Call to Order Mr. Wilcox called the meeting to order at 7:02 p.m. and accepted the secretary’s posting of the public hearing notices. He introduced Eric VanderMaas, the new Planning Board member. AGENDA ITEM Persons to be heard – No one came forward to address the Board. AGENDA ITEM PUBLIC HEARING : Consideration of a recommendation to the Town of Ithaca Town Board re- garding proposed changes to the Official Map of the Town of Ithaca. Mr. Wilcox opened the public hearing at 7:05 p.m. Jim Weber, Town of Ithaca Highway Superintendent, stated that the Town is required by New York State law to keep an official Town map on file that shows all streets that have been developed to a life, safety, and welfare standard and adopted through the Town process. There are changes to the map that was adopted in 2010. He apologized for the small nature of the map in the packet. The full-sized version is posted in the board room. The major change since the 2010 version is based on Bruce Bates finding some of the original development approvals for the trailer park on Seven Mile Drive, and discovering that the roads within the park were built to standards identified through the plan- ning process. Ithaca Beer Drive has also come up to standard. There were street name changes off Game Farm Road that were done for the building permit process. He brought attention to the letter from Bruce Brittain relative to the map. There seemed to be some confusion between the official Town map and highway or street maps. The official Town map does not necessarily show every road or private driveway within the Town limits. Those private roads were not built to a safety standard or developed as part of any development process. They may not meet accessibility or structural stability standards or provide for fire safety and emergency services use. He went through Mr. Brittain’s list and gave reasons why certain roads were or were not on the map. One of the roads – a loop road at the Cornell golf course – can be removed from the map because it serves as an internal driveway. Game Farm Road is not shown correctly on the map: it is supposed to extend all the way to Ellis Hol- low Road and is a County road, so that will be corrected. Private subdivision roads mentioned are mostly private driveways that service one or two lots and are not built to Town standards. Walnut Street in the new Belle Sherman Cottages subdivision was not done on time to go in front of the Town Board. Mr. Bosak commented on the need for vector renderings of maps. He stated that he had complained at the meeting two weeks ago. It is not acceptable to not have these. If he had one, he could have Planning Board Minutes 05-01-2012 Page 2 of 8 been following the discussion on his laptop, and zooming in to see the details of what was being talked about. This capability exists. The Board agreed that the Cornell loop road should be removed from the map. It will be added as a condition to the resolution. To a question by Mr. Bosak, Mr. Weber explained that the amount of information that could be shown on the map, like drainage systems, would be overwhelming and make it too cluttered. The intent they’re trying to achieve is the ability to issue building permits. Mr. Wilcox closed the public hearing at 7:20 p.m. PB Resolution No. 2012-021: Recommendation to Town Board Regarding Proposed Modifications to Official Map Moved by Hollis Erb; seconded by John Beach WHEREAS , Section 270 of NYS Town Law authorizes the Town Board to establish an official map of that part of the town outside the limits of any incorporated city or village showing the streets, highways and parks theretofore laid out, and may also show drainage systems; and WHEREAS , the current Official Map of the Town of Ithaca was last updated in 2010; and WHEREAS , Section 273 of NYS Town Law authorizes the Town Board to change or add to the offi- cial map of the town so as to lay out new streets, highways, drainage systems or parks, and any such change or addition to the Official Map must be referred to the Planning Board for a report thereon; and WHEREAS , the Director of Public Works has prepared a draft proposed revised Official Map with a creation date of May 10, 2010 updated on March 8, 2012; and WHEREAS , the Town Board discussed the draft revised Official map as described above at its regular meeting on April 9, 2012, and referred the proposed changes to the Official Map to the Planning Board for a report and recommendation; and WHEREAS , the Town of Ithaca Planning Board reviewed the draft Official Map, dated May 10, 2010 updated March 8, 2012, and held a public hearing on the draft Official Map at its meeting on May 1, 2012; NOW, THEREFORE, BE IT RESOLVED, that the Town of Ithaca Planning Board hereby recom- mends that the Town Board adopt the proposed revised Official Map with the changes shown on the May 10, 2010 updated on March 8, 2012 draft, and with the changes further identified by Highway Superintendent/Director of Public Works, James Weber, at the May 1, 2012 Planning Board meet- ing, plus the additional change of the elimination of the loop road serving the Cornell golf course pro shop and Moakley House. Mr. Wilcox opened the public hearing at 7:22 p.m. Warren Allmon said that he thinks that the document that Ms. Balestra and Ms. Ritter prepared is an excellent summary of the history of this issue, going back to the 75th anniversary in 2007 when they did a pilot project on this idea. The process from 2007 was so drawn out that even if they had money to put up banners, they would not have done so because it took three meetings and three months to get them approved. Back in 2010, they had a meeting to discuss the concept of a blanket variance: approve the style and position once, then within that variance, they would be able to change the con- tent. The two issues are size and number. Regarding size, they did a test in 2007 using four 12-foot banners, which were invisible at 55 mph. They don’t have a fixed concept of a certain size – it just needs to be a size that achieves the goal. Regarding number, he pointed out that the photo they sub- mitted that shows the campus also shows property that they don’t own. The number and size are both arbitrary, but they need to be big enough and frequent enough to announce to motorists driving 55 mph that they are in the presence of something. They don’t expect people to read fine print. They would like at least some of them in front of the Massage School complex. Mr. Bosak said he’s fine with both the size and location proposed because as a person who passes through there every time he gets in the car, he’d be happy seeing what’s been mocked up. Also, he goes to visit the museum when he goes to a major city. From the standpoint of other signs throughout the world, these are small signs. He thinks that anything less would not do the job. Mr. Allmon agreed and said that the other two formal museums in Ithaca that are not located in the Town have gigantic banners in front of them. Ms. Erb thinks that eight banners along the road is excessive. One on each side of their driveway to mark the entrance makes sense and another one in the lower property to give a heads up. She asked the Board what they will do the next time someone has enough road frontage that they can put up eight signs along the roadway. She would keep a banner that is not associated with another business’s driveway and also have one on each side of the correct driveway, all visible at 45 mph. Mr. Wilcox said that the idea is mostly to let people know that PRI exists and is in that location. He doesn’t think the banners are going to grab someone to come in the first time they drive by. If they’re vacationing in the area, they might decide to come back the next day and visit. Mr. Allmon responded that this might be so, with the exception that it’s a huge deal in July and August. He said it’s exactly as Mr. Bosak said. Think of walking on the National Mall and seeing a banner outside one of the muse- ums. It’s all about ambiance and creating a presence and a sense that there’s something special going on. To Ms. Erb’s point, he responded that they are competing in a market. When you drive past the Planning Board Minutes 05-01-2012 Page 4 of 8 Science Center, you’re a couple hundred feet off the road. It’s incredibly visible. PRI is 500 feet off the road and down a hill. They want to be that visible. Ms. Baer agrees with Mr. Bosak and Mr. Allmon. She’d be willing to reduce the number of banners, but not to three. Ms. Erb stated that part of the grab comes if the signs are changed periodically so people driving by will see that they’ve changed and that something new is going on. She thinks two or three would suf- fice. She’s worried about the precedent. Ms. Baer disagreed. Mr. Bosak voiced a problem with the idea that it will set a precedent. It’s saying that the Board should treat equally every large, distinguished, non-profit museum that happens to be in the Town. He would be happy to do the same for another museum in the Town. Ms. Brock commented that under Mr. Bosak’s logic, the regulation of signs matters who the applicant is – a museum as opposed to a beer company. That could run afoul of constitutional provisions about regulation of speech. Mr. Bosak asked what’s going on in a major city when they have vastly larger signs on museums than anywhere else. Ms. Brock responded that she is not familiar with their sign laws, and pointed out that a place like Times Square also allows enormous commercial advertising. A number of cities also allow billboards. She cautioned that the Board does need to take Ms. Erb’s words into account about setting precedent. Mr. Bosak said he thought the idea of a variance was to make exceptions to certain things based on certain principles. Ms. Brock recommended that the Board look at the visual impact on the environment and on the character of the neighborhood and the community and at traffic safety – whether the banners will cause driver distraction or obstruction of sightlines. They should focus on those things more than saying “this is a museum so we’re happy to let them put up any signs they want.” Mr. Bosak thinks that the public good will be served by allowing this, which would not be the case with an ordinary commercial enterprise. Ms. Brock said that before it gets to the ZBA, she will research that issue. Ms. Erb commented on driver distraction. All signs along the road at one time should be the same so people will not try to read them. Mr. Allmon agreed. She also thinks it important that none of the signs have any commercial sponsorship – that would make them advertisements for someone else, which she doesn’t want to see. Ms. Balestra thought it was illegal to regulate the content of a sign. Ms. Brock said that would depend on if it’s an off-premise billboard. Ms. Erb said the only way these will work without becoming a distraction is if they’re color graphics. Mr. Allmon responded that they’re fine with not offering it to a corporate sponsor. Mr. Bates said that if that were done, it would be off- premise advertising, and they would need a variance for that type of sign. Ms. Erb likes the idea of flagging the entrance. The sizes of the signs inside the property and the ones out front don’t bother her, especially if they’re all linked to the same graphics and there’s no com- mercial component. Mr. Allmon stated that they’ve been doing this long enough that they know how drivers behave, par- ticularly out-of-towners. He is told all the time about the visibility of their sign in all types of weather and lighting conditions. The museum is on a long, skinny piece of property with not a lot of frontage. If you don’t know exactly where to turn, it’s confusing, and you don’t get a lot of leeway to turn, par- ticularly southbound. So partly it’s about announcing that the museum is there, but really it’s about Planning Board Minutes 05-01-2012 Page 5 of 8 making the museum more visible in a general sense – creating an ambience that there’s more back there than people would realize at 45 mph. The number of signs is immaterial, but it’s not just about putting a sign in front of the property – it’s about making their frontage bigger so people will think of them as bigger. Ms. Baer stated that she was leaning towards five banners and asked Mr. Allmon what their minimum would be. He responded that the minimum would be five. The Board discussed which banners on the provided diagram to keep. Ms. Erb said she was trying to get rid of the visual impact of the four in front of the future PRI property. She would prefer four rela- tively densely around the driveway to announce it is there. Mr. Wilcox said that the purpose is not to tell you where the driveway is; it is to let you know that PRI exists. Mr. Bosak said that the usual way you see museum signs is evenly spaced. Repetition is an aesthetically good thing. He’d like to see them as a series kept together, wherever they are, because of the visual effect of seeing them in a row. Mr. Allmon made a proposal to cut off the southern three on their diagram and to keep the remain- ing six. The Board agreed to six identical banners, each measuring 40 square feet, not lit, and with no commercial components. Mr. Wilcox closed the public hearing at 7:53 p.m. PB Resolution No. 2012-022: Recommendation to the Town of Ithaca Zoning Board of Appeals – Sign Variances, Paleontological Research Institution (PRI), 1259 Trumansburg Road Moved by John Beach; seconded by Ellen Baer RESOLVED , that the Town of Ithaca Planning Board, acting as the Town of Ithaca Sign Review Board, hereby recommends to the Zoning Board of Appeals the request for sign variances for the six northernmost 40-square foot banner-like signs on utility poles, as shown on the applicant’s map, date- stamped March 27, 2012, where signs on utility poles are prohibited and signs in residential districts are restricted to four square feet in size; three 10-square foot banner-like signs on light poles in the PRI parking lot, where signs in residential districts are restricted to four square feet in size; and one 800-square foot sign on the Museum of the Earth façade, where signs in residential districts are re- stricted to four square feet in size, be approved, with the following conditions: a.Each of the proposed signs on the utility poles shall not exceed 40-square feet in total sign ar- ea, as defined in the Town of Ithaca Sign Law, b.Each of the proposed signs on the light poles in the Museum of the Earth parking lot shall not exceed 10-square feet in total sign area, as defined in the Town of Ithaca Sign Law, c.The proposed sign on the Museum of the Earth shall not exceed 800-square feet in total sign area, as defined in the Town of Ithaca Sign Law, d.The proposed signs shall not be illuminated, e.If the signs on the utility poles are approved by NYSEG, Verizon, and the NYS Department of Transportation, then the applicant will submit documentation from NYSEG, Verizon, and the NYS Department of Transportation that such signs will be acceptable by those organiza- tions, f.If any of the signs become ripped or tattered, they will be promptly replaced or removed, g.None of the signs on utility poles shall interfere with line of sight of motorists traveling on Route 96, h.All such signs shall be removed by May 1, 2017, and Planning Board Minutes 05-01-2012 Page 6 of 8 i.The signs shall not list commercial sponsors, and j.All six signs on roadside utility poles shall be the same in appearance and content. Lou LoVecchio, CMC, and Paul Levesque, HOLT Architects, were present. It was noted that they will be returning soon for a sign variance because the entire campus will be non-smoking. Mr. Wilcox stated, for the record, that he will break the law and the rule while he is on their property. Mr. Levesque explained that the second floor of the lab addition was to be the future obstetrics depart- ment. They did their best to anticipate where the windows would be and how it would be designed. Further work on the project necessitated some minor changes. Window fenestration is different be- cause they now know which windows they want to be opaque and which they want to let light through. Also, there’s a small infill addition, which is documented as both 490 and 390 square feet: it is actually 490 square feet. The Board decided that it’s not significant to the public hearing notice,  which stated that it is 390 square feet. PB Resolution No. 2012-023: SEQR, Preliminary and Final Site Plan Approval, Cayuga Medical Center Laboratory Addition, Tax Parcel No. 24.-3-2.1, 101 Harris B. The modifications include the con- struction of a 490+/- square foot addition and modifications to the design of the proposed win- dow configuration. Final Site Plan Checklists, having de termined from the materials presented that such waiver will result in neither a significant altera tion of the purpose of site plan control nor the policies enunciated or implied by the Town Board, and 2. That the Town of Ithaca Planning Board hereby grants Preliminary & Final Site Plan Approval for the proposed modifications to the Cayiiga Medical Center Lab Addition, as described in the application materials referenced in "Whereas #3" above, subject to the following condition: a. Submission of one original set of the revised approved site plan drawings on mylar, vellum or paper, signed and sealed by the registered land surveyor, engineer, architect or landscape ar chitect who prepared the site plan materials, prior to the application of a building permit for the approved modifications.
