M PUBLIC HEARING 11 Adam Leskevich, Applicant/ Reputed Owner (dba LADA Auto Trade) - 96 Wood Road - TM #28.-1- 54.1 - Proposed Motor Vehicle Repair Shop The Public Hearing was opened at 7:30 p.m. by Chairman Mark Baxendell; the Board Secretary read aloud the Legal Notice as duly published in the Finger Lakes Community Newspapers. Proof of Publication has been placed on file for the record. (It is noted for the record that the applicant appeared at the 15 August 2019 meeting of this Board and explained in detail what he wished to do. At that time, the Board scheduled this Public Hearing. Reference is made to the August Minutes for details of this application.) Chairman BaxendelL recognized the applicant who explained to those present that he would like to build a garage to repair vehicles at the location shown on the aerial map accompanying the drawing. Chair Baxendell asked if there were any comments from the public regarding this application; there was one, as follows: Sheldon Clark, Town Councilman - Mr. Clark asked if the repair shop would be up to Code, and Chair Baxendell responded that it would, and he had reviewed the plans and the procedures performed by the Code Enforcement Officer. With everyone heard who wished to be heard, Chairman Baxendell closed the Public Hearing at 7:33 p.m. II REGULAR MEETING II The Regular Meeting of the Town of Groton Planning Board was called to order by Chairman Mark Baxendell at 7:33 p.m. APPROVAL OF MINUTES — 15 AUGUST 2019 A motion was made by Member Monica Carey to approve the Minutes of 15 August 2019 Planning Board meeting, as submitted. The motion was seconded by Member Ed Neuhauser, Page 1 of 3 (T) Groton Planning Board Minutes of Public Hearing & Regular Meeting 19 September 2019 with the vote recorded as follows: Ayes: Chair Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Member Brockway Abstain: Member Rose Motion carried. This becomes Action #25 of 2019. OLD BUSINESS Adam Leskevich, Applicant/ Reputed Owner - 86 Wood Road - TM #28.-1-54.1 - Proposed Auto Repair Shop (LADA Auto Tradej Chairman Mark Baxendell reported that repairs on their own vehicles will be conducted in the proposed shop by appointment only, and any sales would be online. The applicant stated there would be ten unlicensed vehicles on the property. Chair Baxendell then acknowledged receipt of a 11 September 2019 letter from the Tompkins County Department of Planning and Sustainability regarding this application stating that they had reviewed the proposal and had determined that it had no negative inter -community or County -wide impacts. With no further discussion, a motion was made by Member Leon Brockway, Jr., that the Town of Groton Planning Board declares itself Lead Agency under SEQRA for the proposed business. The motion was seconded by Member Sam Rose, with the vote recorded as follows: Motion carried. Ayes: Chair Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Member Brockway Member Rose This becomes Action #26 of 2019. Member Brockway then read aloud Part II of the Short Environmental Assessment Form. Negative responses were obtained to all questions in Part II. A motion was then made by Member Lisa Maloney Hahn that, based on the information and analysis of the SEQR concerning this application for a proposed Motor Vehicle Repair Shop, the Town of Groton Planning Board has determined that the proposed action will not result in any significant adverse environmental impact, resulting in a Negative Declaration. The motion was seconded by Member Brockway, with the vote recorded as follows: Motion carried. Ayes: Chair Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Member Brockway Member Rose This becomes Action #27 of 2019. Page 2 of 3 (T) Groton Planning Board Minutes of Public Hearing & Regular Meeting 19 September 2019 With no further discussion, a motion was made by Member Barbara Clark to approve the Final Site Plan, as requested, with a limit of ten (10) unlicensed vehicles, and business open to the public by appointment only. The motion was seconded by Member Rose, with the vote recorded as follows: Motion carried. Ayes: Chair Baxendell Nays: None Member Carey Member Clark Member Neuhauser Member Maloney Hahn Member Brockway Member Rose This becomes Action #28 of 2019. Chair Baxendell advised the applicant to contact Town Code Enforcement Officer Rick Fritz. NEW BUSINESS - NONE ADJOURNMENT At 7:50 p.m., a motion was made by Member Clark to adjourn the meeting. The motion was seconded by Member Maloney Hahn, with all members present voting in favor. J n E.
