Mr. Wilcox opened the public hearing at 7:05 p.m. Mark Macera and David Schlosser, architect, were present. Mr. Wilcox thanked Mr. Schlosser for putting together the summary. Ms. Erb said that she loves the project and pointed out some internal inconsistencies on the draw- ings. The following items were corrected and /or clarified:  Color-scheme: The Board likes variation. Ms. Erb pointed out that what’s on A-20 is not con- sistent with the coloring on A-21 because A-20 calls for the front door to match the trim color, whereas the drawing that follows shows a contrasting door, which she likes better.  Landscaping: Ms. Erb appreciates that they’re trying hard to preserve the large trees. She ques- tioned the location of some of the trees on the drawing. Mr. Schlosser responded that the survey- ing of the area isn’t complete because of the dense foliage, so the trees may not be accurately lo- cated on the drawings. He went on to say that if necessary, they would be willing to run a sidewalk around a tree to preserve it.  Rain gardens: Drawing D1 indicates that the smaller rain gardens should be 200 square feet and the larger ones 400. In the other documents, the small gardens are 150 square feet and the larger ones 300. Dan Thaete responded that the sizes changed once the perk testing was done. He’s comfortable with the smaller numbers; the SWPPP was done on those numbers and is adequate. D1 will be updated to match those numbers. Mr. Wilcox opened the public hearing at 7:50 p.m. Mr. LiVigne thanked the Planning Board and Planning Staff for the good comments that made it a better project. Since the last meeting, they have obtained the zoning change to allow the tower. Mr. Wilcox asked about the plan to take the water tank down. Mr. LiVigne said that the Town want- ed the tank down by December 31, 2012, but Cornell will seek an extension to that agreement. They would like to take the tank down in February when the ground is as frozen as can be. Mr. Wilcox commented that the plan is to build the replacement tower and facilities between now and the end of the year, then take the tank down. Ms. Erb would like the condition from the preliminary approval added back in that states that the tower will be down within 90 days after it ceases to perform its originally intended functions. Joel Harlan spoke in favor of the project. LiVigne, Director, Cornell Real Estate, Agent; and 2.This is an Unlisted Action for which the Town of Ithaca Planning Board, acting in an uncoordi- nated environmental review on October 4, 2011, made a negative determination of environmen- Planning Board 05-15-2012 Page 5 of 8 tal significance, after having reviewed and accepted as adequate a Full Environmental Assessment Form Part I, submitted and prepared by the applicant, and Part II and Visual Addendum pre- pared by staff; and 3.The Planning Board, at a Public Hearing held on October 4, 2011, granted Preliminary Site Plan Approval and Special Permit for the project; and 4.The Town of Ithaca Zoning Board of Appeals, on October 24, 2011, granted a height variance for the proposed tower; and 5.The Planning Board, at a Public Hearing held on May 15, 2012, reviewed and accepted as ade- quate a narrative, dated April 10, 2012; site plan drawings entitled “Cornell Monopole (Dryden Road),” prepared by Costitch Engineering, including sheets CA100, CA110, CA111, CA500, and CR110, all dated 9/01/2011; sheet CA130, titled “Grading & Erosion Control Plan,” dated 3/29/2012; sheet CA501, titled “Erosion Control Details & Notes,” dated 3/29/2012; and sheet LI120, titled “Lighting Exhibit,” dated 4/5/2012; and other application materials; NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby grants Final Site Plan Approval for the construction of the proposed Cornell University Monopole, the co-location of antennas for the Verizon Wireless, AT&T Mobility, and T-Mobile telecommunications companies, the placement of related telecommu- nications facilities, and the co-location of the 10-foot whip antenna, located at 798 Dryden Road/NYS Route 366, Town of Ithaca Tax Parcel No. 65-1-5.2, as shown on the above-referenced plans and materials, subject to the following conditions: a.Submission of a completed Town of Ithaca Simple Erosion and Sedimentation Control appli- cation form to the Town of Ithaca Public Works Department, for review and approval prior to the application for any building permit; and b.Submission, as part of the building permit application, of final detailed tower design and foundation plans, signed and sealed by a licensed engineer, for review and approval of the Di- rector of Code Enforcement; and c.Submission of record of application for and proof of receipt of all necessary permits from county, state, and/or federal agencies, prior to the issuance of any certificates of occupancy; and d.The monopole shall be constructed of galvanized steel; and e.The emergency generators shall be tested only between the hours of 9 a.m. and 5 p.m. Mon- days through Fridays, and no testing shall occur on Federal holidays; and f.If the telecommunications facilities become technologically obsolete or cease to perform their originally intended function for more than 12 consecutive months, they shall be removed within 90 days. Upon removal of said facilities, the land shall be restored to its previous con- dition, including but not limited to the seeding of exposed soils; and g.Prior to the issuance of any building permits, submission of a financial security bond for the removal of the telecommunications facilities and property restoration, with the Town of Itha- ca as the assignee and subject to the approval of the Attorney for the Town, in the amount of $50,000; and Planning Board 05-15-2012 Page 6 of 8 h.The placement of any microwave dishes on the tower is not allowed without a site plan modi- fication by the Town of Ithaca Planning Board. Vote: Ayes – Wilcox, Collins, Conneman, Beach, Bosak, VanderMaas, Erb AGENDA ITEM Discussion of requested changes to the Declaration of Covenants and Restrictions, dated 1992, to allow Hospicare and Palliative Care Services of Tompkins County to expand their facilities. Hospica- re is located at 172 King Road East, Town of Ithaca Tax Parcel No. 44.2-1-2, in the Low Density Res- idential Zone. Mark Wheeler, board member of Hospicare and chairman of the property committee, David Klein, architect, and Dale Johnson, executive director of Hospicare, were present. Mr. Wheeler stated that when the facility was built, it was situated on a piece of land that was subdivided in 1992. It is a large parcel (11.6 acres) with a pond. On the subdivision map, there’s a notation that anything from the middle of the pond and back to the southeast line of the property is marked restricted; no buildings shall be allowed on this portion of the plot. When the approval was obtained to build the existing facility, there was a requirement that a declaration of covenants and restrictions be adopted by the owner. Those restrictions included the no-build zone in the rear of the property and also allowed for a build area for a 7000-foot structure in the front of the lot near King Road East. The restrictions also included a blanket prohibition against any amendment to the restrictions without approval of both the Town Board and Planning Board. One of the restrictions that related to the original site plan stated that “except for the above improvements, the remainder of the above-described parcel shall remain as open space, where no construction activity shall occur.” This means that anything – with the exception of the current building – requires approval of the two boards. They went before the Town Board and got the sense that they would endorse the project if it had viability and was met with approval by the Planning Board. The project will entail moving the patient residence into a new building, converting the existing facility to administrative space, and planning for a future incremen- tal increase in patient residents from six to eight. The additions are proposed to the east of the cur- rent facility. Mr. Wilcox commented that the area behind the pond is very sensitive. The area of the existing build- ing seems appropriate for an addition. Ms. Erb said she didn’t understand any particular limits other than buffering the pond on the south side and to the east near the trail. Mr. Wheeler said that the addition would be further from the pond than the existing structure. Ms. Erb asked if there is a Chase Farm resident trail to that area. Mr. Wheeler pointed it out on the map and said it is well used. Mr. Wilcox thinks it’s an official Town trail. Mr. Wheeler pointed out that the preliminary sketch shows a 4000-square-foot addition, which was drawn when they were seeking a six-resident addition, but their focus now is for an eight-resident ad- dition, because the state-approval guidelines are the same for both, and if it were approved for eight, they would have future capacity. That increases the footprint to 4800 square feet. Mr. Bosak stated that what ended up in the covenant is not what the Board wanted; what they wanted is that Hospicare not build in the sensitive area. Planning Board 05-15-2012 Page 7 of 8 As a resident of the area, Mr. Wilcox pointed out that most people don’t know Hospicare is there. They’re generally good neighbors except on occasion when people park along the road. Ms. Collins wondered whether there will be more parking. Mr. Klein responded that they’re considering envi- ronmentally sensitive expansion of the parking facilities. Ms. Collins stated that she is very supportive of the project and wondered what will happen to the garden area the addition will displace. Mr. Johnson said he expects they will redesign the garden space to the southeast. They have a full-time gardener and will make sure all the plantings are preserved in some respect on the property. Mr. Klein stated that they haven’t resurveyed the property yet. This is very conceptual because the Hospicare board didn’t want to proceed with too much detail until they had a sense of the Town’s direction. Ms. Collins stated that she knows there are human remains (ash- es) buried in the garden. Mr. Johnson said it was reported to him by a reliable source. Mr. Wheeler encouraged members of the Planning Board to visit the site, saying that the culture of this site is the gardens. It’s possible to look out the window during board meetings and see the wildlife. It’s a re- markable site.
