General Municipal Law Section 239 M that a supermajority vote is to be attained by the Town in order to approve this application unless every contingency documented in this resolution is followed, AND BE IT FURTHER RESOLVED, that the Planning Department is hereby authorized to convey this action to the Zoning Officer, Town of Cortlandville. _______________________________ Wendy Miller, Secretary Cortland County Planning Board October 20, 2021 Ayes: 8 (Members Swisher, Bertini, Miller, Feiszli, Harbin, Slowey, Haynes, & Hans) Nays: 0 Abst.: 1 (Member Comfort)
