Staff Present: Bruce Bates, Director of Code Enforcement; Susan Brock, Attorney for the Town; Kristin Taylor, Engineer; Jonathan Kanter, Director of Planning; Mike Smith, Planner; Darby Kiley, Planner; Debra DeAugistine, Deputy Town Clerk Call to Order Chairperson Wilcox called the meeting to order at 7:04 p.m., and accepted the posting of the three public hearing notices. AGENDA ITEM Persons to be heard No one in the audience wished to be heard. AGENDA ITEM SEQR Determination: Alden / Baer 3 -Lot Subdivision, 247 Dubois Road Jon Bosak recused himself and took a seat in the audience since he is a friend of the applicant. Chairman Wilcox noted that Ellen Baer, one of the co- applicants, is an alternate member of the Planning Board. For the record, Ms. Baer was not participating in consideration of this matter and was seated in the audience and not at the table with the Board. Ellen Baer gave a brief overview of the proposal. She noted that a year ago, the PB approved their plan. The ZBA said that one of the lot sizes was under the minimum of 30,000 feet. Since they have the property to make it a larger lot, they decided to do so. The ZBA suggested they go back before the Planning Board for approval. The conditions from the ZBA were met or exceeded. Chairman Wilcox wanted to verify that the ZBA condition of no further subdivision would be accomplished through a deed restriction. Attorney Brock said that he was correct. Board Member Erb wondered whether TCAT services Dubois Road. Ms. Baer said that it does, but very infrequently, going to the Racker Centers. Ms. Erb mentioned that she liked the shared driveway for the three residences. PB RESOLUTION NO. 2010-015: SEOR Determination: Preliminary and Final Subdivision Approval, Alden /Baer 3 -Lot Subdivision, 247 Dubois Road, Tax Parcel No. 22i,2-1.31 Motion by Rod Howe; seconded by Kevin Talty WHEREAS: 2. 3 9 5 This is I consideration of Preliminary and Final Subdivision Approval for the proposed three -lot subdivision located at 247 Dubois Road, Town of Ithaca Tax Parcel No. 22 -2 -1.31, Low Density Residential Zone. The proposal involves subdividing the existing +/- 5.8 acre parcel into three new lots, with Lot A being +/- 0.7 acres, Lot B being +/- 0.7 acres, and Lot C, containing the existing house, being +%- 4.4 acres. Barbara Alden Guttridge & Ellen Baer, Owners /Applicants, and The Planning Board on March 3, 2009 granted Preliminary and Final Subdivision Approval for the 3 -lot Alden /Baer Subdivision with the approval conditioned upon the granting ting of several variances from the Zoning Board of Appeals, including a variance to allow Lot B to be less than the minimum required 30,000 square feet in the LDR Zone, and The Zo ing Board of Appeals (ZBA) considered the Alden /Baer subdivision at their meeting on October 26, 2009 and adjourned consideration until such time that the applicants could submit a revised proposal to increase the size of Lot B to conform to the minimum required lot size for the LDR Zone, and on November 16, 2009 the ZBA, after considering the revised subdivision proposal which increased the size of Lot B to 0.7 acres, granted the necessary variances for the insufficient setbacks on Lots B and C, conditioned upon the applicant receiving approval from the Planning Board for the modification to the subdivision plan, and This is an Unlisted Action for which the Town of Ithaca Planning Board is acting in an uncoordinated review with respect to Subdivision Approval, and The Planning Board on March 2, 2010, has reviewed and accepted as adequate a Short Environmental Assessment Form Part I, submitted by the applicant, and Part II prepared by the Town Planning staff; a survey map entitled "Lands of Barbara Alden Guttridge and Ellen Baer, 247 Dubois Road, Town of Ithaca, Tompkins County, New York State, Proposed Lot Split ", prepared by Stockwin Surveying, date of certification 10/30/09, and other application materials, and PB Final 03 -02 -2010 Page 3 of 17 Town 1planning staff has recommended a negative determination of environmental significance with respect to the proposed Subdivision Approval; NOW THEREFORE BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance for the reasons set forth in the Environmental Assessment Form Part II referenced above, in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed, and, therefore, an Environmentall Impact Statement will not be required. A vote on the motion was as follows: AYES: Wilcox, Conneman, Talty, Howe, Erb NAYS: None The motion AGENDA ITEM SEAR Determination: Ithaca College Freeman Field Backstop Replacement, Conservatory Drive Rick Couture, associate vice president for facilities, Ithaca College, described the proposed project and welcomed questions. He verified that they will be putting in the same PA system as before, with no changes. The project came before the Planning Board because of the cost. The chain link fence needs to be replaced, and this will be an enhancement to the field. Mr. Bates had is question about structure. He wondered if there was any danger of players, for example, catchers, running into the 3 -foot high concrete barricade. A chain link fence would give more than concrete wall. He wondered if they had given any thought to padding the structure. PB Final 03 -02 -2010 Page 6 of 17 Mr. Couture responded that they had not given it thought. The wall is only 3 -feet high and the catcher is wearing protective gear. He would be happy to talk to the athletic director to see if there was anything appropriate to do. Mr. Bates suggested that a warning track (a transition from grass to, say, a gravel surface) would work. Mr. Kanter asked whether the Planning Board would be amenable should they decide to install paddingl, to which the Planning Board agreed they would be. Attorney Brock changed the language in the resolution slightly to indicate more clearly that Sheet 1 ofd the packet is date stamped. It was agreed that, in future, all pages in a plan should be date stamped. PB RESOLUTION NO. 2010 -017: SEQR Determination: Preliminary and Final Site Plan & Special Permit, Ithaca College Freeman Field Backstop Replacement, Tax Parcel No. 41;1 -30.2 Moved by Kevin Talty; seconded by George Conneman WHEREAS: 1. This action is consideration of Preliminary and Final Site Plan Approval and Special Permit for the proposed Ithaca College Freeman Field Backstop Replacement project located on the Ithaca College campus between Danby Road (NYS Route 96B) and Conservatory Drive, Town of Ithaca Tax Parcel No. 41 -1 -30.2, Medium Density Residential Zone. The project involves removing the existing backstop and constructing a new backstop (a 3 foot high concrete wall with a +/� 20 foot high net on top) in the same location. The project also includes a new stone dust pad for six units of portable bleachers and new concrete steps and a 1 andicap ramp. Ithaca College, Owner /Applicant; Richard Couture, Associate Vice - President for Facilities, Agent, and 2. This is an Unlisted Action for which the Town of Ithaca Planning Board is acting as Lead Agency in an environmental review with respect to Site Plan Approval and Special Permit, and 3. The public hearing was closed at 7:36 p.m. Attorney Brock made the same amendments to the resolution regarding packet stamping as she suggested for the SEQR resolution above. IC has not used the compost facility on campus for a few years and decided it was more cost effective to outsource their compost operation to Cayuga Compost. They decided to turn the compost building into a cold storage facility and to put a roof over the concrete pad on the north side of the building and use the pad for additional storage. Mr. Couture asked the Board to consider an additional item: putting siding on the north and east sides of the building to block the wind.l This would leave the west side open, which is where the main entrance to the building is located. The siding would be the same color and texture as the rest of the building. They would also like to move the lighting fixtures up 3 feet on the east and west sides because they will be enlarging the garage door openings on those sides. The Board discussed whether having only one side open posed a fire safety hazard to a person working in that area. Mr. Bates answered that the number of exits required depends first on the use of the building and second on the travel distance. They're proposing a dry sprinkler system in the building, which could be extended into the overhang, which would increase the travel distance. Attorney Brock noted that the public hearing notice states a roof structure over open sides (plural), so it cannot be voted on tonight. When questioned about snow load on the roof, Mr. Bates answered that the building will be designed, to take the load of snow in this area into account. Mr. Couture stated that the open -sided area will be used as storage for maintenance equipment, etc. No work will be done in there as far as repairs. Mr. Bates determined that would be a U occupancy, and that, according to the code, the number of feet before an exit is sufficient. Mr. Couture requested that the Board vote on the drawings in front of them and not on the additional requests. He will take the drawings back to IC and return to the Planning Board if IC decides to modify the project. It might be too expensive to modify. The Board discussed whether the concrete pad could support the weight of the beams from the roof. Mr. Bates stated that IC will have to prove to the building department that it meets code. Board Member Bosak made a minor grammatical amendment to the resolution. This action is consideration of Preliminary and Final Site Plan Approval and Special) Permit for the proposed conversion of the Ithaca College Compost Building, into an unheated storage facility for maintenance materials and equipmnt, located at 123 Farm Pond Road on the Ithaca College campus, Town of Ithaca Tax Parcel No. 41 -1 -30.2, Medium Density Residential Zone. The project involves installing a dry sprinkler system in the building, installing a new water service line, and enclosing any exterior openings in the building with doors or framed wall sections. The project also includes attaching a new roof structure (open sides) on the north side of the Compost Building over top of the existing 50' x 60' concrete pad. The public hearing was closed at 7:58 p.m. Mr. Wilcox asked Mr. Smith about moving the lighting fixtures up. Mr. Smith responded that if the applicant can show that the lights meet the code, they can move the lights up. Attorney Brock (amended the resolution by adding paragraph C regarding revisions made during the meeting. AGENDA ITEM I Letter from Cornell University requesting a time extension regarding the redevelopment lof 380 Pine Tree Road (former Courtside site). Tom LiVigne, director of Cornell real estate, and others from the transportation staff were available to answer questions. Mr. LiVigne explained that they were requesting the extension because they have a project that fits in with their master plan, but they need more time to develop it. Mr. Wilcox asked whether Cornell intended to put in a parking lot, since eventually, they would want to put in housing. Mr. LiVigne said that was a probability. David Lieb: Putting a parking lot in that area would intercept traffic before it entered campus, so it's not going through neighborhoods adjacent to campus, and particularly intercepting traffic going to A Lot. TCAT's new route plan has put more transit through that area, so there are a lot of connections from that location to all parts of the campus. Cornell would want that lot to be on a par with A lot so people are making their choice based on geography rather than price. It would be permit parking. Mr. Wilcox asked Mr. Lieb how a parking lot would affect putting in residential units in the future. Mr. Lieb responded that they are accustomed to making parking lots into building sites. At that time, they would assess whether the parking area was a success at intercepting traffic and making) a good connection to campus, and would then come back to the Planning Board looking for an alternative. Board Member Jon Kanter stated tonight, other than would make sense Planning Staff woul asked what the goal of the discussion was at tonight's meeting. that Cornell was not anticipating asking the Board to do anything sear this initial discussion and provide Cornell direction on whether it to come in with the sketch plan. There was concern that it would becomes an unofficial parking lot, and it actually became a construction staging area for work on the heating plant. That was inconsistent with the Planning Board resolution. Mr. LiVigne stated that Cornell doesn't know at the present time specifically how that area will be developed. The Board discussed whether they'd be comfortable waiting to see at the same time a request for an extension and a sketch plan. Mr. Bates wondered whether, without a resolution, he should write an order to remedy or not. Attorney Brock: i he requirement for the site to be landscaped if it is not redeveloped by March 1, 2010 is a condition of the site plan approval that was granted. She told the Board that if they want to extend the timing on that, they'd have to do a modification of the site plan approval, and that would require a public notice and a public hearing. This Board cannot grant that tonight. The PB can't tell Mr. Bates not to take enforcement action; he needs Ito do what he thinks is appropriate. Board Member Erb noted a plan for a parking lot would require landscaping, but that in the immediate neighborhood, there has been a lot of failure of landscaping that was promised. Mr. Conneman concurred that Cornell has not followed through on their landscape promises. AGENDA ITEM Continue disc 6 ssion regarding possible planning study for growth on West Hill Board Member) Conneman handed the Board a list of suggested recommendations to the Town Board regarding a detailed plan for West Hill development as part of the ComprehensiveI j Plan update. Board Member IBosak would like there to be a time limit on the plan completion. He stated that it is difficult to make individual decisions on specific projects without being able to plug it into an overall plan. Mr. Bosak answered that zoning sets an outer limit; it is not a detailed plan of what the Planning Board wants, and that's the Town Board's job — to provide a blueprint. Attorney Brock disagreed. She stated that zoning is not the outer boundary; it is what's permitted. Perform an environmental review, and if there are negative impacts, you require mitigation . Take each application as it comes in, and do an environmental review. Mr. Bosak argued for looking at the cumulative effect of all known future developments Mr. Kanter mentioned that regarding the Conifer /Cornell and Holochuck developments, the state DOT is (interested in how those two are going to fit together (or not) and in looking at the cu I ulative numbers from those two developments. The Conifer proposal consists of a 60 -unit senior apartment complex, an 80 -unit assisted living complex, a park- and -ride lot with 110 parking spaces, possibly up to 36 townhouse workforce housing units, and the Cornell unspecified piece on 10 or 12 acres of the property, which will have a neighborhood commercial component. Board Member Erb stated that she's excited about this development; it's a logical place to put senior housing since it's near the hospital, and the rush hour workforce traffic serving it will be going out of the city in the morning. Mr. Kanter noted that the Conifer presentation to the Town Board will be Monday, March 8, early in the meeting (which starts at 5:30 p.m.).
