AGENDA ITEM Persons to be heard No one came forward to address the Board. AGENDA ITEM PUBLIC HEARING: Consideration of a recommendation to the Town of Ithaca Zoning Board of Appeals regarding a sign variance for the East Hill Antiques sign, located at 335(a) Pine Tree Road, Town of Ithaca Tax Parcel No. 62 -2- 1.121, Community Commercial Zone. The proposal is to replace the existing wall sign with a new 33 +/- square foot wall sign in the same location. Cornell University Real Estate Department, Owner /Applicant; Maria B. Maynard, Property Manger, Agent. Mr. Wilcox opened the public hearing at 7:05 p.m. Ms. Maynard explained that their sign permit application was denied because it does not meet code in terms of the square footage permitted per linear feet of store front. She gave a short history of signage at East Hill Plaza, noting that in 1992, when Cornell renovated the plaza, they did a fagade project and came in front of the Planning Board and ZBA for approval of box signage. The previous tenant in this space was Rock, Paper, Scissors. Ms. Maynard confirmed for Mr. Wilcox that the new sign will be consistent with the size of the existing sign. Mr. Bates explained how the size of a sign is defined in the law. The whole fagade is part of the sign, including the background. Ms. Brock agreed that, based on the definition in the sign law, the entire panel is the sign. Mr. Wilcox closed the public hearing at 7:17 p.m. Ms. Collins noted that this is the second East Hill Plaza sign the Board has seen recently, and asked whether the Board will have to go through this process every time a business opens there. Mr. Bates explained that Rock, Paper, Scissors never had a sign permit. What's Your Beef was compliant because the frontage of the structure was less than the area they were allowed by the sign law. Under normal circumstances, as long as the new business is a similar use, and the sign is not going to change dramatically, the applicant will not have to come back. The problem is that the last tenant did not receive a variance and did not have a permit for their sign. All the other PB Minutes 08 -02 -2011 Page 2 of 10 signs the Board has addressed at the plaza will not need variances if a business changes hands, as long as it is a similar use. Mr. Bosak commented that it's obvious that the sign ordinance was written with free - standing units in mind. It's less time and trouble to address situations like this with the occasional variance than to have the Town Board write a better sign ordinance. PB Resolution No. 2011 -058: Recommendation to Town of Ithaca Zoning Board of Appeals, Sign Variance — East Hill Antiques Sign, East Hill Plaza, 335A Pine Tree Road, Tax Parcel No. 62. -2 -1.121 Moved by Ellen Baer; seconded by John Beach WHEREAS: This action is consideration of a Recommendation to the Zoning Board of Appeals for sign variance for the East Hill Antiques sign, located at 335A Pine Tree Road, Town of Ithaca Tax Parcel No. 62 -2- 1.121, Community Commercial Zone. The proposal is to replace the existing wall sign with a 33 +/- square foot wall sign in the same location. Cornell University Real Estate Department, Owner /Applicant; Maria B. Maynard, Property Manager, Agent; and 2. The Planning Board, at a Public Hearing held on August 2, 2011, has reviewed and accepted as adequate sign details showing the proposed location, dimensions, and details of the sign, along with other application materials. NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board, acting as the Town of Ithaca Sign Review Board, hereby recommends that the Zoning Board of Appeals approve the request for a sign variance for a new 33 +/- square foot wall sign for the East Hill Antiques shop, where the proposed sign will be larger than allowed in the Town Sign Law. The Planning Board further recommends that such approval be subject to the following condition: a. The applicant must obtain a sign permit prior to installing the new sign. Vote: Ayes: Wilcox, Collins, Conneman, Beach, Baer, Bosak, Erb AGENDA ITEM SEQR Determination: Maple Hill Apartments Playground, 301 Maple Avenue. Bruce Abbott provided a brief overview of the project. In 2000, they proposed a variety of actions at Maple Hill Apartments to mitigate stormwater, principally, and as an adjunct to provide play space for the youngest children. At that time, they did not have many children, but the number of children has increased dramatically over the past five years. His intention was to provide two play areas: one for ages 4 to 9 and another for ages 10 to 14. To accomplish the larger playground, he bought two large, heavy metal play pieces when he sold the West Village apartments. There was a deadline given for completion of the playgrounds, and just under the wire, they completed the smaller playground by adding some spring - loaded riding toys to what was originally only a jungle gym. The radius that is now required around a piece of play equipment is somewhat exaggerated, and they just managed to squeeze the three extra toys into the restricted space and there is no more room. They now have a play area for the younger group. For the older children, the larger PB Minutes 08 -02 -2011 Page 3 of 10 playground was paved for a basketball area, but a tenant petition was circulated opposing the constant pounding of basketballs against the backboard, because it would drive them nuts. The area is very popular, and the kids are there every day riding their bikes and entertaining themselves. Mr. Abbott was ready to put in the heavy play equipment, but discovered that the bolts and connectors needed to hold the structure together had been stolen by scavengers, and they were left with a bunch of tubular junk they could not assemble. In terms of taking care of children, they partnered with the Tompkins County 4 -H 32 years ago and have transferred about a million dollars to them during that time to provide after - school and summer recreation for around 4000 children. They have a lot of children from Burma who are political refugees and they've sponsored after - school programs to help the children acclimate to the US by holding a daily program at Belle Sherman conducted by the 4H. The playground space they have is used for volleyball, running around, playing soccer, and social events. He doesn't think they need the equipment. He is asking that the final 5% of the building permit be expunged. Mr. Wilcox noted that the Board is looking at the potential impacts of not building a playground. Ms. Erb said that she had visited the area before the meeting and saw small children riding in the parking lot, so she is in favor of keeping the larger area as a better place to ride. She was pleased to see seven children simultaneously in the smaller area. She also saw new speed bumps. Mr. Abbott commented that the worst offenders were delivery trucks and the police; the 10 -MPH signs he installed seem to be working. Mr. Bosak said he was sorry to hear about the theft, but it might be just as well, because 10 to 14 year olds would prefer the open space to having a slide and a swing set. Ms. Baer said she is not in favor of completely letting it go. She saw used equipment on Craigslist and thinks that something should be provided for this age group as opposed to doing nothing. Mr. Abbott responded that there's a nightly soccer game, the grass has been demolished from volleyball, there are social events, and the children ride there, since even with the speed bumps, cars go fast in the parking lot. There is no restriction now on what the kids can do. They've provided them with a volleyball net and ball. People barbecue there every night. It's the recreational back yard for the all the apartments. People hang their laundry there. In cold weather, they have the after school program until 6 p.m., which reinforces their homework and language. They don't see people out in the winter time. Mr. Bates commented that this is the third time Mr. Abbott has come before the Board to change what he was required to do with the space. The permit has been open for three years and needs to be closed out. PB Resolution No. 2011 -059: SEAR, Preliminary and Final Site Plan Approval, Maple Hill Apartments, Tax Parcel No. 61- 2 -7.1, 301 Maple Avenue Moved by Hollis Erb; seconded Jon Bosak WHEREAS: This action involves consideration of Preliminary and Final Site Plan Approval for the proposed modifications to the Maple Hill Apartments playground, located at 301 Maple Avenue, Town of Ithaca Tax Parcel No. 63- 2 -7.1, Multiple Residence Zone. The proposal involves revising the previously approved site plan, granted on October 19, 2010, by removing the requirement for a second playground to be constructed. Abbott Associates, Owner /Applicant; Bruce D. Abbott, Manager, Agent; and PB Minutes 08 -02 -2011 Page 4 of 10 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is acting as lead agency in the environmental review with respect to Site Plan Modification; and 3. The Planning Board, on August 2, 2011, has reviewed and accepted as adequate a Short Environmental Assessment Form Part I, submitted by the applicant, and a Part II prepared by Town Planning staff, a project narrative in the form of a letter addressed to the Town of Ithaca Planning Board and dated July 11, 2011, a site plan and photo attachments, date - stamped July 11, 2011, and labeled Diagrams 1 -9, that describe the location of existing activities that occur on the site, and other application materials; and 4. The Town Planning staff has recommended a negative determination of environmental significance with respect to the proposed modification of the site plan; NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with Article 8 of the Environmental Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality Review for the above referenced actions as proposed, based on the information in the EAF Part I and for the reasons set forth in the EAF Part 11, and, therefore, a Draft Environmental Impact Statement will not be required. Vote: Ayes: Wilcox, Collins, Conneman, Beach, Baer, Bosak, Erb AGENDA ITEM PUBLIC HEARING: Consideration of Preliminary and Final Site Plan Approval for the proposed modifications to the Maple Hill Apartments playground, located at 301 Maple Avenue, Town of Ithaca Tax Parcel No. 63- 2 -7.1, Multiple Residence Zone. The proposal involves revising the previously approved site plan, granted on October 19, 2010, by deleting the requirement for a second playground to be constructed. Abbott Associates, Owner /Applicant; Bruce D. Abbott, Manager, Agent. Mr. Wilcox opened the public hearing at 7:35 p.m. Ms. Erb asked whether there was any reason to worry that the paved area used by the bicyclists is at risk of being used for a different purpose, such as a parking lot. Mr. Abbott responded that that would be impossible because of the topography. It's actually a holding pond that is filled with tons of gravel. Ms. Brock stated that when the Planning Board approved the site plan in 2000, there was a condition regarding preserving trees. With last year's modification, that condition was dropped because the equipment was going to go there. She recommended adding the condition back into the approval. Mr. Abbott and the Board agreed. Mr. Wilcox closed the public hearing at 7:40 p.m. PB Resolution No. 2011 -060: Preliminary and Final Site Plan Approval. Maple Hill Apartments, Tax Parcel No. 61- 2 -7.1, 301 Maple Avenue Moved by Hollis Erb; seconded by Linda Collins PB Minutes 08 -02 -2011 Page 6 of 10 occupants. The glass on the lower panels will be completely opaque and there will be a gradient to the top, where it will be translucent, allowing access to sky views. The penthouse (legally, a fourth floor) will be a metal- paneled system and will house all the mechanical systems to support the operating rooms. It will be no louder outside than at present, as there are soundproof walls, and .it's not a very noisy area — just a lot of air being moved. The generators are all at the other side of the hospital. It's a custom air handler that is more efficient and provides better performance. The waste gas will be recaptured; this is the law. The industry recently came out with for LEED for healthcare; they're working on meeting that. LEED doesn't work very well for healthcare because of all the air handling systems, etc. Mr. Bosak said that while he appreciates all the effort they're putting into meeting LEED certification, he thinks that the enormous southwest facing expanse was a missed opportunity to use passive solar construction. It could have been the biggest solar- energy collector in the county. He thinks the Town needs to work in the future at changing the code to encourage a more imaginative handling of the energy issue. Mr. Levesque responded that there were lots of things that could have been done, but they were trying not to go too far outside the envelope of the current hospital architecture. It's a very dominant architecture in that part of the county. The roofing material planned is a matte finish that will be less reflective than the white roof is now; people farther upon West Hill will not get a glare. Ms. Michaels explained the parking plan. The five handicap spaces that will be moved during construction will be restored when construction is complete. The staging area will be fenced off for the contractors and will return to regular parking when construction is complete. The workers will park their personal vehicles in the same gravel lot in the back that they have parked in for other projects. This area will also be used for materials that are not immediately needed. There was discussion regarding the anticipated increase in the number of surgeries as a result of the project. Mr. Rudd commented that this project will accommodate future population growth. This is not a project intended to increase the volume of surgeries, but to meet the needs of the current standard. The number of rooms will remain the same, but will be larger to accommodate modern equipment and better serve patients. Any increase in traffic would happen anyway. The Planning Board agreed that the fact that there will be no net increase in the number of surgical rooms is the key. Any increase in traffic is because the population is growing and aging. Ms. Erb questioned why they will be using Chinese elms since the Board tends to require native plantings. Mr. Tasman responded that it's a cultivar that was developed in the United States, not China. There are several disease - resistant American elms and English elms, but he hasn't heard of any used in the area. Ms. Michaels has personally used this species and trusts it. She has not seen specimens of those Mr. Tasman talked about. She prefers to grow and get to know plants before using them on a project. There was discussion and changes made to the Full EAS. PB Resolution No. 2011 -061: SEQR, Preliminary and final site plan approval, and special permit, Cayuga Medical Center Surgical Services Addition, Tax parcels 24 -3- 2.412, 24 -3- 2.411, 24- 3 -2.1, 101 Harris B. Dates Drive Moved by George Conneman; seconded by John Beach PB Minutes 08 -02 -2011 Page 7 of 10 WHEREAS: 1. This action involves consideration of preliminary site plan approval, final site plan approval, and special permit approval for the proposed Cayuga Medical Center Lab Addition project, 101 Harris B. Dates Drive, Town of Ithaca tax parcels 24 -3- 2.412, 24 -3- 2.411, 24- 3 -2.1, OPC- Office Park Commercial zoning district. The project includes construction of a three story (48 foot height) addition with 13,900 square feet of floor area on a footprint of 4,400 square feet, located in an area that is currently a landscaped plaza on the west (front) side of the hospital. The addition will include four general operating rooms, and space for future development of outpatient services and expansion of the imaging department. The project also includes addition of two new driveways encroaching over existing landscape areas, with approximately 1,000 square feet of new impervious surface, to provide improved access for firefighting apparatus. Cayuga Medical Center at Ithaca, owner /applicant; Kimberly Michaels, Trowbridge and Wolf LLP, Landscape Architects, agent; and 2. This is a Type I Action, pursuant to the State Environmental Quality Review Act, 6 NYCRR Part 617, and Town of Ithaca Code, Chapter 148 — Environmental Quality Review; and 3. In a letter dated July 5, 2011, the Planning Board proposed to establish itself as lead agency to coordinate the environmental review of this project, and notified potential involved and interested agencies of its intent to serve as lead agency; and 4. The Planning Board, on August 2, 2011 has reviewed and accepted as adequate a Full Environmental Assessment Form Part I, submitted by the applicant, and a Part II prepared by Town Planning staff, the following drawings: key map dated April 2011; perspective view (Al), west elevation (A2), north elevation (A3), and floor plans (A4) dated June 24, 2011; general demolition plan (1-101), sequencing plan (1-102), site layout plan (1-201), grading plan (1-301), planting plan (1-401), site details (1-501), site details (C101), utility demolition plan and utility plan (C102), erosion and sediment control plan (C102) and site utility details (C201) dated July 1, 2011; and other application materials; and 5. Town Planning staff has recommended a negative determination of environmental significance with respect to the proposed preliminary site plan approval, final site plan approval and special permit, NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board, having received no objections from other involved agencies, establishes itself as lead agency to coordinate the environmental review of the above described actions; AND BE IT FURTHER RESOLVED: That the Town of Ithaca Planning Board makes a negative determination of environmental significance in accordance with Article 8 of the Environmental Conservation Law and 6 NYCRR Part 617 New York State Environmental Quality Review for the above referenced actions as proposed, based on the information in the Full EAF Part I and for the reasons given in the Full EAF Part II, and, therefore, a Draft Environmental Impact Statement will not be required. Dates Drive, Town of Ithaca Tax Parcel No.'s 24 -3- 2.412, 24 -3- 2.411, and 24- 3 -2.1, Office Park Commercial Zone and Planned Development Zone No. 3. The proposal involves constructing a three story, 13,900 +/- square foot addition for the surgery department on the west side of the existing hospital, adjacent to the main entrance. The project will also involve a new driveway connection between the existing southwest parking lot and the Biggs parking lot, modifications to the existing parking lot islands, and new landscaping. Mr. Wilcox opened the public hearing at 8:26 p.m. and closed the public hearing at 8:30 p.m. The mobile pad will temporarily be relocated. They want to retain the pad for any new mobile equipment that comes out in the future. That the Town of Ithaca Planning Board waives certain requirements for preliminary site plan approval, as shown on the preliminary site plan checklists, having determined from materials presented that a waiver will not result in a significant alteration of the purpose of site plan control or the policies enunciated or implied by the Town Board; and 2. That the Town of Ithaca Planning Board grants preliminary and final site plan approval for the proposed Cayuga Medical Center addition as described in the application materials referenced in "Whereas #3" above, subject to the following conditions being met before a building permit is issued, unless otherwise noted: a. Approval of a variance to building height requirements of the OPC - Office Park Commercial zoning district by the Board of Zoning Appeals; and b. Approval of the submitted Stormwater Pollution Prevention Plan by the Public Works Department; and c. Submission of one original set of final site plan drawings on mylar, vellum or paper, signed and sealed by the registered land surveyor, engineer, architect or landscape architect who prepared the site plan materials; and d. Submission of documentation of all necessary approvals from county and state agencies before any certificate of occupancy is issued; and e. Submission of a revised site plan showing locations of bicycle racks and of breakaway or flexible bollards for the connection between the southwest parking lot and the Biggs lot; and f. Written notification to the Town Department of Public Works of routes and destinations for all excavated materials to be removed from the site. Vote: Ayes: Wilcox, Collins, Conneman, Beach, Baer, Bosak, Erb AGENDA ITEM Discussion regarding potentially re- opening the State Environmental Quality Review (SEQR) or amending the negative declaration of environmental significance issued for the Holly Creek Townhomes project, based on recently learned information about the presence of a 0.05 + / —acre wetland on the site. Mr. Hebdon said the developer created a depression when putting in the water and sewer lines. When they filled it back in, they got enough cover for the Town to approve the line, but not PB Minutes 08 -02 -2011 Page 10 of 10 enough to fill it to the top, so now there's a low area that fills with water. It's not a water line leaking, because the chlorine in water is not conducive to cattails. It's the drainage from Country Inn and Suites. According to the Army Corps of Engineers, if cattails grow, it's a wetland. The Board did not want to reopen SEQR for a man -made depression that sits on an easement. It might be ripped up some day if the Town needs to work on the sewer line. The Board did not feel it was significant. It's so small that Mr. Bosak, Mr. Beach, and Ms. Erb could not find it.
