AGENDA ITEM Persons to be heard No one came forward to address the Board. AGENDA ITEM Public Hearing: Consideration of Final Site Plan and Subdivision Approval for the proposed modifications to the Holly Creek Townhouse development located on Holly Creek Lane (off King Road West), Town of Ithaca Tax Parcel No.'s 37 -1 -17.16 and 37 -1- 17.17, Multiple Residence Zone and Low Density Residential Zone. The proposal involves modifying the approved plan to change the design and siting of the buildings and increasing the number of units from 20 to 22 units in six buildings. The units would be sold to moderate income buyers as part of the Ithaca Neighborhood Housing Services Community Housing Trust program. Holly Creek Townhomes, LLC, Owner; Ithaca Neighborhood Housing Services, Applicant. Mr. Wilcox opened the public hearing at 7:05 p.m. Scott Reynolds and Paul Mazzarella, INHS; Andy Sciarabba, TG Miller; Noah Demarest, Trowbridge and Wolf; and Claudia Brenner, architect, were in attendance. Mr. Demarest said that there have been no significant changes since preliminary site plan approval. He pointed out minor revisions to the landscape plan, specifically the vegetative berm to separate the back yards of some units from the front yards of others. They've also added more street trees and some evergreens to screen patios and have made a few species substitutions. They will submit a final landscape plan. Ms. Erb commented that she likes the way they've distinguished the units with different colors. She questioned why the sidewalk does not extend to the southernmost units (19 -22). Mr. Demarest responded that it is the worst of all the grades, and he thinks walkers would use another path, which he pointed out on the map. The grade on the playground is around 5 %. To a question from Ms. Erb regarding why they chose ornamental fruit trees rather than fruit trees that bear edible fruit, Mr. Demarest responded that they're messy to maintain. PB Minutes 08 -16 -2011 Page 2 of 9 Mr. Bosak agreed that the homeowners might think they would be messy. Mr. Mazzarella pointed out that the homeowners association can decide to add public gardens. Ms. Collins said she appreciates the architectural details around the doors and windows. Mr. Wilcox brought up the size of parking spaces: Town code requires 180 square feet (10x18 or 9x20), but the plan calls for only 162 square feet (9x18). The Board can authorize a plan with smaller spaces if there is good cause shown and no adverse effects on the neighborhood. He pointed out that at College Circle, the Board approved a plan with the 9x18 -foot parking spaces. Mr. Demarest responded that it is the typical size they use: 9x18 is standard for INHS. Their driving aisle is bigger than standard (24 feet as opposed to 22 feet). Making parking spaces smaller allows a larger driving aisle for backing out. He said that it's a wash, and also noted that they're not striping the parking lot. Mr. Slottje said that, as far as complying with the law, he was not convinced that they've demonstrated good cause shown. Mr. Demarest said that they normally try to minimize impervious surface. They were also trying to fit everything within the setbacks, or minimize how much they went over the setbacks. Ms. Ritter pointed out that a lot of the Town's laws are old and have not been modernized. The Town probably would not require that size space today. Mr. Bosak commented that it's hard to fit a full -size truck in modern parking spaces when you aren't used to it, but on the other hand, minimizing impervious surface constitutes good cause shown. The larger driving aisle would solve the problem of backing out a larger vehicle. Mr. Wilcox asked about the status of the issues in Mr. Hebdon's memo. Mr. Hebdon responded that there's an issue with the sidewalk that comes around the corner; it sits on a drainage swale, and there was no regrading shown. This will have to be addressed. Public Works also has a problem with the L- shaped sidewalks. Over time the road and sidewalk will heave at different rates, and if the sidewalk becomes higher, the plow will hit it. The Highway Superintendent would like the L to be cut off and the sidewalk to run straight to the road. The applicant responded,that this was in response to the post office request that the mailboxes be next to the road. Ms. Collins concurred with the applicant that the letter carrier will not exit the truck to deliver the mail. This is a post office regulation. This is also the collection location for trash and recycling bins. After discussion, Mr. Demarest offered the solution that the L- portion of the sidewalk be made of asphalt. The Board generally agreed. Mr. Hebdon agreed that asphalt is easier for Public Works to repair, and requested that they make it level with the road. Mr. Wilcox closed the public hearing at 7:47 p.m. Mr. Wilcox commented that the applicant revised the landscaping plan but did not provide updated drawings for the meeting. He reminded the applicant that the Board does not appreciate receiving last- minute changes. Mr. Wilcox thought plantings might be needed on the eastern edge of the property as a buffer, because the applicant cannot rely on the trees from the PB Minutes 08 -16 -2011 Page 3 of 9 neighboring property to buffer their development. Ms. Erb commented that there's a considerable hillside there and that she was relying on the height of the rise to provide a buffer. Mr. Bosak agreed that there was a risk in using the neighbor's trees as a buffer, but that it's not easy to remedy. I PB Resolution No. 2011 -065: Final Site Plan and Subdivision Approval, Holly Creek Townhouses, Holly Creek Lane off Danby Road and King Road West, Tax Parcel Nos. 37.- 1 -17.16 and 37. -1 -17.17 Moved by Hollis Erb; seconded by John Beach WHEREAS: This action is consideration of Final Site Plan and Final Subdivision Approval for the proposed modifications to the Holly Creek Townhouse development located on Holly Creek Lane (off King Road West), Town of Ithaca Tax Parcel No.'s 37- 1- 17.16,and 37 -1- 17.17, Multiple Residence Zone and Low. Density Residential Zone. The proposal involves modifying the plan approved in 2004 to change the design and siting of the buildings and increase the number of units from 20 to 22 in six buildings. The units would be sold to moderate - income buyers as part of the Ithaca Neighborhood Housing Services Community Housing Trust program. Holly Creek Townhomes, LLC, Owner; Ithaca Neighborhood Housing Services (INNS), Applicant; and 2. The Planning Board, at its December 7, 2010 meeting, issued a negative determination of environmental significance with regard to the proposed Site Plan Approval and Subdivision Approval modifications, after reviewing and accepting as adequate a Full Environmental Assessment Form (EAF) Part I, prepared by the applicant, and Part II of the EAF prepared by the Town Planning staff, and granted Preliminary Site Plan and,Subdivision Approval; and 3. The Planning Board, at a Public Hearing held on August 16, 2011, has reviewed and accepted as adequate final plans for the Holly Creek Townhouses, as listed in the "Final Site Plan Review Application, Holly Creek Townhouses, Ithaca, New York" binder, dated June 27, 2011, and the "Holly Creek Townhouses Final Site Plan Review Submission" drawings, including Cover Sheet 000 (dated June 27, 2010), Boundary and Topographic Map - Lot 6 and Lot 7 Holly Creek Lane, Final Subdivision Plat - Holly Creek Residences, Civil Drawings C101, C102, C201, and C202, Landscape and Site Drawings L201, L202, L301, L401 and L501, Architectural Drawings A -2 through A -6, and A -10, and other application materials; NOW, THEREFORE, BE IT RESOLVED: 1. That the Town of Ithaca Planning Board hereby determines that (a) the change to the project after the granting of Preliminary Site Plan and Preliminary Subdivision Approval (discovery of a .05 +/- acre man -made wetland on the property) does not impact stormwater runoff or any other environmental conditions of the site, and (b) the December 7, 2010 negative determination of environmental significance made by the Planning Board remains appropriate and does not require re- opening or amendment; and 2. That the Planning Board hereby grants Final Subdivision Approval for the proposed subdivision of Tax Parcel No. 37 -1 -17.17 (Lot 7) for the purpose of designating eleven residential units (Phase I - labeled as Units 1 through 11) with common open and developed areas surrounding those units , and for the proposed subdivision of Tax Parcel No. 37 -1- 17.16 (Lot 6), for the purpose of designating eleven residential units (Phase II - labeled as Units 12 through 22) with common open and developed areas surrounding those units, all as PB Minutes 08 -16 -2011 Page 4of9 shown on the drawing entitled "Final Subdivision Plat, Ithaca Neighborhood Housing Services, Holly Creek Residences ", prepared by T.G. Miller PC, dated 6/27/11, conditioned upon the following: a. Submission for signing by the Chairperson of the Planning Board of an original or mylar copy of the final subdivision plat, along with three dark -lined prints, prior to filing with the Tompkins County Clerk's Office, and submission of a receipt of filing to the Town of Ithaca Planning Department; and b. Submission of any cooperative proprietary leases, condominium or homeowners association documents, or other agreements among property owners, including, but not limited to, suitable provisions to assure maintenance of all common utilities and facilities, satisfactory to the Attorney for the Town, prior to issuance of any Certificates of Occupancy; and c. Submission of the language of cross easements or other agreements necessary to guarantee owners of all units in the subdivision access to all utilities, drainage and stormwater facilities, recreational amenities, common open space and other common or shared facilities on Lots 6 and 7, to ensure that future owners and leaseholders of all parcels have full rights to use all of the above - mentioned facilities, satisfactory to the Attorney for the Town, prior to the issuance of any Certificates of Occupancy; and d. Acceptance by the Town Board of any infrastructure, facilities, or easements for dedication to the Town prior to the issuance of any Certificates of Occupancy; and e. The deed restricted natural buffer zone on both sides of the stream that traverses Lots 6 and 7 shall remain in effect; and f. All conditions pertaining to Lots 1 through 5 of the originally approved Holly Creek Subdivision in Resolution No. 2004 -001 shall remain in effect; and g. Submission of a water main easement satisfactory to the Attorney for the Town and the Town of Ithaca Public Works Department prior to the issuance of any building permits for any units; AND BE IT FURTHER RESOLVED: 1. That the Planning Board hereby grants Final Site Plan Approval for the proposed Holly Creek Townhouses as shown on the "Holly Creek Townhouses Final Site Plan Review Submission" drawings, including Cover Sheet 000 (dated June 27, 2010), Boundary and Topographic Map - Lot 6 and Lot 7 Holly Creek Lane, Final Subdivision Plat - Holly Creek Residences, Civil Drawings C101, C102, C201, and C202, Landscape and Site Drawings L201, L202, L301, L401 and L501, Architectural Drawings A -2 through A -6, and A -10, and other application materials, conditioned upon the following: a. Submission of one original set of revised final site plan drawings on mylar, vellum, or paper, and two sets of paper copies, amended to show a clear demarcation between Phases I & II on all drawings, and signed and sealed by the registered land surveyor(s), engineer(s), architect(s), or landscape architect(s) who prepared the materials; and b. Submission of a copy of the Army Corps of Engineers Permit required to fill in the +/ -.05 acre wetland, prior to any work occurring on. the site; and PB Minutes 08 -16 -2011 Page 5 of 9 c. Submission of a truck routing plan showing proposed routes for trucks hauling material excavated from the site for review and approval of the Town of Ithaca Department of Public Works, prior to issuance of any building permits; and d. Submission of a stormwater "Operation, Maintenance, and Reporting Agreement" between the property owner and the Town of Ithaca, satisfactory to the Attorney for the Town and the Town of Ithaca Public Works Department, prior to issuance of any building permits; and e. Obtaining the necessary curb -cut and road work permits from the Town Highway Superintendent, prior to construction of any facilities that affect the Town road (Holly Creek Lane); and f. Submission of record of application for and proof of receipt of all necessary permits and approvals from county, state, and /or federal agencies, prior to the issuance of any certificates of occupancy for the units; and g. Submission of revised plans satisfactory to the Department of Public Works and the Director of Planning showing grading for the sidewalk along the road from the new storm manhole to Buildings 12 to 14, showing a revised Planting Plan consistent with the plantings shown at the August 16, 2011 Planning Board meeting, and changing the concrete L sections along the road to asphalt; and h. Submission of the architectural renderings showing building elevations as presented to the Planning Board at its August 16, 2011 meeting, and submission of the color palette for exteriors, satisfactory to the Director of Planning; AND BE IT FURTHER RESOLVED: That the Planning Board allows a reduction of the standard size of the parking spaces to 162 square feet, finding that the applicant has shown good cause for the reduction and further finding that such reduction will cause no adverse effects on the project, on the surrounding properties, or on the neighborhood. Vote Ayes: Wilcox, Collins, Conneman, Beach, Bosak, Slottje, Erb AGENDA ITEM Public Hearing: Consideration of Final Site Plan and Subdivision Approval for the proposed Ithaca Beer Company Development located on Mancini Drive off Elmira Road (NYS Route 13) on Town of Ithaca Tax Parcel No.'s 33- 3 -2.2, 31 -3 -3.12 and 33- 3 -2.9, Planned Development Zone No. 14. The proposal involves developing approximately 12.52 acres of the property for a new brewery facility which includes 11,000 +/- square feet for production, shipping /receiving, and storage, 1,500 +/- square feet for offices, and 2,500 +/- square feet for the retail and pub space. The project will also include a beer garden, silo, agricultural fields, approximately 78 parking spaces, signage, stormwater facilities, outdoor lighting, and landscaping. As part of this proposal, a 9.56 +/- acre parcel is being subdivided from Tax Parcel 33 -3 -2.2 for the brewery development (Parcel D). The subdivision proposal also involves subdividing off a 0.75 +/- acre parcel (Parcel B) from Tax Parcel 33- 3 -2.2, to be consolidated with 33- 3 -2.9, and subdividing off a 0.75 +/- acre parcel (Parcel C) from Tax Parcel No. 33- 3 -2.9, to be consolidated with the new 9.56 acre brewery parcel (Parcel D). Mitchell Ventures, LLC, Owner /Applicant; Dan Mitchell, President, Ithaca Beer Company, Inc., Agent. PB Minutes 08 -16 -2011 Page 6 of 9 Wilcox opened the public hearing at 8:18 p.m. Dan and Mari Mitchell and Michele Palmer, landscape architect, were present. Mr. Mitchell said that they went before the Town Board, who voted unanimously to approve the PDZ. The Town Board had questions regarding property tax abatements. Ms. Erb noted that the Plant Schedule in the packet is inconsistent with the Planting Plan: the quantity of flame grass needs to be corrected on the Plant Schedule to19 instead of 13. Also one neighbor asked for some additional landscaping on the west side of the road going from the egress towards Five Mile Drive. She suggested a mix of evergreen shrubs and trees to help protect their privacy. Mr. Mitchell responded that they have made efforts to block the building from view. The issue is the view across the pond. The neighbor has not seen the current plan, where it has been addressed. Ms. Palmer said the applicant feels that the pond is an amenity that they would like to be viewable from their site. While they recognize that the neighbor would like privacy, the whole expanse of the pond is between them and the driveways and planting a row of evergreens would mean that no one could see the pond from the applicant's site. Ms. Erb agreed. Mr. Wilcox said that the same neighbor is concerned about the amount of stormwater going into the pond, which is partially on her property and partially on property owned by the applicant. Mr. Hebdon responded that very little stormwater will flow into the pond before being filtrated. Mr. Bates would like the unimproved road on the subdivision plat to be shown as Ithaca Beer Drive, since it's a continuation of that road from the PDZ property. Ms. Brock stated that clarification is needed on where all the stormwater facilities will be located and whether they will all be on site or if some elements will be off site. Ms. Palmer stated that the resubmitted plan shows that instead of there being an open drainage swale, there is now a pipe system. The only drainage that is on the neighboring property is a pipe that picks up the existing drainage Swale. It is for convenience to prevent sediment from going into the structure. In the future, if the neighbors decide they don't want the pipe there, they can just take it out; it will not affect the functioning of the system. This means that they will require only a temporary construction easement to do a bit of grading on the adjacent parcel. Mr. Hebdon agreed. Mr. Wilcox closed the public hearing at 8:45 p.m. PB Resolution No. 2011 -066: Final Site Plan Approval & Final Subdivision Approval, Ithaca Beer Company Development, Mancini Road (off Elmira Road), Tax Parcel No.'s 33- 3 -2.2, 31 -3 -3.12 and 33 -3 -2.9 Moved by Fred Wilcox: seconded by John Beach WHEREAS: PB Minutes 08 -16 -2011 Page 7 of 9 1. On June 21, 2011, at a Public Hearing, the Town of Ithaca Planning Board granted Preliminary Site Plan and Preliminary Subdivision approvals, with conditions; and 4. On August 8, 2011, at a Public Hearing, the Town of Ithaca Town Board did adopt a local law entitled "A Local Law to Amend Zoning Chapters 270 and 271 of the Town of Ithaca Code to Provide a Planned Development Zone for the Ithaca Beer Company on Route 13 "; and 5. The Planning Board, at a Public Hearing held on August 16, 2011, has reviewed and accepted as adequate, the following drawings: "Subdivision Plat" dated 4/5/2011 and revised 7/18/2011 and prepared by T.G. Miller P.C.; "Planting Plan" (1-102), dated 07/19/2011 and prepared by Templeton Landscape Architecture & Planning; "Existing Conditions Plan" (Sheet C100), "Site Plan" (Sheet C101), "Layout Plan" (Sheet C102), "Grading and Drainage Plan" (Sheet C103), "Erosion & Sediment Control Plan — Construction Phase" (C104), "Erosion & Sediment Control Plan — Stabilization Phase" (C105), "Utility Plan" (C106), "Details" (Sheets C201, C202, C203), dated 07/18/2011 and prepared by T.G. That the Town of Ithaca Planning Board hereby waives certain requirements for Final Subdivision Approval, as shown on the Final Subdivision Checklist, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board; and 2. That the Town of Ithaca Planning Board hereby grants Final Subdivision Approval for the proposed Ithaca Beer Company Development project located on Mancini Road, as described in the drawings listed above, subject to the following conditions: PB Minutes 08 -16 -2011 Page 8 of 9 a. submission for signing of one original or mylar copy and three dark -line prints of the final plat by the Planning Board Chair, said plat to be filed in the Tompkins County Clerk's Office, and a copy of the receipt of filing provided to the Town of Ithaca Planning Department, prior to the issuance of any building permits, and b. consolidation of the 0.75 +/- acre parcel (Parcel B) from Tax Parcel 33- 3 -2.2, to be consolidated with 33- 3 -2.9, and the 0.75 +/- acre parcel (Parcel C) from Tax Parcel No. 33- 3 -2.9, to be consolidated with the new 9.56 acre brewery parcel (Parcel D), and submission of a copy of the consolidation request to the Town of Ithaca Planning Department within six months of the date of this final subdivision resolution, and c. submission of a revised subdivision plat showing the name "Ithaca Beer Drive" on the segment of unimproved road that is southwest of the portion of Ithaca Beer Drive that is included in the Planned Development Zone, and BE IT FURTHER RESOLVED: 1. That the Town of Ithaca Planning Board hereby grants Final Site Plan Approval for the Ithaca Beer Company Development project located on Mancini Drive, as described in the drawings listed above, subject to the following conditions: a. submission of the final Stormwater Pollution Prevention Plan and associated drawings, satisfactory to the Town of Ithaca Public Works Department, prior to the start of any site work, and b. submission of one set of the final site plan drawings on mylar, vellum, or paper, signed and sealed by the registered land surveyor, engineer, architect, or landscape architect who prepared the site plan material, prior to the issuance of a building permit, and c. submission of an easement satisfactory to the Attorney for the Town to ensure ingress and egress for the 10.21 -acre parcel onto Mancini Drive and Mancini Road, prior to issuance of building permits, and d. submission of an easement agreement between the Ithaca Beer Company property owner, Mitchell Ventures LLC, and the Town of Ithaca for the stormwater facilities that extend onto the adjacent Mitchell Ventures property, satisfactory to the Attorney for the Town and the Town of Ithaca Public Works Department, prior to the installation of those stormwater elements, and e. submission of a stormwater "Operation, Maintenance, and Reporting Agreement" between the property owner and the Town of Ithaca, satisfactory to the Attorney for the Town and the Town of Ithaca Public Works Department, prior to issuance of any certificates of occupancy, and submission of record of application for and proof of receipt of all necessary permits from county, state, and /or federal agencies, prior to the issuance of any certificates of occupancy,and g. submission of a temporary construction easement between the Ithaca Beer Company, property owner, and Ferrara Realty Inc. for construction of the stormwater facility that extends onto the adjacent Ferrara Realty Inc property, satisfactory to the Attorney for the Town and the Town of Ithaca Public Works Department, prior to the installation of that stormwater facility, and PB Minutes 08 -16 -2011 Page 9 of 9 h. submission of a revised Plant Schedule showing the quantity of flame grass to be planted to be 19 rather than 13, consistent with Sheet L102. Vote Ayes: Wilcox, Collins, Conneman, Beach, Bosak, Slottje, Erb AGENDA ITEM Other Business Mr. Wilcox distributed an excerpt from a local weekly newspaper that quoted an opinion from a planning board chair of another town regarding a project that had not yet come before that board. Mr. Wilcox solicited opinions from the Planning Board members as to the appropriateness of the chair making such a statement. Members agreed that such a statement was inappropriate, considering its timing.
