PUBLIC HEARING: Consideration of Preliminary and Final Subdivision Approval for the proposed lot line modifications located at 651 and 655 Five Mile Drive, Town of Ithaca Tax Parcel No.'s 31-2-24, 31-2-25.2 and 31-2-25.3, Low Density Residential Zone. The proposal involves moving several of the lot lines to create a 0.820 +/- acre lot containing the existing house at 655 Five Mile Drive (Tax Map No. 31-2-24), a 0.683 +/- acre lot containing the existing house at 651 Five Mile Drive (Tax Map No. 31-2-25.2), and a 3.757 +/- acre lot containing the existing cell tower (Tax Map No. 31-2-25.3). AGENDA ITEM SEQR Determination: Carroll Lot Line Modifications, 651 and 655 Five Mile Drive PB Resolution No. 2013.030: SEAR, Preliminary and Final Subdivision Approval, Carroll Lot- Line Modifications, 651 &655 Five Mile Drive, Tax Parcel No.'s 31.2.24, 31.-2-25.2, 31.2-25.3 Moved by John Beach; seconded by Jon Bosak WHEREAS: 1. This is consideration of Preliminary and Final Subdivision Approval for the proposed modifica- tions to the lot-lines located at 651 and 655 Five Mile Drive, Town of Ithaca Tax Parcel No.'s 31.- 2-24, 31-2-25.2, and 31.-2-25.3, Low Density Residential Zone. The proposal involves moving sev- eral of the lot lines to create a 0.820+/. acre lot containing the existing home at 655 Five Mile Drive (Tax Map No. 31.-2-24), a 0.683+/-acre lot containing the existing home at 651 Five Mile Drive (Tax Map No. 31.-2,25.2), and a 3.757+/-acre lot containing the existing Verizon cell tower (Tax Map No. 31:2-25.3). This proposal is not creating any new lots. Donn Carroll, Own- er/Applicant, and 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is acting as lead agency with respect to Subdivision Approval, and 3. The Planning Board on August 6, 2013, has reviewed and accepted as adequate a Short Environ- mental Assessment Form Part I, submitted by the applicant, and Part II prepared by the Town Planning staff, a survey map entitled "Survey Map Showing Lands of Donn K. Carroll, Located on No. 651 &No. 655 Five Mile Drive, Town of Ithaca, Tompkins County, New York" prepared by T. G. Miller P.C., dated 1/16/2013, revised 6/27/2013, and other application materials, and Planning Board Minutes 08-06-2013 Page 2 of 4 4. Town planning staff has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval; NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and, therefore, an Environmental Impact Statement will not be required. Carroll, Owner/Applicant Mr.Wilcox opened the public hearing at 7:07 p.m. Ms. Brock pointed out that Mr. Carroll had received variances for frontage and setbacks. Board members discussed the memo from Mr. Bates regarding a proposed 20-foot-wide easement on Parcel A for use by Parcel B. Ms. Balestra said he was concerned that the easement might cause dis- putes in the future over a shared driveway. He was trying to think of every scenario. Ms. Brock said that if it became an issue, the Parcel B owner could just use their own access to Five Mile Drive. The memo suggested including the 20-foot strip in Parcel B's boundaries. Mr. Carroll said it would be an advantage to him to have access to the loop driveway, so he would be fine with that option.The modification was ultimately rejected because it might have negatively impacted the dimensional re- quirements of Parcel A, and Mr. Carroll was not in favor of applying for any more variances. Carroll, Located on No. 651 &No. 655 Five Mile Drive, Town of Ithaca, Tompkins County, New York", subject to the following conditions: a. Submission of a revised tree preservation and fall zone easement among Donn K. Carroll, Upstate Cellular Network and the Town of Ithaca, for review and approval of the Attorney for the Town, delineating the "No Cut Area," with references to the new parcels and property lines, and submission to the Town of Ithaca Planning Department of the filing receipt from the Tompkins County Clerk's Office for the filing of the approved easement, and b. Revision of the final subdivision plat to (1) specifically reference the revised tree preservation and fall zone easement described in condition "a" above and (2) delete the "shed" that is shown on Parcel B, and c. Submission for signing by the Chairperson of the Planning Board of an original and three dark-lined prints of the final subdivision plat, revised as described in condition "b" above, prior to filing with the Tompkins County Clerk's Office, and submission to the Town of Ithaca Planning Department of the filing receipt from the Tompkins County Clerk's Office for the filing of the approved easement.
