The proposal involves subdividing the property into a 1.76 +/- acre parcel, containing the existing residence at 424 Bostwick Road, and an 11.76 +/- acre parcel which will be consolidated with Tax Parcel No. 32-1-15. AGENDA ITEM Persons to be heard - No one came forward to address the Board. AGENDA ITEM SEQR determination: Irish 2-Lot Subdivision, 424 Bostwick Road PB Resolution No. 2013-036: SEAR, Preliminary and Final Subdivision Approval, Irish 2-Lot Subdivision, 424 Bostwick Road, Tax Parcel No. 32-1-17.21 Moved by John Beach; seconded by Yvonne Fogarty WHEREAS: 1. This is consideration of Preliminary and Final Subdivision Approval for the proposed 24ot subdi- vision of 424 Bostwick Road, Town of Ithaca Tax Parcel No. 32-1-17.21,Agriculture Zone. The proposal involves subdividing the property into a 1.76 +/- acre parcel, containing the existing res- idence at 424 Bostwick Road, and an 11.76 +/- acre parcel which will be consolidated with Tax Parcel No. 324-15. David C. Irish, Owner/Applicant, and 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is acting as lead agency with respect to Subdivision Approval, and 3. The Planning Board on September 3, 2013, has reviewed and accepted as adequate a Short Envi- ronmental Assessment Form Part I, submitted by the applicant, and Part II prepared by the Town Planning staff, a survey map entitled "Subdivion [sic] Plat - Hermon &Simon Property - 424 Bostwick Road" prepared by Lawrence P. Fabbroni, LLS, dated 08-27-04 and revised 06-27-13, and other application materials, and 4. Town planning staff has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval; Planning Board Minutes 09-03-2013 Page 2 of 4 NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and, therefore, an Environmental Impact Statement will not be required. David C. Irish, Owner/Applicant. Mr.Wilcox opened the public hearing at 7.05 p.m. Ms. Fogarty asked what will happen to the pond because it's on both the properties. Mr. Irish responded that it will be done away with. It was dug very shallow. It has water when it rains and none when it doesn't. It will be filled back in because he considers it a hazard. That's part of the understanding with the new owners. Mr. Bosak asked if he was planning to turn the wood lot back to agricultural use. Mr. Irish said that he believes the Bakers plan to keep everything as is. They're purchasing the back portion to adjoin to their property. He said he can't speak to what their uses will be, but the woods are pretty rough, so he assumes the Bakers will keep them the way they are. They lease the land right now. Mr.Wilcox noted that one of the neighbors shown on the subdivision plat,Janine McFall, is his cousin. Mr. Wilcox closed the public hearing at 7:08 p.m. PB Resolution No. 2013-037: Preliminary and Final Subdivision Approval, Irish 2-Lot Subdivision, 424 Bostwick Road, Tax Parcel No. 32-1.17.21 Moved by Hollis Erb; seconded by Joseph Haefeli WHEREAS: 1. This is consideration of Preliminary and Final Subdivision Approval for the proposed 24ot subdi- vision of 424 Bostwick Road, Town of Ithaca Tax Parcel No. 32-1-17.21,Agriculture Zone. This is an Unlisted Action for which the Town of Ithaca Planning Board, acting as lead agency with respect to Subdivision Approval, has on September 3, 2013, made a negative determination of environmental significance, after having reviewed and accepted as adequate a Short Environ- mental Assessment Form Part I, submitted by the applicant, and Part II prepared by the Town Planning staff, and 3. The Planning Board on September 3, 2013, has reviewed and accepted as adequate a survey map entitled "Subdivion [sic] Plat - Hermon &Simon Property- 424 Bostwick Road" prepared by Lawrence P. Fabbroni, LLS, dated 08-27-04 and revised 06-27-13, and other application materials; NOW THEREFORE BE IT RESOLVED: 1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and Final Subdivision Approval, as shown on the Preliminary and Final Subdivision Checklists, hav- ing determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of site plan control nor the policies enunciated or implied by the Town Board, and 2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the proposed 2-lot subdivision located at 424 Bostwick Road, as shown on the survey map entitled "Subdivion [sic] Plat - Hermon&Simon Property - 424 Bostwick Road", subject to the following conditions: a. revision of the final subdivision plat to update the current ownership of 424 Bostwick Road, and to correct the spelling of"Subdivision" in the title, and b. submission for signing by the Chairperson of the Planning Board of an original and three dark lined prints of the final subdivision plat, revised as described in condition "a" above, prior to filing with the Tompkins County Clerk's Office, and submission of a receipt of filling to the Town of Ithaca Planning Department, and c. within six months of this approval, consolidation of the 11.76 +/- acre parcel(Parcel "B")with Tax Parcel No. 32-1-15, and submission of a copy of the consolidation request to the Town of Ithaca Planning Department.
